Kolkata: Calcutta High Court on Wednesday directed the principal secretary, higher education department, to appear before the court virtually at 10.30 am on Thursday and explain the position of the state in regard to the counselling of merit-listed candidates in the Common Entrance Test for Medical and Allied Sciences Postgraduate Courses, 2024, conducted by the WBJEE Board.
Justice Kausik Chanda ordered that the state shall not take further steps in the admission process including counselling till Thursday.
Senior counsel for the JEE Board, Kalyan Bandyopadhyay, submitted that no further step would be taken in violation of the single bench order on May 21, 2025, until the stay application by the state was decided by the division bench against the single bench order.

The examination was held on July 14, 2024, and the results were published on Nov 14.
Candidates moved the HC after the WBJEE Board could not hold the counselling.
The judge expressed "surprise and concern" at the manner in which the state acted in violation of the division bench order on May 22, 2024, despite the fact that no stay had been granted by the SC. The Calcutta High Court Thursday directed the West Bengal Joint Entrance Examinations Board (WBJEEB) to come up with a new merit list of examinees, holding that the published one did not conform to the court's order on OBC reservation. Justice Kausik Chanda directed that the fresh panel will provide 7 per cent reservation for the 66 classes of OBC candidates as recognised by the West Bengal Backward Classes Department prior to 2010. He directed that the entire exercise needs to be completed within 15 days from the date of this order. The court directed that affidavits of compliance will be filed by the Registrar, West Bengal Joint Entrance Examinations Board, and also by an officer not below the rank of senior special secretary, West Bengal Higher Education Department, on the next date of hearing after three weeks. Justice Chanda observed that the preparation of the WBJEE 2025 merit list by the West Bengal JEE Board has been carried out in clear violation of this court's order passed on May 21. The suo motu proceeding was initiated on the basis of communications received by Justice Chanda through email from some candidates for the West Bengal JEE Board examination. The court noted in its order that the JEE Board had fixed Thursday for publication of the merit list of the joint entrance examination, 2025, providing reservations to the OBC candidates in terms of a new reservation policy, which had come into effect on June 10. The new policy was stayed by a division bench of the high court on June 17. An interim order of the Supreme Court on July 28 revived the new reservation policy for a limited period until August 11, Justice Chanda noted. The court said that the information bulletin for the state's JEE 2025 was published on December 24, 2024, and the application window remained open from January 22 to February 23, 2025, and the examination itself was held on April 27. 'In these circumstances, it is wholly beyond comprehension of this court as to how the new reservation policy effective from June 10, 2025, could have any application to the said examination,' the court said. 'Even assuming that the said policy is eventually upheld or allowed to operate, it can, at best, have prospective effect. Accordingly, the application of the said policy to the merit list for the 2025 examination is clearly erroneous and unsustainable,' the Judge observed.

While observing that 'right to protest is a fundamental right', the Calcutta High Court on Thursday while hearing a Public Interest Litigation (PIL) against a proposed protest rally, by the parents of the RG Kar rape and murder victim, near the state secretariat 'Nabanna' on August 9, said that the 'Nabanna Abhijan' protest rally must comply with police prohibitory orders. A division bench presided by Justice Sujoy Paul and Justice Smita Das De observed, 'This Court declined to pass any prohibitory order as sought for by the petitioner therein. This Court poignantly held that the right to protest is a fundamental right.' A PIL was filed in the Calcutta High Court on Wednesday, seeking to stop the 'Nabanna Abhijan' planned by the parents of the postgraduate trainee doctor who was raped and murdered at RG Kar Medical College and Hospital, in Kolkata, last year. The march is scheduled for August 9, marking the first death anniversary of the doctor. A resident of the Howrah district had filed the petition, citing disruptions caused by protest rallies near the state secretariat, affecting daily life, movement, and business activities in the Mandirtala area. The court, on Thursday, said it will be open for the West Bengal government to implement a prohibitory order imposed in the area near Nabanna and inform the organisers about adequate alternative places for protest. 'As noted above, the police has already issued the prohibitory order and it will be open for the Government to implement the said prohibitory order in accordance with law and inform the organizers about adequate alternative places for protest,' it said. The court observed that the persons participating in the rally should protest peacefully as law-abiding citizens and not cause any harm to the police or government authorities, buildings and public properties.
