Zandile Gumede fraud case, back in court
Former eThekwini mayor Zandile Gumede and her 21 co-accused were charged with multiple counts of fraud, racketeering, corruption, money laundering, contravention of the Municipal Finance Management Act and the Municipal Systems Act, relating to the Durban Solid Waste (DSW) tender worth more than R320 million.
The media has been prohibited from naming State witnesses in this matter.
During proceedings at the Durban High Court, the State put it to the current witness that the figures for household numbers in the tender's bid specification were provided by Allan Robert Abbu. Abbu, at the time, was the Deputy Head for cleansing and solid waste.

Lolitha Kowa's alleged killers abandon bail
CAPE TOWN - The alleged killers of seven-year-old Lolitha Kowa have abandoned bail in the Khayelitsha Magistrates Court. Their alternative addresses could not be secured. Odwa Jack and Nokuthula Matyeseni are accused of the murder and sexual assault of the girl, whose body was found dumped near her home in Kuyasa last month. She was last seen playing with Matyeseni's daughter. Their Legal Aid lawyer has told the court that the families of the accused are refusing to take them in, should they be released on bail. Magistrate Brendale Abrahams postponed the matter until October. "Your matter is now remanded to the 22nd of October for further investigation purposes. You both will remain in custody, and you will not be brought to court on the next court appearance. You will appear via Audio Visual Remand (AVR) System." The State said it's still awaiting the postmortem and DNA results taken from the deceased child.

Amantle Samane's mother urges court to hand 3 life sentences to her daughter's killer
JOHANNESBURG - The mother of six-year-old Amantle Samane has urged the Johannesburg High Court to hand down three life sentences for the man who kidnapped, raped and murdered her daughter. The accused 25-year-old, Phethe Sara Simiao, pleaded guilty to all counts, including contravening the Immigration Act. ALSO READ: Amantle Samane's mom tells court she relives pain of her daughter's murder Simiao appeared before the Johannesburg High Court on Tuesday for pre-sentencing, where the State argued for the harshest punishment against him. On the stand, Samane's mother, Ntombi, spoke, visibly emotional during her victim impact statement, detailing her family's anguish and the deep pain caused by the crimes. The State has requested the maximum penalties: life imprisonment for rape and murder, five years for kidnapping, and five years for the Immigration Act, despite the act prescribing a maximum of three months. During proceedings, Judge William Karam questioned the State on this, asking why they sought a sentence above the prescribed minimum. The defence did not oppose the State's submissions, maintaining that Simiao showed remorse by pleading guilty and cooperating with the court. Judge Karam also addressed Ntombi directly, encouraging her to seek support for herself and her children. "The court recommends that you continue to take your children to Sunday school because we all know that with God, all things are possible." Sentencing has been postponed to 1 September.

Khayelitsha couple returns to court for Lolitha Kowa's murder

Odwa Jack and Nokuthula Matyeseni have been in custody since July 23, the day the child's body was discovered with a screwdriver lodged in her head in another part of Kuyasa, Khayelitsha. Lolitha was last seen the day before, when she told her mother she was going to play with a friend, Matyeseni's daughter. During their last court appearance on August 8, the National Prosecuting Authority (NPA) regional spokesperson Eric Ntabazalila confirmed that a charge of kidnapping had also been added. 'They now face kidnapping, rape, and murder — the evidence we have at our disposal points to the two of them. We have overwhelming evidence, and that is the reason we believe they have a case to answer,' Ntabazalila said. Jack and Matyeseni are expected to apply for bail, but only if the address they provide to the court is verified. Their home was previously set alight by community members, prompting the State to argue that they are a flight risk and that bail should be opposed. Initially, the accused offered an alternative address, but the State deemed it unsuitable.
