Harvey Weinstein guilty of sexual assault in landmark retrial

Daily Recorda day ago

Harvey Weinstein now faces fresh prison time after jurors found he forced a woman into a sex act in 2006.
Disgraced Hollywood mogul Harvey Weinstein has been convicted of one count of sexual assault in his sex crimes retrial.
The 73-year-old was acquitted of another, and jurors were as yet unable to reach a verdict on a third charge, reports the Mirror.

Weinstein, who denies ever raping or assaulting anyone, sat emotionless in court as the split verdict was delivered. It marks a partial victory for both prosecutors and his defence, as the case continues to divide public opinion

He denies sexually assaulting or raping anyone.
His initial conviction came five years ago after the landmark #MeToo Movement. However, last year it was overturned.
The case went back for a retrial in the same Manhattan courthouse.
Now, the jury convicted the former studio boss of forcibly subjecting one to a criminal sex act in 2006. They also acquitted Weinstein of another criminal sex act charge from 2006.
The jury remains in deadlock over claims he raped another woman in 2013. Under New York law, the third-degree rape charge carries a less severe penalty than the first-degree criminal sex act offence.

Jurors – seven women and five men – are now in their fifth day of deliberations and earlier today re-heard dramatic testimony from Jessica Mann, who says Weinstein raped her in a hotel room in 2013. She has waived her right to anonymity.
Weinstein has pleaded not guilty to raping Mann and to forcing oral sex on two other women, Mimi Haley and Kaja Sokolo. He insists that he never sexually assaulted or raped anyone. His legal team claims the women were ambitious opportunists trying to boost their careers in the movie business.
Mann told the court her relationship with Weinstein started consensually but turned abusive. Despite this, it continued for some time. Weinstein was convicted in 2020 of raping her and assaulting Haley, but that conviction was overturned last year due to concerns over how the jury was influenced.

Sokola added her accusation last year after New York state's highest court overturned the 2020 conviction and sent the case back for retrial. Weinstein is also appealing a 2022 rape conviction in Los Angeles.
All three women in the case have waived their right to anonymity. Weinstein is facing a retrial after New York's highest court overturned his 2020 conviction last year, ruling that prejudicial testimony had unfairly influenced the original outcome.
He will be retried on two of the original charges; raping an aspiring actor in a Manhattan hotel in 2013, and forcing oral sex on a production assistant in 2006.

A third, unnamed woman also came forward in this retrial with fresh claims. Weinstein has pleaded not guilty to all charges.
He is currently being held at Rikers Island, where his lawyers say he's endured shocking conditions. They've filed a $5 million lawsuit against New York City, claiming "substandard medical care" and unsanitary conditions.

Simon Cowell admits big worry about son Eric and says he's 'petrified' of one thing

Simon Cowell has opened up about being a father and how precious his 11-year-old son Eric is to him in a rare interview with Jeff Brazier. Simon Cowell has candidly discussed fatherhood in an interview with This Morning's Jeff Brazier. During the touching interview ahead of Father's Day this weekend, the 65-year-old spoke about how becoming a dad changed him while also voicing his concerns for his 11-year-old son. ‌ Simon welcomed his only child Eric in February 2014 with partner Lauren Silverman. The music mogul mostly keeps his family life private but Britain's Got Talent fans were treated to an unexpected onscreen appearance of Erin during an epic Golden Buzzer moment during the latest series of the show where Simon let his son press the famous buzzer. ‌ During the 2024 series, he also revealed his son was a keen drummer and now he has shared even more rare information about his boy. Speaking to father of two Jeff, Simon shared how much his son means to him. He said: "Honestly, everything. Out of everything I've ever done in my life, this is the best thing to ever happen to me. The very first time I saw his scan, I was literally obsessed." However, Simon confessed there were some down sides to parenthood as he shared his concerns for his son growing up in the modern world, the Mirror reports. He said: 'We're getting to a point where the word phone comes up. 'Oh god, here we go". ‌ The 65-year-old previously revealed he doesn't have his own personal mobile phone device. He continued: 'I'm very worried Jeff, about how much kids can see at a certain age. I grew up…Which was learning things at the right time, the right age, etcetera etcetera. I just would be petrified of him having access to anything, that would really worry me. ‌ 'I think schools put too much pressure on kids, which is, you're getting up at seven in the morning, you're coming home say at five, six in the afternoon, evening and then you've got to do two hours of homework. "It's like, they're ten, eleven, twelve years old. It's too much. I would say to any teacher watching, ban homework, you'll have happier kids and they'll do better.' Despite his demeanour softening over the years, Simon has made a name for being the mean judge, starting from his stint in 2001 on Pop Idol. ‌ When asked by Jeff what he'd do if his son wanted to get into the entertainment industry, Simon insisted he would be "absolutely honest" with him. He laughed: 'I've thought about this. What if he said to me, 'I want to be a singer' and he couldn't sing, I would be absolutely honest with him. If he couldn't, I would say, 'You know what, be a drummer'. "He actually can play the drums well but he's quite shy. You know, I walk and I hear him, and he stops. I say, 'Why are you stopping?' and he says, 'Well, I'm a bit embarrassed' and I say, 'Well don't be, you're really good.'

