Co accused in NSEL scam discharged under IBC clause granting immunity
Mumbai: Dunar Foods Ltd, an accused in the 2016 NSEL scam case involving alleged cheating and siphoning of funds, has been discharged from criminal proceedings. The court's decision was based on Section 32A of the
Insolvency and Bankruptcy Code
(IBC), which grants immunity to corporate debtors once a resolution plan is approved and management changes hands.
In a recent order, special judge V P Desai referred to citations and said it was crystal clear that once the resolution plan forwarded by Resolution Professional is accepted by the NCLT, immunity cannot be denied to the corporate debtor. "The provision of section 32A is not to shield the wrongdoers. The extinguishment of the criminal liability of the corporate debtor is apparently important to the new management to make a clean break with the past and start on a clean slate.
It must also not overlook the principle that the provision is part of an economic measure," the judge said.
The judge further said that, thus, though it can be gathered that the company was involved in the offence committed by the prime accused, Surender Gupta in conspiracy along with others, as the resolution plan is accepted by NCLT, there is immunity to the corporate debtor. "Therefore, in view of section 32A (1) of IBC, as the corporate debtor cannot be liable for criminal proceedings committed prior to commencement of the Corporate Insolvency Resolution Process, M/s Dunar Foods Ltd needs to be discharged," the judge said.

The CBI alleged a conspiracy was hatched between 2007 and 2013 to defraud M/s PEC Ltd of approximately Rs 120 crore through fraudulent agro-commodity trades on the NSEL platform, with Dunar Foods Ltd identified as a major beneficiary.
However, Dunar Foods Ltd sought discharge, arguing its financial creditor, State Bank of India, initiated insolvency proceedings. A resolution plan was approved by the National Company Law Tribunal on Nov 26, 2019, leading to a change in the company's management with a man being appointed as the Successful Resolution Applicant.
The defence submitted that the new management, having paid the entire amount along with interest under the approved resolution plan, should not face ongoing criminal proceedings due to the protection offered by Section 32A of IBC. They cited several Supreme Court and high court judgments, emphasizing on the principle of a "fresh slate" for successful resolution applicants, preventing them from being burdened by pre-existing claims.
The CBI opposed the plea, submitting allegations of fraudulent transactions and the company's alleged role as beneficiary of misappropriated funds. But the court noted CBI's arguments did not specifically address the applicability of Section 32A of IBC. The judge said the resolution plan for Dunar Foods Ltd was approved on Nov 26, 2019, and the company's criminal liability ceased from that date.

Earlier today, police disclosed that Sonam Raghuvanshi, the prime conspirator in the murder of Raja Raghuvanshi, had insisted on proceeding with the killing despite others withdrawing their support. This determination reportedly played a crucial role in the tragic event. Authorities have since arrested Sonam's alleged boyfriend, Raj Kushwaha, along with three contract killers—Vishal Chauhan, Akash Rajput, and Anand Kurmi—in connection with the case. Sonam herself was taken into custody in Ghazipur, Uttar Pradesh, and is currently held at Shillong Sadar Police Station in Meghalaya. Sonam Raghuvanshi's brother Govind visited his sister's in-law's household on Wednesday. At the residence Govind and Raja Raghuvanshi's brother Vipin held a joint press conference. There Govind said, 'According to the evidence found so far, I am 100% sure that she has committed this murder. All the accused in this case are related to Raj Kushwaha. I apologise to Raja's family.' Govind also informed that their family had broken ties with murder accused Sonam Raghuvanshi. 'I don't have an idea if she (Sonam) has confessed to the crime, but I am saying that she has done it. I am with Raja... I will boycott Sonam.' Govind said. "Our parents have also accepted it. They were not aware of the details earlier today. I was in flight. Not only my family but the entire society will boycott her (Sonam). I have apologised to the (Raja's) family. I will always stand with them." he added. Earlier on June 6, Govind had sought a CBI probe into the missing Indore couple's case, and asked Meghalaya CM Conrad Sangma to treat it as a case of abduction, and not look for her dead body. Vipin Raghuvanshi, brother of Raja Raghuvanshi, revealed that Govind, Sonam Raghuvanshi's brother, had been in contact with him. He explained that Govind had informed him of his intention to visit his house to make a confession. Govind wanted to admit that his sister had committed a grave mistake and expressed that she deserved the death penalty for her actions. Raj Singh Kushwaha's mother has vehemently claimed that her son is being 'trapped' in the murder case and insisted that he 'could never do something like this.' The 21-year-old, who is alleged to be Sonam Raghuvanshi's boyfriend, was arrested by police for his purported involvement in conspiring to kill Raja Raghuvanshi in May. 'My son is not like that; he can never do something like this. He is very young and used to taking care of his three sisters after his father passed away. He started working at Govind's (brother of Sonam Raghuvanshi) office. My husband passed away in 2020. After that, Raj has taken care of our family,' Kushwaha's mother was quoted as saying by ANI. According to the Meghalaya Police, Indore businessman Raja Raghuvanshi's wife Sonam (25) was allegedly involved in the conspiracy to murder him with her alleged lover Raj Kushwaha (20). The duo had hired three killers to execute the plan. Raja Raghuvanshi (29) and his wife Sonam got married here on May 11. They went missing during their honeymoon in Meghalaya on May 23. Raghuvanshi's body was found in a deep gorge near a waterfall in Sohra area (also known as Cherrapunji) of East Khasi Hills district on June 2. Sonam and her aides were arrested from Indore in Madhya Pradesh and Ghazipur in Uttar Pradesh recently for their alleged role in conspiring and killing Raghuvanshi.

