
Newport HMO application turned down over flood risk
The applicant sought approval for the change in use, but the application was rejected on May 10.
The refusal was based primarily on the lack of a Flood Consequences Assessment (FCA), given that the property is in Flood Zone 3 – Sea, a high-risk area.
The ground floor bedroom, in particular, was highlighted as having no adequate first-floor flood refuge, with only the landing and communal bathroom as possible refuge spaces.
These were considered insufficient based on a relevant precedent.
Consequently, the application was found to be contrary to Planning Policy Wales, TAN15 (2025), and policies SP3, GP2, H8 of the Newport Local Development Plan (2011–2026).
Residents in the area raised several objections to the application, primarily concerning parking problems and congestion, especially with visitors to a nearby One Stop Shop.
There were also complaints about noise and anti-social behaviour, often associated with the transient nature of HMO tenants, as well as concerns about rubbish overflow, pest issues, and property value depreciation.
One resident noted: "There seems to be a considerable rise in houses of multiple occupancy in our road which is placing a significant strain on parking..."
Another commented: "HMOs, if not properly managed, can sometimes lead to an increase in anti-social behaviour..."
Councillors Matthew Pimm and Deborah Davies also objected to the application.
Councillor Pimm highlighted the issue of overdevelopment and the lack of suitability of the terraced houses for HMO use.
Councillor Davies raised concerns about parking safety and security, particularly for lone women at night, and requested a parking survey.
The Highways Officer also objected due to the lack of off-road parking, inadequate cycle and refuse storage, and access issues.
Natural Resources Wales noted that the property is in Flood Zone 3 – Sea and stated that the flood risk was increased due to the intensification of use.
They also advised conducting a Flood Consequences Assessment, which was not provided.
The Waste Manager indicated a standard 120-litre bin allocation with kerbside recycling, with no issues as long as the bins meet the specified requirements.

A report had noted that objections had come from the Environmental Health (Public Protection Service) at the council. Its "primary concerns" related to the proximity of the premises to nearby residential properties. "While there are other licensed premises nearby (including pubs), the service notes that cumulative impact must be considered," the service had said. "The introduction of a late-night takeaway could increase footfall and late-night activity in the area, particularly noise from customers leaving or gathering outside the premises, as well as from food deliveries and pick-ups." It had also pointed out that "once customers leave the premises, the applicant has limited ability to control associated noise which could disturb residents". It noted that a planning condition had required the premises to close at 11pm, with any later opening currently permitted only under Temporary Event Notices. There was also "no specific details provided" regarding ventilation and extraction systems, which could "contribute to noise or odour concerns". The officer had also noted in their report that the business was "in breach of a current retrospective planning permission, granted in 2024". This was regarding a retrospective change of use from a shop to a mixed use site, which "states that details of any extractor units, fans or associated equipment shall be submitted to and approved by the local planning authority prior to their installation if the property changes ownership". It adds: "The equipment shall be installed and used in accordance with the details as agreed." Overall, the service concluded that regular opening until 2am "may significantly increase noise levels and disturbance in an otherwise quiet residential area and could undermine the objective of preventing public nuisance". The council's planning service had initially objected to extending the hours, as the premise was subject to a planning condition limiting operation between 8am and 11pm, Monday-Sunday. At the time of their response, a planning application to amend these hours had been submitted but was not yet valid. Since then, the application has been validated and was under consideration. "It should be noted that the hours requested under the planning application extend only until 1am," the report said. In response, the applicant had also proposed reducing the operating hours by one hour, and had also highlighted a conflict with the existing planning permission. The business also proposes to use 16 cameras, internally and externally, employ staff trained in dealing with unpleasant/drunk and disorderly customers, to use two large flood lights on the building front, have staff ensure that customers do not crowd outside, and to clean the "whole way up the street" after closing. One objecting member of the public raised concerns over the potential for increased public disturbance and anti-social behaviour. They felt there were "risks to public safety" due to the narrow and busy pedestrian route, and that access for emergency services if needed at night could prove "problematic". They also