Chief Justice calls for coordination between government offices and legal services authority
Delivering the inaugural address at 'Legal Services Summit 2025' organised by the Thiruvananthapuram District Legal Services Authority (TDLSA) here on Saturday, the Chief Justice said the Kerala State Legal Services Authority (KELSA) was formed under the Legal Services Authorities Act that was enacted to provide access justice to the most vulnerable sections of society. Each of KELSA's schemes was mirrored in statutory enactments that placed responsibility on government offices to perform the same work as the National Legal Services Authority or KELSA schemes did. The Legal Services Summit was important as it brought together all those working towards a common cause, he said.
'The synergy between legal services authority and statutory authority is not optional; it is a necessity,' the Chief Justice said.
Almost all schemes of the legal services authority worked in the same areas as government departments did. For these schemes to succeed, KELSA could not work in isolation. And without proper coordination, even the best schemes could not reach the people who need them the most, he said.
Giving the example of Samvada or other schemes to help children in trouble or in need of protection, he said these would find their mirror in the Juvenile Justice (Care and Protection of Children) Act, 2015, and the Right to Education Act. The Women and Child Development department and the Education department played a major role in this area.
Giving many more examples, he underlined that the schemes were well planned and there were strong laws, but what was needed was proper coordination and sharing of information by departments with each other and with the legal services authority so that people were not denied justice that they were desperately seeking for.
Justice, he said, could not be delivered in isolation. The promise of access to justice would require multi-pronged action, the Chief Justice said.
High Court judge and KeLSA executive chairman A. Muhamed Mustaque and High Court judge Raja Vijayaraghavan V. spoke. Nazeera S, principal district and sessions judge and chairperson of TDLSA presided. S. Shamnad, senior civil judge and secretary of TDLSA, welcomed the gathering.
Awards were given away to individuals and institutions for their contributions to legal services.
A legal awareness session on 'Gender sensitisation and women-centric laws' and 'Free and competent legal services – an overview' was held as well as an interactive session.
A legal awareness play scripted by the TDLSA and the Kerala Police was also staged.

Kerala HC allows ship owners of capsized MSC Elsa 3 to issue public notice on limited liability
Kochi: The Kerala High Court on Thursday permitted the owners of the capsized vessel MSC Elsa 3 to publish public notices in connection with an admiralty suit filed by them seeking to limit liability for maritime claims arising out of the ship's sinking. The suit was filed under Part XA of the Merchant Shipping Act, 1958, which provides for the limitation of liability of ship-owners in relation to maritime losses. The plaintiffs approached the High Court after several claims were raised against them following the incident. Justice M.A. Abdul Hakhim, while considering an interim application, allowed the plaintiffs to issue notices in multiple publications - all editions of the Malayalam daily 'Malayala Manorama', the Kochi and Mumbai editions of 'The Times of India', and the international maritime journal 'Trade Winds'. In their plaint, the ship-owners included seven defendants who had already lodged claims, and designated "Defendant No. 8" as all persons claiming or being entitled to claim damages. This inclusion, they argued, was to ensure a general public notice and to cover all potential claimants. The senior counsel for the plaintiffs submitted that the limitation of liability is rooted in international maritime law and serves the larger interests of shippers and trade. "There is a public policy purpose in limiting liability," the counsel argued. The defendants' lawyers did not oppose the publication of public notices, prompting the court to pass the interim order. 'This is only for the advancement of justice. It will not defeat the purpose,' Justice Abdul Hakhim orally observed. Senior counsel V.J. Mathew pointed out that the Kerala High Court has not framed separate rules to deal with claims under Part XA. However, the court noted that a coordinate bench had already directed the Registry to number the suit after considering precedents from the Bombay and Andhra Pradesh High Courts. "When the suit is numbered, this court has to proceed with the suit like any other suit," Justice Abdul Hakhim observed. The court directed the plaintiffs to submit a draft of the paper publication within three days, while listing the matter for further hearing on September 18.

