Observing incestuous sexual violence by a parent "tears through" the foundational fabric of familial trust, the Supreme Court has upheld a man's punishment for raping his minor daughter.
A bench of Justices Aravind Kumar and Sandeep Kumar called the dignity of women "non-negotiable" while asking the legal system not to permit repeated intrusion into that dignity under the "guise of misplaced sympathy" or purported "procedural fairness".
Justice, the August 4 order said, must not be limited to conviction and must include restitution.
The top court further directed Rs 10.50 lakh to be paid to the survivor as compensation under the state of Himachal Pradesh.
"Incestuous sexual violence committed by a parent is a distinct category of offence that tears through the foundational fabric of familial trust and must invite the severest condemnation in both language and sentence. The home, which should be a sanctuary, cannot be permitted to become a site of unspeakable trauma, and the courts must send a clear signal that such offences will be met with an equally unsparing judicial response," the order read.
The apex court said entertaining a plea for leniency in a case of this nature would not merely be misplaced, it would constitute a betrayal of the court's own constitutional duty to protect the vulnerable.
"When a child is forced to suffer at the hands of her own father, the law must speak in a voice that is resolute and uncompromising. There can be no mitigation in sentencing for crimes that subvert the very notion of family as a space of security," the bench said.
The top court was acting on the appeal of the man against a Himachal Pradesh High Court decision upholding his conviction and sentence under Section 6 (sexual assault) of the Protection of Children from Sexual Offences Act, 2012 and Section 506 (criminal intimidation) of IPC.
The court said such offences deserve severest condemnation and deterrent punishment.
To pardon such depravity under any guise would be a travesty of justice and a betrayal of the child protection mandate embedded in our constitutional and statutory framework, the verdict added.
The bench went on to quote Manusmriti, as saying, 'Yatra nāryastu pūjyante ramante tatra devatā, yatraitaastu na pūjyante sarvāstatra aphalā kriyā (where women are honoured, divinity flourishes and where they are dishonoured, all acts become fruitless)." The top court said this verse reflects not merely a cultural principle but a constitutional vision.
The court rejected the man's prayer for interim bail saying, "Our judicial conscience does not permit casual indulgence in a prayer for interim relief of bail where the conviction has been rendered." The bench said entertaining petition would mean betrayal of the constitutional promise made to every child in the country.
"It would be a judicial insult to the sanctity of womanhood and a blow to every mother who teaches her child to believe in justice." The order continued, "When a father who is expected to be a shield, a guardian, a moral compass, becomes the source of the most severe violation of a child's bodily integrity and dignity, the betrayal is not only personal but institutional. The law does not, and cannot, condone such acts under the guise of rehabilitation or reform." PTI PKS PKS AMK AMK

When she reached a single road towards the passport office side, a person sitting in a small transport vehicle (Chotta Hathi) signalled her and she went towards him. She sat in the vehicle and went along with him. The accused took her to a remote village in Zirakpur and had physical relations with her after striking a deal for ₹4,000. When she asked for the money, he started to beat her and pressed her neck with a handkerchief while threatening her. Both then consumed drugs together. Sanjay then again had physical relations with her forcefully and later locked her in the room. After two days, Sanjay put her into the vehicle by hiding her under the blanket and dropped her near the temple of Sector 44, Chandigarh. Somehow, she reached the dispensary of Sector 45, Chandigarh. She reported the incident to the police and the accused was arrested.

