False charge: Chennai bus conductor wins 5-year-long legal battle

(HC) ordered a refund of the recovered amount and settlement of his terminal benefits.
The incident dates back to 2019, when a woman passenger at Chennai Central produced two tickets during a routine inspection - one valid and another soiled one she accidentally picked up from the bus floor.

for misconduct. He alleged that fabricated documents were created to support the charge, leading to a memo against him.
After an internal inquiry, MTC reduced Radhakrishnan's basic pay by three stages with cumulative effect in Sept 2019. His appeal led to a modification - stoppage of increment for six months with cumulative effect. As he retired on Jan 31, 2020, the punishment could not be implemented. Instead, MTC recovered Rs 25,200 from his retirement benefits, claiming it was the monetary value of the unimplemented penalty.
With no response from MTC to his refund request, Radhakrishnan moved Madras HC in Sept 2020. During the trial, his counsel argued that the recovery had no legal backing under Certified Standing Orders applicable to MTC staff. The court agreed, citing division bench rulings that held such post-retirement recoveries as illegal and beyond jurisdiction.
Justice J Sathya Narayana Prasad directed MTC to refund Rs 25,200 and clear all pending retirement dues with 6% annual interest. Welcoming the verdict, Radhakrishnan said, "Officials who impose unlawful punishments and fabricate documents should face disciplinary action, as such practices tarnish the institution and cause personal suffering to workers." The amount was credited to his bank acco-unt last week.

Gandhinagar: The state unit of the Congress party has demanded a Central Bureau of Investigation (CBI) probe into the MNREGA scam in Gujarat. They alleged that minister Bachubhai Khabad, whose two sons were arrested for their involvement in the scam, is obstructing the investigation. Speaking to reporters in Gandhinagar, Amit Chavda, leader of the Congress Legislature Party, said that bills worth over Rs 3 crore were paid without any work being done under MNREGA on 12 land survey numbers belonging to Khabad's family. Chavda said that despite the Congress submitting complaints with evidence of widespread MNREGA-related corruption, the govt has so far investigated cases only in Devgadh Baria and Dhanpur talukas. "A CBI probe will bring to the fore similar corruption cases in different districts," Chavda said.

Lucknow: A land measurement officer posted in the consolidation department of Prayagraj was caught red-handed accepting a bribe of Rs 10,000 by the Uttar Pradesh Vigilance Establishment on Wednesday. Tired of too many ads? go ad free now According to officials, a senior audit officer at the principal accountant general's office approached the department alleging illegal encroachment on his land by two locals, Dharmendra Kumar and Sanjay Kumar. Despite prior measurements ordered by consolidation authorities, one of the accused allegedly manipulated the process to submit a second report without notice, prompting the complainant to seek a fresh survey of his land. When the complainant visited the office on May 30, the assistant consolidation officer informed him that his request was forwarded to consolidation officer Harendra Singh. Upon meeting Singh, the complainant was allegedly told to pay Rs 10,000 to get the fresh land survey conducted with a "favourable report." This prompted the complainant to approach the vigilance department, which verified the allegations and set up a trap. On June 4, the vigilance team caught Harendra Singh red-handed while accepting ₹10,000 near Katra Police Outpost. He was arrested. The vigilance department has appealed to the public to report bribery or corruption by govt officials via helpline numbers 9454404859 (Prayagraj Sector) or 9454401866 (Headquarters).

Berhampore: A Border Security Force (BSF) jawan was forcibly dragged into Bangladesh by a group of Bangladeshi nationals while he was questioning them near the Chandni Chowk border outpost in Suti Police Station area at the Malda-Murshidabad border on Wednesday morning. The jawan — Shri Ganesh of the 71st Battalion — returned after a flag meeting between the BSF and Border Guard Bangladesh (BGB) around four hours later. Initially, it was alleged that the BSF jawan inadvertently crossed into Bangladesh while chasing suspected infiltrators. But a BSF enquiry later found that the jawan was in Indian territory when he was forcibly dragged to Bangladesh. BSF sources said the jawan was detained by locals at Satrashiya village in the Chanpai-Nawabganj district of Bangladesh . A video showed the jawan being tied to a banana tree and being verbally abused by a group of people. Some of them allegedly physically assaulted him, though others intervened to prevent further harm and handed him over to the BGB. BSF officials, however, denied that the jawan was assaulted. A BSF official said: "The jawan was trying to maintain a humane approach and had thus allowed the Bangladeshi nationals to come closer to him considering them normal villagers. But they turned out to be criminals and they overpowered him and took him inside. We will take stern measures to prevent such incidents in the future." BSF officials said the jawan is unhurt.
