Joshlin Smith: NPA says Lourencia Lombaard should be indemnified from prosecution

CAPE TOWN - The National Prosecuting Authority (NPA) said former accused-turned-State witness in the Joshlin Smith trial, Lourencia Lombaard, should be indemnified from prosecution.
Lombaard will hear whether she faces jail time for her role in Joshlin's disappearance in August.
Her testimony proved pivotal to the conviction and sentencing of Joshlin's mother, Kelly Smith, Jacquen Appollis and Steveno van Rhyn.

Lombaard told the court that she witnessed Smith sell six-year-old Joshlin to a sangoma for R20,000 in February 2024.
She was later arrested along with Smith, Jacquen Appollis and Steveno van Rhyn for her role in Joshlin's disappearance.
Lombaard admitted that she agreed to accept money from Smith to keep quiet about the sale of the child.
She later turned State witness and testified against Smith, Appollis and Van Rhyn.
NPA spokesperson Eric Ntabazalila said that the State would argue in Lombaard's favour.
"We believe and we will argue that the court should indemnify her from prosecution."
The matter is set to be heard in the Western Cape High Court in Cape Town on 13 August.

'The estimated budget for the commission over six months is R147.9m.' On Monday the commission chairperson, acting deputy chief justice Mbuyiseli Madlanga, said work had started and they were treating the matter with urgency. The commission is set to begin in August, with the first interim report to be submitted to President Cyril Ramaphosa within the first three months. Madlanga said the inquiry would sit in Gauteng at a soon-to-be-announced venue, as the commission was still procuring premises. The commission comes after serious allegations made by KwaZulu-Natal police commissioner Lt-Gen Nhlanhla Mkhwanazi that police minister Senzo Mchunu and deputy police commissioner for crime detection Lt-Gen Shadrack Sibiya worked in cahoots with criminals. Mchunu and Sibiya have since been placed on 'leave of absence'. Mkhwanazi alleged Mchunu and Sibiya were connected to criminals who run a drug syndicate from Gauteng and they were influenced by criminals to disband the political killings task team which was doing a good job. The commission will also probe: the Tshwane, Johannesburg and Ekurhuleni metropolitan police departments; the National Prosecuting Authority; the SAPS; and the judiciary.

DURBAN - The case involving six men accused of the mass killing of 18 family members in Lusikisiki has been postponed until Wednesday. The victims were gunned down in Ngobozana village last year. The main accused, Mzukisi Ndamase, who's representing himself, asked for more time to review new documents handed over in court on Tuesday. The lawyers for the five other accused also echoed his sentiments in this regard. The six men returned to the special Mthatha High Court sitting in the Lusikisiki Magistrate's Court. NPA spokesperson Luxolo Tyali said: "One of the accused who is representing himself raised an issue with the documents which we furnished them this morning regarding what is contained in the SAP 13 - your chain of evidence, postmortem certificate and exhibits that we picked up at the crime scene." CAPE TOWN - The judge in a high-profile murder trial involving alleged underworld figures has raised concerns about evidence related to two of the accused who are now deceased. Judge Vincent Saldanha has asked the State to justify using evidence against co-accused Mark Lifman and Andre Naude, who, along with three others, have been killed since the start of the trial. Alleged underworld gang boss, Jerome Booysen, and 16 others face a slew of charges related to the murder of "Steroid king" Brian Wainstein in 2017. READ: Trial-within-a-trial in trial of Jerome 'Donkie' Booysen and others continues Security at the Western Cape High Court was beefed up on Tuesday following the murders of co-accused Mark Lifman and Andre Naude, who were shot dead in separate incidents in recent months. Judge Vincent Saldanha on Tuesday warned State prosecutor Nathan Adriaanse about presenting evidence related to slain nightclub security bosses, Lifman and Naude. Saldanha told Adriaanse the State would have to address the court about how it intends dealing with evidence related to the two as they are no longer alive to defend themselves. Adriaanse indicated the prosecution team would be ready with an argument. "Hopefully, we'll be able to persuade the court as to why there should be weight attached to it when the time comes for the argument to take place." The trial continues.