Weinstein case judge declares mistrial on remaining rape charge amid jury issues

The outcome positions the former studio boss for a third New York trial — prosecutors said they're ready to retry the rape count — even as he faces a new sentencing on his sexual assault conviction. Weinstein, 73, denies all the charges and had complained to the judge before Wednesday's partial verdict that it was unfair to continue amid jury tensions. He had a blank, drained expression as court officers escorted him out on Thursday in the wheelchair he uses due to various health problems. He has been behind bars since his initial conviction in 2020 and he was later sentenced to prison in a separate California case, which he's appealing. He's due back in court on July 2 for discussion of retrial and sentencing dates. His first-degree criminal sex act conviction carries the potential for up to 25 years in prison, while the unresolved third-degree rape charge is punishable by up to four years — less than he already has served. In Wednesday's partial verdict, Weinstein was convicted of one charge but acquitted of another. Both of those charges concerned accusations of forcing oral sex on women in 2006. Those verdicts still stand. While the jury of seven women and five men was unanimous on those decisions, it got stuck on the rape charge involving another woman, Jessica Mann, who also said she had a consensual sexual relationship with Weinstein. Jury-room strains started leaking into public view on Friday, when a juror asked to be excused because he felt another was being treated unfairly. Then on Monday, the foreperson complained that other jurors were pushing people to change their minds and talking about information beyond the charges. The man raised concerns again on Wednesday, telling the judge he felt afraid in the jury room because another juror was yelling at him for sticking to his opinion and at one point suggested the foreperson would 'see me outside'. When Judge Curtis Farber asked the foreperson whether he was willing to return to deliberations, the man said no. And with that, Mr Farber declared a mistrial on the rape count. Mr Farber said he later spoke to the other 11 jurors, and 'they were extremely disappointed' by the outcome. 'They all thought they were involved in a normal discourse, and they don't understand why the foreperson bowed out,' Mr Farber told Weinstein and the lawyers in court. Ms Mann, a hairstylist and actor, gave evidence for days — as she did in 2020 — about the rape she said she endured in a Manhattan hotel room and about why she continued to see and have consensual encounters with Weinstein afterward. She is ready to return to the witness stand a third time, prosecutor Nicole Blumberg said. In a statement on Wednesday, Ms Mann said that coming forward 'cost me everything', including privacy. 'Still, I stood up and told the truth. Again and again,' she said. Weinstein's initial conviction five years ago seemed to cement the downfall of one of Hollywood's most powerful men in a pivotal moment for the #MeToo movement against sexual misconduct. But that conviction was overturned last year, and the case was sent back for retrial in the same Manhattan courthouse. Weinstein's accusers said he exploited his Tinseltown influence to dangle career help, get them alone and then trap and force them into sexual encounters. His defence portrayed his accusers as Hollywood wannabes and hangers-on who willingly hooked up with him to court opportunity, then later said they were victimised to collect settlement funds and #MeToo approbation. Miriam Haley, the producer and production assistant whom Weinstein was convicted — twice, now — of sexually assaulting, said outside court on Wednesday that the new verdict 'gives me hope'. Accuser Kaja Sokola also called it 'a big win for everyone,' even though Weinstein was acquitted of forcibly performing oral sex on her when she was a 19-year-old fashion model. Her allegation was added to the case after the retrial was ordered. The Associated Press generally does not name people who say they have been sexually assaulted, unless they agree to be identified. Ms Haley, Ms Mann and Ms Sokola did so.