An FIR was registered against BJP MP K Sudhakar and two others on charges of abetment of suicide after death of a 35-year-old contract driver employed under the Zilla Panchayat in Chikkaballapura, reported PTI citing officials. The deceased, M Babu, died by suicide on Thursday morning by allegedly hanging himself from a tree at the Deputy Commissioner's office premises, according to police. Babu reportedly left a suicide note where he named BJP MP Sudhakar and two others, accusing them of being responsible for his death, the police added. The police stated that Babu had been working as a contract driver in the Zilla Panchayat for the past six to seven years and was assigned to the chief accounts officer. 'We recovered a death note from the scene, which mentions several names. We are verifying the allegations and investigating the case from all possible angles," he added. Another senior police officer said the note named BJP MP Sudhakar, a Zilla Panchayat accounts assistant, and a man identified as Nagesh. Babu alleged that Nagesh and the accounts assistant had 'cheated him of several lakhs of rupees", claiming they could help him secure a government job 'using the MP's influence". 'These are serious allegations. A thorough investigation will determine whether the MP was directly involved or if his name was misused. We are examining all angles," the officer said. An FIR has been filed under sections 108 (abetment of suicide), 352 (intentional insult with intent to provoke breach of peace), 351 (2) (criminal intimidation) and 3(5) (common intention) of the Bharatiya Nyaya Sanhita and the relevant sections under the SC and ST (Prevention of Atrocities) Amendment Act, 2015 In the FIR, BJP MP Sudhakar has been named as accused 1, Nagesh as accused 2 and Manjunatha as accused 3. Further investigation is underway. Reacting to the incident earlier in the day, BJP MP Sudhakar told reporters in New Delhi that he was 'deeply pained" by the death but denied any connection to the deceased. 'I heard about the suicide at the DC office in Chikkaballapura. It has deeply saddened me. I offer my condolences to the family. I have never seen or met this person, Babu, in my public life," Sudhakar said. The MP, a former minister and three-time MLA, said he had helped many youths secure employment and did not understand why his name was mentioned in the note. 'I have no information about the other two individuals named in the note. I've heard that Nagesh and Manjunath allegedly promised Babu a job and took Rs 10-15 lakh from him. I don't know them personally," he added. Sudhakar said Nagesh's father-in-law was a former JD(S) taluk panchayat president who joined the BJP after he did. 'We had appointed him as the president of the Chikkaballapura Development Cell," the MP added.

The Supreme Court on Thursday questioned the Enforcement Directorate (ED) for its low conviction rate under the Prevention of Money Laundering Act (PMLA). The apex court said that the agency 'cannot act like a crook". The remarks by the Supreme Court cam during two different hearings by separate benches of the Supreme Court. The court reviewed matters concerning the legitimacy and execution of the PMLA. Both benches voiced concerns about the Enforcement Directorate's investigative practices, extended timelines, and notably low rate of convictions. In the first case, a bench headed by Chief Justice of India Bhushan R Gavai was hearing review petitions challenging its earlier ruling from May 2 in the Bhushan Power & Steel Limited (BPSL) insolvency case. That ruling had ordered the company's liquidation and rejected the resolution plan submitted by JSW Steel. However, the verdict has since been withdrawn, and the review petitions are now being reconsidered. During the hearing, the Enforcement Directorate's handling of the BPSL case came under scrutiny. This led to a tense exchange between the bench—which also included Justices Satish Chandra Sharma and K Vinod Chandran—and Solicitor General Tushar Mehta, who was representing the ED. In response, Solicitor General Tushar Mehta defended the Enforcement Directorate by highlighting the agency's financial recoveries. 'Let me tell a fact which was never said before in any court — ED has recovered Rs 23,000 crore and given it to the victims," he stated, stressing that the funds do not remain with the government but are returned to those defrauded. 'In some of the cases where politicians were raided and cash was found, our machines stopped functioning due to the volume of money… we had to bring in new machines," Mehta further defended. CJI, however, mentioned that judges don't decide matters on narratives. 'I don't see news channels. I only read headlines in newspapers for 10 to 15 minutes in the morning," he said. In a second and separate hearing, a three-judge bench comprising justices Surya Kant, Ujjal Bhuyan and N Kotiswar Singh said that ED cannot act like a crook. The remarks came while the court was hearing review petitions against the 2022 judgment in the Vijay Madanlal Choudhary case. 'You cannot act like a crook. You have to work within the four corners of the law," said the bench. 'There is a difference between law-enforcing authorities and law-violating bodies. See what I observed in one of the cases….it came true in what a minister said in Parliament. After 5,000 cases, less than 10 convictions… That's why we insist improve your investigation, witnesses…we are talking about liberty of people," the bench. Justice Bhuyan added. The bench also raised serious concerns about prolonged incarceration during pending investigations and trials. Addressing Additional Solicitor General SV Raju, who appeared for the Enforcement Directorate, it remarked, 'We are equally concerned about the image of ED also. At the end of five-six years of judicial custody, if people are acquitted, who will pay for this?" Previously, in the Vijay Madanlal ruling, the Supreme Court had upheld several contentious provisions of the Prevention of Money Laundering Act (PMLA). These included the ED's authority to arrest, conduct searches and seizures, impose a reverse burden of proof, withhold the Enforcement Case Information Report (ECIR), and enforce strict bail conditions.