had concerns about "a negative impact" on a historic location, and the "exacerbation of existing litter issues". North Wales Police gave no objection, stating there was "no evidence of crime or disorder directly associated with the premises". Caernarfon Town Council unanimously supported the application, acknowledging that the premises neither sold alcohol nor played music, and actively discouraged on-street parking. "The applicant has also demonstrated a commitment to being a responsible neighbour through measures such as CCTV monitoring and regular street cleaning," it said. It had noted that the shop signage was "not consistent" with the overall appearance of the street. The committee was told in the report if it was "inclined to approve" it should recommend conditions requiring door security included on the licence, and that the approval aligns with the planning application. Martin Lewis gives major update on car finance scandal with £950 payouts owed
Martin Lewis has issued a major update in the landmark car finance mis-selling case that could see millions of drivers paid substantial compensation. The Financial Conduct Authority (FCA) has confirmed it is launching a consultation on a compensation scheme which it says could cost finance lenders up to £18 billion. A Supreme Court ruling on Friday (1 August) found that lenders are not liable for hidden commission payments in car finance schemes, a decision which means most of the claims will not go ahead, but only the most serious claims will be eligible for compensation. But many cases in a separate strand of the car finance mis-selling case, which was not part of the Supreme Court ruling, are still likely to receive payouts. The FCA is now urging those who believe they may be affected and have not already complained to do so now. Mr Lewis has launched a tool through his Money Saving Expert service to help people do this. Both he and the financial regulator are also warning people against signing up to a claims management company to support their complaint at this stage. This is because the redress scheme will like be automatic and require lenders to get in touch with those affected directly. If an agreement has already been made with a claims firm when this happens, the individual may have to pay up to 30 per cent of their compensation to them, despite the firm not needing to do any work. Here's everything you need to know about the situation: Am I eligible for the car finance compensation scheme? Mr Lewis explains that there are 'two strands' of the car finance mis-selling case. Discretionary Commission Arrangements (DCAs), which Mr Lewis says will be the main form of compensation to come out of the consultation, were not involved in the Supreme Court case, he said. 'The one most people have complained about wasn't involved in the Supreme Court decision, although it was on hold just in case anything in that decision caused a wobbler for DCAs,' Mr Lewis added. DCAs were banned in January 2021, so anyone with a personal contract purchase (PCP) or Hire Purchase (HP) deals before then, is likely to have unknowingly agreed to one. 'It is when you went to a car broker or dealer and it increased the amount of interest that you were charged to increase the amount of commission without telling you,' Mr Lewis explained. Those who had PCP or HP deals are 'likely to get compensation under this scheme'. But Mr Lewis notes that those who had 0 per cent interest, or whose commission was very small, are unlikely to receive compensation. But he says that for most people, the compensation will be in the hundreds of pounds. The other strand of the mis-selling case is the one element of the Supreme Court case which was upheld by the court - with the other two being dismissed. This refers to commissions which were 'manifestly unfair', Mr Lewis explained, adding that it is harder to define because it was done on a case-by-case basis. Factors in the payout may even include how vulnerable you are - and whether it is therefore seen as more unfair for the commission to have been so high. As this is done case-by-case and it is not a blanket issue like the DCA cases, it is unclear how the compensation scheme will work for these, Mr Lewis said. How much could I be compensated? The FCA estimates that most individuals making claims will receive 'less than £950 in compensation per agreement'. The final cost of a compensation scheme will depend on the final design which it takes, the FCA added in its statement earlier today. The first payments are forecast to be made in 2026. For DCA cases, the maximum you could receive is all of the commission you paid, Mr Lewis said. It is more likely you will be paid the higher interest rate you were charged minus the standard interest rate. A simple interest - meaning the interest is calculated on the original amount of the loan - of roughly 3 per cent per year will be added on top of the payout, Mr Lewis added. 'The very high likelihood is that many people who had a discretionary commission arrangement where they were charged more interest than they should have been will get back a chunk of that in the hundreds of pounds at some point in 2026,' he said. But the expert warned that the industry could 'fight this hard', before he urged industry members to accept the 'fair compromise'.
