
This isn't time for court battles: Top court says retain all women officers
This is not the time to have experienced women officers 'running around in courtrooms' or sideline them, said the Supreme Court on Friday, sending a strong message to the armed forces and the government. The court's observation, made during a hearing of the petition filed by Short Service Commission (SSC) women officers who were denied Permanent Commission (PC), came amid the escalating tensions between India and Pakistan.advertisementThe Bench led by Justice Surya Kant made it clear that, for now, the Army must retain those officers still in service. 'There is a better place for them to perform than courtrooms,' Justice Kant said. 'As of date, we would like their morale to be kept high and high like anything.'The court stopped short of passing any order on the merits of the matter but asked the Union government to make transitional arrangements. 'We will decide the legal issues in due course. In the meantime, just utilise their services. It's not your case that they are unsuitable officers,' Justice Kant told Additional Solicitor General Aishwarya Bhati, who appeared for the Centre.
The hearing comes as military personnel are on heightened alert amid hostilities with Pakistan. Justice Kant underscored the importance of experience in the armed forces, saying, 'Of course, the force must always be young ... but young blood also needs to be trained, guided and taught mental temperament. We need a blend of both young and experienced officers.'advertisementReferring to the ongoing situation at the border, he added, 'All of us feel very small before them... That's how much they're doing for us. This is the time when each one of us has to be with them.'Representing one of the petitioners Lt Col Geeta Sharma, senior advocate Menaka Guruswamy argued that Sharma had not yet been dismissed and should be allowed to continue. 'The paperwork shows overwhelming vacancies,' Guruswamy said, adding that Colonel Sophia Qureshi, who recently led the press briefing on Operation Sindoor, wouldn't have had that opportunity had the top court not earlier intervened to secure PC for women officers.Bhati countered the claims, stating that Sharma had already been released from service, having not been found eligible for PC during her board review in 2020. 'She served with distinction since 2011. In 2020, her entire batch was considered. She was not found fit for Permanent Commission. She later received a four-year extension and was finally released in 2024,' Bhati said.Defending the Army's policy, she argued that the service follows a pyramidal structure and can offer PC to only a limited number of officers each year. 'We recruit 600–700 officers annually, but only 250 can be granted PC. The rest can serve up to 14 years. The nation sleeps peacefully because the defence forces are awake,' she said.advertisementThe court remained unconvinced that the present time, when India faces a military standoff with Pakistan, was the right time for the case hearing. 'We are very proud we have a robust and strengthened force,' Justice Kant said. 'Let's not do something that affects morale. Just utilise whoever is there.'In its interim direction, the court said all women SSC officers currently in service should not be relieved until the next hearing. 'We are not creating any equity in their favour,' the bench clarified, 'but we are saying, don't release them until we decide.'The matter will continue to be heard on merits at a later date.

Encroachers can't claim right on public land: Delhi high court
The Delhi high court has ruled that encroachers do not have the right to incessantly occupy public land until their rehabilitation claims are resolved as it is to the detriment of the public at large. Justice Dharmesh Sharma in a ruling delivered on Friday dismissed pleas filed by more than 200 residents of Bhoomiheen Camp in southeast Delhi's Govindpuri challenging the Delhi Development Authority's (DDA) decision to demolish their huts and refusal to rehabilitate them as per the Delhi Slum and JJ Rehabilitation and Relocation Policy, 2015 (2015 policy) 'The right to rehabilitation arises solely from the prevailing policy that binds them. The determination of eligibility for rehabilitation is a separate process from the removal of encroachers from public land. Encroachers cannot claim a right to continue occupying public land pending the resolution of their rehabilitation claims under the applicable policy, as this would unduly impede public projects,' the judge said, in his ruling released later. He added, 'The sum and substance of the aforesaid discussion is that the writ petitions are not only flawed due to the misjoinder of multiple parties with multiple causes of action but also fail to meet the essential threshold provided by the 2015 policy for being considered eligible for relocation and rehabilitation. None of the petitioners has any legal right to continue occupying the JJ cluster incessantly, to the detriment of the public at large.' The plea painted a picture that DDA's action of initiating steps for the demolition of JJ clusters and proceeding with physical eviction without affording due process or considering their documentary evidence was violative of their constitutional right to shelter. In their plea, they had also sought alternative accommodation in accordance with the 2015 policy. DDA had found the residents ineligible on various grounds including their failure to possess a separate ration card for upper floor jhuggi, residing on the second floor, and absence of their name in the Voter List Entry Prior to January 2015. In its order, the court provided relief to 26 residents whose appeals were allowed by the appellate authority but rejected by DDA. Justice Sharma also directed DDA to provide alternative dwelling to another resident whose appeal was allowed by the appellate authority but which DDA failed to provide within six weeks. The judgement comes days after the high court on May 26 and May 30 dismissed pleas filed by over 40 residents, whose names according to DDA were not in the survey list. On Wednesday, DDA had said that the demolition was carried out last month following the dismissal of writ pleas by the high court. The nearly three-decade-old slum cluster was home to migrants from Uttar Pradesh, Bihar and West Bengal, among others, the single-judge bench was told during the hearings. The inhabitants included women who worked as domestic help, labourers in factories and local shops, and others who had meagre sources of income.