Environment Department appeals to public to immerse only eco-friendly clay idols
With the High Court of Karnataka recently stating that it expects the State government to implement the government's order of banning manufacture, distribution, and sale of idols made from Plaster of Paris (PoP) in accordance with the law, Forest, Ecology and Environment Department has appealed to the public to immerse only eco-friendly clay idols in the water bodies. The government had issued an order on September 15, 2023, banning the manufacture, transportation, sale and disposal of PoP idols. Under Section 33(A) of the Water Pollution (Prevention and Control) Act, 1974, the immersion of PoP idols in any water source including rivers, lakes, ponds, dams and wells of the State is prohibited. Hazardous elements 'PoP Ganesh idols are made from powder containing calcium, sulphate, and hemihydrate. It contains many hazardous elements including sulphur, phosphorus, gypsum and magnesium. Such idols are coated with chemical paint containing mercury, cadmium, lead and carbon. When they are immersed in lakes, wells and rivers, heavy metals dissolve and affect the health of people and livestock. Besides, it also leads to the death of aquatic animals,' said Environment Minister Eshwar Khandre. Recently a division bench comprising Chief Justice Vibhu Bakhru and Justice C.M. Joshi passed the order while disposing of a petition filed by the Karnataka State Pollution Control Board (KSPCB), which had sought a direction to the Urban Development Department (UDD) and other authorities of the State to implement the notification issued on September 15, 2023, banning PoP idols The Minister said that the High Court has directed that this government's order be strictly implemented. 'In this context, the public has been requested to worship eco-friendly clay idols and save the environment,' he said. Activists and environmentalists have also welcomed the High Court's direction to the State authorities to enforce a ban on PoP idols. However, despite the ban by State government on the manufacturing of idols, they are available in markets. 'Unless you cut it at the source, their sale will continue. Manufacturers should be penalised heavily. Even if manufacturing of the idols are banned in the State, they are available in the neighbouring States. They should be stopped at the border and also an appeal should be made to the neighbouring States to not to allow them to manufacture these idols which are highly polluting. Until this happens people will have access to these idols,' said T.V. Ramachandra from the Centre for Ecological Sciences, IISc. Another activist, who did not wish to be named, said that this issue props up only during the festive season and that there should be year-long vigil by the concerned agencies so that no manufacturing of PoP idols happens in the State.

KFON OTT services launched
The Kerala Fiber Optic Network Ltd (KFON), the Kerala government's broadband internet service, with over 1 lakh subscriber base and the launch of OTT services has proved all naysayers wrong, Chief Minister Pinarayi Vijayan has said. He was speaking after launching OTT services through the KFON at a function here on Friday. The KFON'S OTT services are being launched with an initial offering of 29 OTT platforms and 350 digital channels. The service will get access to major OTT platforms including Sony Liv, Jio Hotstar, Amazon Prime Lite, Zee5, FanCode, Discovery+, Hungama TV, Playbox TV, among others. The lowest priced plan costing ₹444 per month offers Internet at 45 mbps, 22 OTT platforms and 350 digital television channels. The ₹599 scheme offers Internet at 55 mbps, 26 OTT platforms and 350 digital television channels. The ₹799 scheme offers Internet at 105 mbps, 26 OTT platforms and 350 digital television channels. The ₹899 scheme offers Internet at 65 mbps, 29 OTT platforms and 350 digital television channels. 'When we launched the KFON project, a few people had attempted to scuttle it. Before the launch, they claimed that it would never become a reality. When they realised that the project was on track, they attempted to derail it with fake allegations. Some persons even approached the High Court with this demand, but the High Court asked them whether their litigation is out of public interest or for publicity. The government never gave in to these tactics and implemented the project as intended,' said He said that KFON has ensured high speed Internet access to villages as well as cities. As many as 103 connections have been provided in the tribal villages of Kottur and 396 connections in Attappadi. All government offices, the legislative Assembly and the Secretariat are currently using KFON connections, he said. Across the State, the total Internet connections through KFON now stand at 1.15 lakh, with a total of 74,203 home connections, 23,163 connections to government offices, 14,194 connections to below poverty line families, 3,044 enterprise connections, 10 darkfiber connections and 15 connections for special events.