CBI busts cybercrime racket: Recovers ₹2.8 crore cryptocurrencies; one arrested
As part of its ongoing crackdown on cybercrime under the 'Chakra-V' operation, the Central Bureau of Investigation (CBI) carried out raids at three different locations. The CBI seized crime proceeds in the form of Virtual Digital Assets (VDAs) valued at ₹ 2.8 crore, along with unaccounted cash worth ₹ 22 lakh from the suspect's possession. One individual has been arrested in connection with the case and is being presented before the Special CBI Court. Importantly, the CBI has developed in-house expertise for handling and seizing VDAs as part of its tech-driven strategy to fight cybercrime. The agency has also implemented systems to manage these digital assets in line with legal requirements and has been consistently detecting and confiscating VDAs in multiple operations, said the release.

‘Was attacked in Meghalaya, Raja died saving me': Sonam Raghuvanshi spins new story in honeymoon murder case
In a dramatic spin to Raja Raghuvanshi's murder story, his wife Sonam Raghuvanshi, who is the prime accused in the case, has now claimed that both she and Raja were attacked, and that he died trying to protect her. Her version of events, however, is being closely scrutinised. While Sonam alleged she was kidnapped, police suspect her claims are part of a larger conspiracy. Her father, Devi Singh Raghuvanshi, has accused the Meghalaya Police of making false allegations and called for a CBI investigation. On the other hand, Raja's mother, Uma Raghuvanshi, maintains her son was lured to Shillong under false pretences. The case has seen multiple twists since the couple was first reported 'missing' on May 23 during their honeymoon. Initially, the families criticised the Meghalaya government for not acting swiftly. On June 2, Raja's body was found in a deep gorge near a waterfall in Sohra, East Khasi Hills district. Investigators believe the murder occurred on the same day the couple went missing. According to a Live Hindustan report, Sonam told Sahil, the owner of a roadside eatery where she was found, that she married Raja Raghuvanshi in May 2025 and the two went to Meghalaya for their honeymoon. She claimed some men tried to snatch her jewellery and Raja died trying to protect her. She added that she lost consciousness and did not know how she reached Ghazipur. Police have rejected this version. Meghalaya Police say Sonam planned Raja's murder with her alleged partner Raj Kushwaha and three contract killers. Meghalaya deputy chief minister Prestone Tynsong stated that several suspects in the murder case of Indore-based businessman Raja Raghuvanshi have confessed, and that his wife Sonam Raghuvanshi is "fully involved." He confirmed that the accused were arrested from Madhya Pradesh and Uttar Pradesh by a Meghalaya Police SIT, and that Sonam was the main suspect. Tynsong said, 'Some of them have also confessed to the crime they committed… The moment we were able to pick Sonam Raghuvanshi, being the prime suspect in the killing, we all came to know that she is fully involved in this operation during their stay here in Meghalaya.' Some reports suggest Sonam was prepared to push Raja off a cliff herself if the hired killers failed to act. After the incident, Sonam is believed to have driven from Shillong to Guwahati, and then boarded a train to Indore, reaching the city by May 27. The next day, May 28, she travelled to Ghazipur—hometown of her alleged lover Raj Kushwaha, who is also an accused in the case—where she was eventually arrested on June 9, according to Indore Police.