'I think that's more a matter of when, as opposed to if,' he said. 'We want to make sure we have the underlying volume in the marketplace that would support those investments.'GE has more than 1,400 engines operating in India, powering both narrow and wide body aircraft and an order book for around 2,500 more. Dhumma's Bluestar event messaging went beyond Gargaj, had a Patna Sahib outreach
Jalandhar: On the 41st anniversary of Operation Bluestar at Akal Takht, Baba Harnam Singh Dhumma-led Damdami Taksal showed it clout by not letting Akal Takht acting jathedar Giani Kuldeep Singh Gargaj to speak or honour the families of the "martyrs" (people who were killed in the Army action in 1984), but the messaging went beyond this. These high priests were barred by Akal Takht on May 21 from 'panthic services'. Both priests, along with three others, retaliated on the same day by declaring the jathedars of Akal Takht and Takht Damdama Sahib "tankhaiya" and summoned Shiromani Akali Dal president Sukhbir Singh Badal. The two high priests in question were Patna Sahib head granthi Giani Baldev Singh and granthi Gurdial Singh. Both, along with three other priests, issued another directive on June 1, giving Sukhbir an extension and asking him to appear before them on June 10 to present his side, warning him with "stringent action" if he failed to do so. To communicate the message further, both were made to stand next to Darbar Sahib head granthi Giani Raghbir Singh when he addressed the congregation. Two others who were made to flank him included Darbar Sahib granthi Palwinderpal Singh, a former student of taksal, and a representative from Takht Hazur Sahib. Baldev Singh also addressed the congregation. Shiromani Gurdwara Parbandhak Committee president Harjinder Singh Dhami also addressed the function, while quite a few granthis of Darbar Sahib and leaders of different sampardas (traditional groups) attended the gathering. Tired of too many ads? go ad free now A press statement issued by the taksal mentioned Raghbir Singh as "jathedar", while former Kesgarh Sahib jathedar Giani Sultan Singh, who is now working as granthi at Darbar Sahib, was mentioned as Kesgarh Sahib jathedar. Both Raghbir Singh and Sultan Singh were unceremoniously sacked from their posts of jathedars in March, and their removal led to a big controversy. Taksal chief Baba Dhumma has been agitating against their removal and has been objecting to Gargaj's appointment and taking charge as jathedar, arguing that 'maryada' was not followed. At the June 6 function at Akal Takht, Gargaj gave his message through the 'ardas'. While Baba Dhumma got an upper hand as his point prevailed, Gargaj, after the function, gained some sympathy from the community members. The tradition of Akal Takht jathedar not giving his message on that day was broken to avert a clash. At that time, Giani Harpreet Singh was acting jathedar of Akal Takht. The May 21 directive also explicitly mentioned that Baldev Singh was not fit to render services at Takht Patna Sahib or in the panthic sphere. Both priests were also asked to appear at Akal Takht and present their side. Until then, they were barred from rendering 'panthic services'. The Akal Takht directive also asked the Takht Patna Sahib management committee to appear at Akal Takht and present its side. Hours after this directive, the five granthis (priests) of Takht Patna Sahib, including Baldev Singh and Gurdial Singh, hit back by declaring Gargaj and Takht Damdama Sahib jathedar Tek Singh Dhanaula 'tankhaiya'. They asked Sukhbir Singh Badal to appear there for "his interference and being a conspirator" in the whole affair and asked the Patna Sahib management committee to not appear at Akal Takht. They also held that from now on, no directive from Akal Takht or from any other yakht would be implemented at Takht Patna Sahib nor complied with. When Baba Dhumma announced his opposition to Gargaj's address, to further buttress his case, he prominently cited the Takht Patna Sahib clergy declaring him 'tankhaiya'. MSID:: 121707935 413 |
