'No Grounds To Slash Salary': SC Restores Compensation For Road Accident Victim's Family

The Supreme Court has taken an exception to the reduction of salary of a deceased in computing compensation under the Motor Vehicle in a road accident case, while also emphasising even the children and the parents are entitled to compensation for loss of consortium.
A bench of Justices Sudhanshu Dhulia and K Vinod Chandran restored the order of the Motor Accident Claim Tribunal which awarded a total amount of Rs 23,07,000 to the dependents adopting the salary claimed of Rs 10,000 and reducing 1/3rd for personal expenses while taking 3/4th of 40 per cent of the income of the deceased as future prospects.
The appellants, Hansa Devi and others were the legal representatives of the deceased in a motor accident. They were the widow, three minor children and parents. The deceased was the driver of a truck in which a helper/cleaner was accompanying him. The driver had alighted after parking the truck and when he was boarding the truck, another truck driven rashly and negligently hit him and he died on the spot.
An FIR in the matter was lodged. The claimants sought compensation for the death of the bread winner of the family who was 28 years old when he met with the accident and succumbed.
The Tribunal awarded a total amount of Rs 23,07,000. The wife was granted loss of consortium at the rate of Rs 40,000, the children Rs 25,000 each and the parents Rs 10,000 each. The funeral expenses and loss of estate was also awarded at the rate of Rs 15,000 each.
The Insurance Company filed an appeal before the High Court in which there was considerable deduction made especially on the salary, which was reduced to Rs 4,076 adopting the minimum wages for a driver as Rs 5,434 with 40% future prospects. The claimants were granted only Rs 40,000 towards loss of consortium. The amount awarded was reduced to Rs 12,34,105.
Having the heard the parties, the bench said, 'We find no reason to accede to the reduction of income as done by the High Court".
The court noted the accident occurred on May 08, 2014. In Ramachandrappa Vs Royal Sundaram Alliance Insurance Co Ltd (2011) this court held that even a coolie would get an income of Rs 4,500 in the year 2004. Hence, an unskilled labourer considering the marginal and incremental increase in each successive year at the rate of Rs 500 per year would be entitled to get almost Rs 10,000 in the year 2014, it said.
Thus, the bench said, 'The claim made before the Tribunal with respect to the driver of heavy vehicle getting Rs 10,000 as wages per month must be necessarily accepted".
Insofar as the loss of consortium, the court pointed out, it has been held in New India Assurance Company Vs Somwati and Ors (2020) that even the children and the parents are entitled to compensation for loss of consortium.
'Since no appeal is filed by the claimants from the award of the Tribunal, we do not think there is any enhancement required. Still the award made as compensation for loss of consortium to the children and the parents by the Tribunal has to be retained," the bench said.
Therefore, the court set aside the order of the High Court restoring the order of the Tribunal. The amounts, with interest, as awarded by the Tribunal would be disbursed to the claimants within a period of two months, which would be equally apportioned in the name of the wife, children and parents, it clarified.
'If any of the minor children have not attained majority, the amount shall be kept in a fixed deposit, the interest of which can be disbursed to the mother who is the guardian," the bench further added.

The Delhi High Court has ordered the reconstruction of four-decade-old trial records in a 1984 anti-Sikh riots case, saying the victims' and society's right to a fair investigation and trial cannot be compromised by missing files or flawed earlier proceedings. The directive, issued to the trial court, concerns the acquittal of five men including former Congress councillor Balwan Khokhar in the killing of four Sikhs in Ghaziabad's Raj Nagar. The court said the available material revealed 'several lacunae' in both the investigation and trial. The murders took place on November 1, 1984, a day after then PM Indira Gandhi's assassination. Three women had alleged that their husbands and son were burnt alive. In 1986, the trial court acquitted Khokhar and four others, citing lack of evidence. Now, nearly 40 years later, a bench of justices Subramanian Prasad and Harish Vaidyanathan Shankar WHEN has acted on petitions challenging the correctness of that verdict. The bench had earlier observed that the 1986 judgment appeared 'unsustainable' and noted it was being relied on in appeals by Khokhar, Captain Bhagmal, Girdhari Lal, Mahender Yadav, and Krishan Khokhar against their 2013 conviction for murdering five Sikhs in the same locality. Neither the state nor the victims had appealed the 1986 acquittal at the time. The court said the available material -- composite challans and the final judgments -- revealed 'several lacunae' in both the investigation and trial. Key eyewitnesses were never examined because summons were sent to addresses destroyed or abandoned during the riots. 'A composite challan has been filed for several cases, prima facie reflecting a perfunctory investigation,' the court said in its 66-page order, adding that the matter 'cannot be left to rest at this juncture.' Citing Supreme Court precedent in Abhai Raj Singh, the bench ruled that the trial court must reconstruct the records of Sessions Cases 31 and 32 of 1986, and only then can the High Court assess whether the original acquittals can stand. The matter will be heard next on September 1. 'The valuable rights of victims and the society at large to a free and fair investigation as also a real trial cannot be allowed to be compromised as a result of fait accompli,' the court observed. Senior advocate HS Phoolka, appearing for the complainants, argued that the 1986 investigation and trial were 'thoroughly inadequate and sketchy' and urged that the matters be remanded for retrial. Amicus curiae Siddharth Aggarwal asserted that the court, before giving any findings into the correctness of the judgements passed by the additional sessions judges, was under a mandate to call for the records, examine the same and only then proceed ahead in the matter. He submitted that the trial court records had been weeded out and it was inappropriate for the court to proceed further with the matter without getting the records. Khokhar's counsel had asserted that ordering a re-trial or further investigation, when the records have been weeded out, would violate his client's right to free trial. In a separate 26-page judgment, the same bench directed the authorities to widely publicise the various government compensation schemes available for victims of the 1984 anti-Sikh riots. It further instructed them to verify victims' claims within 16 weeks of receiving them and to disburse the compensation within two months thereafter.

