Nominee doesn't have ownership of insurance policy money: HC

: The Lucknow bench of the Allahabad high court has ruled that a beneficial nominee of an insurance policy does not have ownership of the policy's proceeds.
The court said holding the beneficiary to be a 'beneficial nominee' -- to the exclusion of the legal heirs -- would lead to absurdity, which was never intended when Section 39(7) of the Insurance Act was amended in 2015.
Section 39 (7) provides that a nominee shall beneficially be entitled to the amount payable by the insurer. Prior to the amendment, the nominee of a policy was entitled to hold the amount for the benefit of the successor.
Justice Pankaj Bhatia pronounced the judgment recently on a petition filed by one Kusum of Unnao district of U.P, who was involved in a dispute with her son-in-law and daughter-in-law over the ownership of her daughter Ranjeeta's insurance policies. Kusum had taken out 15 life insurance policies in Ranjeeta's name when she was unmarried.
Ranjeeta married later and a daughter was born to her. However, Ranjeeta died in 2011 when her daughter was 11 months' old.
Since Kusum was a nominee of the insurance policies, she claimed ownership of the proceeds. This was challenged by her son-in-law and granddaughter, who moved the civil court and got a favourable decision.
In revision, the Unnao district judge asked Kusum to deposit the amount of these insurance policies in the form of Fixed Deposit Receipt (FDR) in the name of her granddaughter till she attains age of 18 years.
Kusum then moved the high court to contend that she is entitled to the amounts under the policies as a beneficial nominee. However, she also agreed that apart from the amounts under the policies, her granddaughter would be entitled to her estate as per succession laws.
Considering its findings on the prevalence of succession law over the Insurance Act, the high court dismissed the petition.
Due to the contradictory judgments of high courts on the issue, the court also said it would be fit to take the matter to the Supreme Court.
Observing that the Insurance Act was never enacted by Parliament to govern the rights of succession in respect of the persons who are governed by their individual succession laws, the court said: 'Clearly, the issue of succession would be governed by a specific statute being The Hindu Succession Act and to that extent, the general law as flows from Section 39(7) under the Insurance Act has to give way.'

NEW DELHI: Supreme Court has held that a homebuyer, who seeks refund due to delay in completion of a project, cannot claim that a developer also reimburse the amount paid as interest on home loan. The buyer is only entitled to the principal amount paid to a company and a 'compensation' in terms of the interest on the said amount as per the agreement, it said. It set aside a consumer court order directing the Greater Mohali Area Development Authority to reimburse the interest paid by a homebuyer to a bank on home loan in addition to refunding the principal amount with 8% interest. SC: How buyer funds flat buy not developer's consideration A bench of Justices Sanjay Karol and Prasanna B Varale said there cannot be multiple heads to grant damages and interest over and above what is agreed upon between the homebuyer and the builder. Referring to various SC verdicts, the bench said there were no exceptional or strong reasons for directing GMADA to pay the interest on the loan taken by the homebuyer. The bench said, "Whether buyers of the flat do so by utilising their savings, taking a loan for such purpose or securing the required finances by any other permissible means, is not a consideration that the developer of the project is required to keep in mind. "For, so far as they are concerned, such a consideration is irrelevant. The one who is buying a flat is a consumer, and the one who is building it is a service provider. That is the only relationship between the parties. "If there is a deficiency or delay in service, the consumer is entitled to be compensated for the same. Repayment of the entire principal amount along with 8% interest thereon, as stipulated in the contract, alongside the clarification that there shall be no other liability on the authority, sufficiently meets this requirement." In this case, the Punjab State Consumer Disputes Redressal Commission had directed GMADA to refund the entire amount of Rs 41 lakh along with interest at the rate of 8%, apart from compensation of Rs 60,000 to the buyer for the mental tension and harassment suffered by him, in addition to reimbursing the interest paid by the buyer to banks on home loan. The court said once the parties had agreed for a particular consequence of delay in handing over of possession, then there had to be exceptional and strong reasons to award compensation at more than the agreed rate.

The Quad Leaders Summit is expected to be held in November, with the four members of the grouping now focused on giving shape to an agenda to bolster economic security and maritime security, people familiar with the matter said. The Quad Leaders Summit, which will be hosted by India this year, was earlier expected to be held in September but scheduling and logistical issues have resulted in plans to hold the meet later in the year, the people familiar with planning for the meeting said on condition of anonymity. However, dates are yet to be finalised for the summit, they said. Some Quad members believed September wouldn't be ideal for holding the summit because the focus would be on the UN General Assembly in New York, and the people pointed out that Japan is set to hold elections for the upper chamber of the Diet or the Parliament in July, leaving little time for preparations for a summit. The summit will be preceded by a meeting of the foreign ministers of India, Australia, Japan and the US - the four members of Quad - that is set to be hosted by Washington either in late June or early July, the people said. As preparations have progressed for the summit, the four members of Quad have felt the need to make the agenda more focused so that the grouping can come up with concrete deliverables, the people said. 'There was a feeling that the Quad had spread itself too thin by taking on too many things. There is a need for a more focused agenda,' one of the people said. The focus in shaping the agenda for the Quad Leaders Summit will be on infrastructure and technology, which both dovetail into creating economic security, maritime security and maritime domain awareness, and disaster response, a second person said. The people also said some aspects of shaping the agenda were influenced by the imperatives of the Donald Trump administration in the US. 'The cancer moonshot, which was conceived at the behest of the Biden administration, doesn't appear to be a priority at the moment,' the second person said. The Quad Cancer Moonshot, a global offshoot of a US initiative, focused on reducing the burden of cancer in the Indo-Pacific region, starting with cervical cancer. 'The Quad partners are giving shape to efforts to offer technology and funding for infrastructure across the Indo-Pacific so that smaller countries in the region have more options,' a third person said. The four members of Quad have already done considerable work to bolster the Indo-Pacific Partnership for Maritime Domain Awareness (IPMDA), which was launched in 2022 to combat illegal fishing and counter 'dark shipping'. Last year, the Quad agreed to expand this initiative to the Indian Ocean through the Indian Navy's Information Fusion Centre in Gurugram. The initiative aims to improve real-time maritime monitoring, particularly the identifying and tracking of suspicious or unlawful activities such as 'dark shipping', whereby ships switch off their tracking systems. In addition to the maritime domain awareness initiative, the Quad recently launched the Indo-Pacific Logistics Network (IPLN), which enables the grouping to leverage shared logistics capabilities in the Indo-Pacific to support the response to natural disasters. The people said IPMDA and IPLN reflect the Quad's commitment to a free and open Indo-Pacific and highlight practical cooperation to address regional challenges. Counter-terrorism too is expected to figure in both the upcoming meeting of Quad foreign ministers and the summit, and India will expect support from the other members of the grouping for its new approach to counter cross-border terrorism backed by Pakistan, the people said.
