Husband can't seek wife's private info or passwords: Chhattisgarh HC

A husband has no legal right to demand access to his wife's personal information, including her phone and bank passwords, the Chhattisgarh High Court has ruled, according to a report by LiveLaw.
The observation was made by Justice Rakesh Mohan Pandey while hearing a plea filed by a man whose request for his wife's call detail records (CDRs) was rejected by the Family Court. The petitioner had moved the High Court challenging that order, the report added.
The bench stated that any such compulsion by a husband amounts to a breach of the wife's right to privacy and would invite action under the Protection of Women from Domestic Violence Act, 2005.
'Marriage does not grant the husband automatic access to the wife's private information, communications and personal belongings. The husband cannot compel the wife to share her passwords of the cellphone or bank account and such an act would amount to a violation of privacy and potentially domestic violence,' the Court said, as reported by LiveLaw.
Background
The man filed for divorce under Section 13(1)(i-a) of the Hindu Marriage Act, citing cruelty. His wife denied the allegations. During proceedings, he filed applications with the Senior Superintendent of Police (Durg) and the Family Court, seeking her CDRs on suspicion of an affair. The Family Court dismissed the plea, stating that the information was not relevant to the case, LiveLaw reported.
The High Court upheld that order, noting that the husband had not filed for divorce on grounds of adultery, nor had he established the relevance of the call records. The claim regarding a relationship between the wife and her brother-in-law was raised for the first time in the CDR application.
Citing previous judgments, the Court said that privacy within marriage is protected under Article 21 of the Constitution.
'The right to engage in mobile conversations in the privacy of one's home or office without interference is certainly protected under the right to privacy. Such conversations are often intimate and confidential in nature and constitute an important facet of a person's private life,' Justice Pandey said, as quoted by LiveLaw.
He also observed that while spouses share a life, they do not surrender their individual autonomy or personal boundaries.

To this, the AG responded by saying that prior to the submission of the report by the commission, the stampede case resulting in 11 deaths was entrusted to the CID based on the FIRs registered by Cubbon Park police. The petitioner-company has challenged those proceedings and got an interim order in its favour. According to the company, this denial of opportunity itself renders the report invalid. The petition claimed the authorities failed to respond to their memos filed on July 3, 2025. New Delhi, Aug 13 (PTI) The Enforcement Directorate (ED) on Wednesday questioned former India cricketer Suresh Raina for more than eight hours in an alleged money laundering case linked to an illegal online betting app, official sources said. Raina (38) was seen interacting with CISF personnel and ED staff outside the agency's office in central Delhi before marking his attendance at around 11 am. He left the agency office around 8 pm. The federal probe agency recorded Raina's statement under the Prevention of Money Laundering Act (PMLA) as part of its investigation linked to a sports betting application named 1xBet, the sources said. Raina, who played 18 Tests, 226 ODIs, and 78 T20Is for India, is understood to have been linked to the app through certain endorsements. The ED wanted to understand his links with the app, any endorsement fee earned and the mode of communication between the two parties, according to the sources. The agency recently called representatives of Google and Meta for questioning as part of its probe. It also conducted multi-state searches on Tuesday in connection with a similar investigation against an online betting app named Parimatch. The agency is probing multiple such cases involving illegal betting apps, which allegedly duped numerous people and investors worth crores of rupees or evaded a huge amount of taxes. According to estimates by market analysis firms and probe agencies, there are about 22 crore Indian users of various such online betting apps, out of which half (about 11 crore) are regular users. The online betting app market in India is worth over USD 100 billion, which is growing at a rate of 30 per cent, according to experts. The government last month told Parliament that it has issued 1,524 orders from 2022 till June 2025 to block online betting and gambling platforms. Minister of State for Electronics and Information Technology, Jitin Prasada, told Lok Sabha in a written reply that the Directorate General of GST Intelligence headquarters is empowered as an appropriate government agency under the Information Technology Act, 2000, and the IGST Act to direct intermediaries to block unregistered online money gaming platforms, including offshore online money gaming platforms, violating the IGST Act. He said the suppliers of online money gaming are also being regulated under the Integrated Goods and Services Tax Act, 2017 (IGST Act). 'Under the Seventh Schedule of the Constitution, 'betting and gambling' is a state subject (entry 34 of the List II). Therefore, as per the provisions of Article 246 read with Article 162 of the Constitution, state legislatures have the power to legislate on matters related to betting and gambling," Prasada said. The minister also said the states and Union territories are primarily responsible for prevention, detection, investigation and prosecution of crimes, including action against illegal betting and gambling. 'The Central government supplements the efforts of the states/Union territories through advisories and financial assistance under various schemes for capacity building of their LEA," Prasada said. RANCHI: The recent police encounter of ex-BJP leader Surya Hansda, who had also contested four Assembly polls, has sparked controversy in Jharkhand politics. State BJP president and Leader of Opposition Babulal Marandi, terming the encounter as a 'cold blooded murder', demanded an investigation either by the CBI or under the supervision of a sitting High Court judge. Meanwhile, former Union Minister Arjun Munda will be visiting Hansda's family in Godda on August 17, suggesting that the BJP plans to escalate the issue further. Talking to the media persons, Marandi made a scathing attack on the Hemant Soren government, alleging that 'criminal elements within the Jharkhand police' have taken it upon themselves to frame tribal leaders, seize land for money, shelter mafias and silence dissent through staged encounters. 'The way some police officers in this government are themselves involved in criminal activities by giving shelter and protection to criminals, the leaders in power and opposition and their allies are also facing threat to their lives every day, besides the common people,' said Marandi. Marandi claimed that Hansda was not killed in a police encounter, but murdered by 'cowards in uniform' who feared his activism could mobilise tribals to demand their rights and resources. 'False cases, harassment and constant pressure have become the government's standard way of dealing with protestors,' Marandi said. Hansda's wife and mother have repeatedly accused the police of deliberate murder and they demanded a CBI inquiry; if the Chief Minister Hemant Soren fears CBI, then let a sitting High Court judge lead the probe, he added.
