Legal fees in city audit by Troutman Sanders cost Columbus taxpayers more than $450,000

COLUMBUS, GA. () — The Columbus city government has spent a lot of tax money to investigate claims of illegal activity and misconduct in the city's Finance Department.
The legal fees paid to an Atlanta law firm to investigate the city's Finance Department cost taxpayers more than $450,000, according to information obtained by WRBL through Georgia's Open Records Act. The city has paid the money to Troutman Pepper since 2023. That is strictly funds for legal fees alone and not the cost of a forensic audit that accompanied the Troutman Pepper investigation, according to City Attorney Clifton Fay.
It started in August 2023 when City Councilor JoAnne Cogle made a surprise motion at the end of a council meeting. The motion by the District 7 representative was specific, asking for a particular law firm.
'I would like to make a motion that we hire Troutman and Pepper to work alongside our internal auditor in a previously approved audit with the intention and goal of providing a detailed report of some of the concerns that have surfaced,' Cogle read.
Hiring Troutman Pepper came on the heels of an internal city audit of the Finance Department. That audit suggested, without evidence, that 45 million dollars was missing from city coffers. That is a claim that has been repeated as recently as this week when Mayor Skip Henderson had to correct a citizen who regurgitated it at a public hearing Tuesday night.
Troutman Pepper's detailed report found serious operational and organizational issues inside the Finance Department, but nothing rose to a criminal level..
Troutman Pepper partner Charles Peeler said when his work concluded, 'There is no evidence to support the claim that there is $45.1 million of revenue missing.'
That wasn't the only investigation. The Muscogee County Sheriff's Office recently concluded a 16-month investigation that resulted in two misdemeanor arrests. Finance Director Angelica Alexander was charged with obstruction. Former Revenue Manager Yvonne Ivey was charged with two counts of simple battery. None of the charges were connnected to alleged financial misconduct.
But according to one councilor, the investigations created a deeper divide between the mayor, city manager, and some city councilors.
'We brought in Troutman Pepper and Charlie Peeler to kind of protect the auditor,' District 5 Councilor Charmanine Crabb told WRBL in a May 20 interview. 'They weren't cooperating with her. They were kind of attacking her. And he was supposed to be working for council. And all of a sudden, this investigation comes into play, and he's working for Isaiah and the mayor.'
In that Muscogee County Sheriff's Office investigation that Crabb referenced in an interview with WRBL last month, she called Peeler 'disloyal, lacking honor, integrity, and respect.' Peeler is a former U.S. attorney.
The Troutman Pepper investigation cost taxpayers $456,221.40.
Councilor Glenn Davis and Crabb contend that part of that money paid for investigative work requested by Mayor Skip Henderson and the city manager.
The investigations into the Finance Department were one of the reasons given last week when the city council voted 7-3 to terminate City Manager Isaiah Hugley just seven months short of his retirement. Crabb made that motion to fire Hugley and pay him through the end of December.