In this seven-month period, over 54,900 accused were arrested, convictions were secured in more than 46,000 cases, and fines totalling over Rs 14.6 crore were imposed on traffic rule violators. The drive also saw large-scale execution of warrants, preventive actions against lakhs of people, and major seizures of narcotics, liquor and arms, said additional director general (law and order) Pankaj Kumar Darad, while addressing a press conference on Monday. He said execution of warrants and other legal orders was robust, with 234,366 summons, 171,561 bailable warrants and 189,932 non-bailable warrants issued from Jan to June 2025. Darad said, "A total of 1,300 criminals were identified for possessing assets acquired through illegal means, with property attachment proposals against 280 of them already submitted to the court. Following this, the court initiated proceedings to seize the assets of seven criminals. Under section 3 of the CCA (Crime Control Act), proposals against 1,662 people were sent to the district magistrates, resulting in orders against 339. Furthermore, under Section 12(1) of the CCA, detention orders were issued against eight criminals, with more actions underway. Further strengthening moves to maintain law and order, 5,174 people were arrested for instigating communal violence, attacks on police, mob violence, and indulging in celebratory firing in the seven month period. He said following strict order against celebratory firing, such cases have come down. "In the checking drives during the period, over eight lakh vehicles were checked, and fines of over Rs 14.6 crore collected. Additionally, seizures of illegal substances and weapons were made, including 91,684 litres of country-made liquor, 64,506 litres of foreign liquor, 159 firearms, 1,018 cartridges, and 941.857 kg of cannabis," he added. Udupi: As part of the Mane Mane Beti, or door-to-door outreach programme launched in July, Udupi District police launched the Drishti Project. SP Hariram Shankar told reporters on Monday that to curb criminal activities, night patrol arrangements were introduced in selected urban and market areas of the district. Tired of too many ads? go ad free now The aim is to effectively prevent theft, crimes against women, and offences involving drug addicts, while also ensuring the safety of commercial establishments, residents living alone, and senior citizens. To strengthen this, a group of 50-100 houses was formed, and security guards were appointed to patrol their assigned areas between 10pm and 6am. Already, 10 groups are functioning. If they come across any suspicious person or incident, they must immediately inform the beat police or the District Police Control Room. The remuneration for the appointed security guards will be borne by the residents. Currently, the Drishti Project has been launched in 12 locations, two each in the Udupi Town, Shirva, and Gangolli police station limits, and one each in the limits of Kundapur, Hebri, Karkala Town, Hiriyadka, Shankaranarayana, and Brahmavar police stations. In the coming days, the programme will be extended to 21 more locations across the district, the SP said. As a continuation of this initiative, Udupi District police, in collaboration with the Udupi District Chamber of Commerce, has planned an ambitious project to install 601 CCTV cameras at 207 junctions and border roads across the district. The estimated cost of this project is around Rs 2.5 crore. The project is called Syena Drishti. In the initial phase, 10 Automatic Number Plate Reader cameras will be installed at the district borders, locations prone to communal tension, and strategic points such as Mala, Hosmaru, and Sacharipete in Karkala Rural police station limits, Sanur in Karkala Town police station limits, Someshwara in Hebri police limits, Amasabailu in Amasebail police station limits, Hosangadi and Dali in Kollur Police station limits, Mel Gangolli in Gangolli police station limits, Malpe Beach in Malpe police station limits, and Udupi City Bus Stand in Udupi Town police station limits. Udupi Chamber of Commerce president Ammunje Prabhakar Nayak and honorary secretary Dr Vijayendra Vasant Kadiyali were present. Additionally, 10 high-quality cameras will be installed at Kalsanka Junction, Karavali Junction, Indrali Bridge, Santhekatte Junction, Service Bus Stand, and Old KSRTC Bus Stand in Udupi City Municipality limits, Mkodi Junction and Kandloor Pete in Kundapur sub-division limits, Baradi and Naravi in Karkala sub-division limits. Footage from these cameras will be continuously monitored by the respective local police stations and the District Police Control Room. "With this, every corner of the district will be covered with CC Cameras, in probably the first of its kind initiative in the country," the SP said.