Yet our state superintendent and those leaders he's entrusted to serve us appear to be happily doing just that in denying access to one of the most basic records that's long been released through our state's Open Records Act — resignation letters. And Attorney General Gentner Drummond's office, which is supposed to help enforce open records laws, has strangely — and inexplicably — been sitting on the sidelines like a stupified observer as this continues to play out. Walters has seen a number of senior employees exit stage left for greener pastures. He also leads an agency whose administrators have proven that they're not the strongest champions of laws that govern public access. After all, they lost a lawsuit that accused agency leaders of violating First Amendment rights related to public meeting access and face another that contends the Education Department is not complying with the Open Records Act. The latest dustup involves a request Oklahoma Voice filed earlier this year seeking access to all employee resignation letters submitted since Jan. 1. The agency issued a blanket denial, citing a provision of law that it claims bars the release to protect employee privacy and one that allows public bodies to keep documents private if they pertain to an internal personnel investigation. As far as we can tell, there's no indication that any of these employees are subject to any investigation, and for any state agency to inaccurately cite a provision of law inferring such would be reckless and potentially damaging to someone's reputation. One would also hope that there weren't personnel investigations into multiple high-level employees because that would indicate Walters' is making really bad hires. Normally resignation letters are as dry as parched earth, and pretty much every other state agency I can think of typically releases them without issue. Even the State Department of Education used to do so without batting an eye. I've never seen a blanket denial like this. That's why it's so odd that the Department of Education has chosen this hill to die on, and that Drummond's office, which lawmakers have empowered to help the public fight for open records access, has sat idly by, seemingly wringing its hands. A recently leaked scathing resignation letter may shine some light on why the Education Department is so reluctant to release them. The Education Department's former chief compliance officer wrote in her resignation letter that the agency has 'fundamental operational issues' and 'senior leadership attitudes' that will need to be addressed in order to 'achieve the outcomes that Oklahoma students deserve.' She also leveled accusations of 'manipulation of school accreditation and deleting employee review processes,' but did not include specifics. In short, the letter portrays a very unflattering portrait of the inner workings of an agency that receives over $3.8 billion in annual state appropriations and raises questions about its operational integrity. That's something the public deserves to know. And it's why the access to resignation letters should be an undisputed right. Our state is one that believes — or at least used to — that 'people are vested with the inherent right to know and be fully informed about their government.' And that access to government records helps Oklahomans 'efficiently and intelligently exercise their inherent political power.' That's straight from the state's Open Records Act. It's also why Oklahoma agencies have done the right thing and provided resignation letters without argument, particularly for high-ranking officials. It boggles the mind that the Attorney General's Office, which is supposed to have a public records ombudsman to fight for public access, has refused to intervene in this issue and insist upon their release. It's even stranger because last year, Drummond took a swipe at Walters following what he called an 'alarming number of complaints' of his agency's poor compliance with the state's records act and sent a sign he wasn't going to stand for it. But ahead of the publication of our story highlighting our records battle, the Attorney General's Office and its 'public access counselor' refused to comment or address our complaint because of a pending lawsuit involving a single resignation letter. I could see not releasing a single letter that's subject to litigation, but to allow an agency to issue a blanket denial to withhold all undisputed ones is nuts. There seems to be no reason Drummond couldn't have advocated to release the rest. Unless, that is, his office wants to keep our government shrouded in secrecy or he doesn't believe the public should view resignation letters written by public employees. The fight over resignation letters at the state Department of Education proves why lawmakers need to further strengthen public access laws, not water them down. If there's any lingering doubt that these are public, maybe they need to spell it out. This also highlights how critical strong advocacy from the Attorney General's Office is in this realm. Because it's never a good idea to give a government bureaucrat absolute power to determine if the public is entitled to records. In the wrong hands that power can lead to unintended consequences, making government less accountable and accessible to the very people it is supposed to serve. COLUMBUS, Ga. () — A retired Army veteran who is running for mayor of Columbus has been arrested twice since 2018, WRBL has learned. Steven Kelly filed his intent to run for mayor with the Muscogee County Office of Elections and Registrations on Monday. By Tuesday evening, WRBL found Kelly was arrested for DUI in 2018 and then again in early June for a misdemeanor simple battery family violence charge. Kelly confirmed both arrests with WRBL. PREVIOUS COVERAGE: Third candidate jumps into Columbus mayor's race 'I do not run from my past or the challenges that I have faced or will face,' Kelly said in a statement. 'I knew there were issues that would be made public and I still remain committed to transparency, accountability, and the values that have guided me throughout my life: service, resilience, and a dedication to doing better for my family, myself, and for the people of Columbus.' The June simple battery came after a 9-1-1 call to Kelly's residence. He says he has a court date scheduled for next month. The February 2018 DUI case is still pending, Kelly told WRBL. 'Like many in our community, I've faced personal challenges that I'm not proud of, but I believe it's how we confront those challenges that truly defines us,' he said. 'I take full responsibility for my actions and my past.' Kelly spent 20 years in the U.S. Army, retiring two years ago. He says he will remain in the mayoral race. Director of Elections and Registrations Nancy Boren says neither of the charges Kelly faces would disqualify him from seeking the mayor's office. Kelly is one of three people who have declared an intention to run for Mayor. The other two or former City Manager Isaiah Hugley and Mark LaJoye, who has run unsuccessfully four times for sheriff. Federal government posts $6.5 billion deficit in April, May

The federal government posted a $6.5 billion deficit in the first two months of the fiscal year. The result for the April-to-May period compared with a $3.8 billion deficit for the same stretch last year. Revenues increased $26 million, virtually unchanged from the prior year, as increases in customs import duties and pollution pricing proceeds to be returned to Canadians were largely offset by a decrease in revenues from corporate income and goods and services taxes. The Finance Department says program expenses excluding net actuarial losses rose $2.9 billion, or four per cent. Public debt charges increased $400 million, or 3.8 per cent, due to an increase in the stock of marketable bonds and higher consumer price index adjustments on real return bonds.
