Kerala HC directs steps to strengthen school protection groups to tackle drug abuse among students
The bench of Chief Justice Nitin Jamdar and Justice C Jayachandran made the suggestion while considering a batch of petitions, including one filed by Sumi Joseph of Ernakulam, a mother of two school-going children, along with petitions by KeLSA and others, seeking effective state action on the issue.
As per the 2011 circular, the formation of SPGs was voluntary, with the head of institution as chairperson, and members including the police station house officer, local elected representatives, PTA president, student leaders, teachers, parents and community members such as merchants and auto drivers.
Observing the sharp rise in NDPS cases over the last decade, HC orally suggested that the state govt consider formalising the SPGs.
It directed that the issue be placed before the chief secretary, who may assign it to the concerned secretary of the state govt for appropriate action.
Kochi police commissioner Putta Vimaladitya, who appeared before HC as per an earlier directive, informed that police have identified vulnerable hotspots and increased surveillance around educational institutions, deploying both uniformed and shadow officers.

HC further noted that, as per a report submitted by the registrar of district judiciary, 529 NDPS cases are currently pending due to delays in receiving reports from forensic science laboratories (FSLs). Although the state submitted that there are no vacancies in the post of scientific officers, HC observed that neither the state nor the PSC had provided details of FSL vacancies despite earlier directions. Accordingly, the state was directed to file an affidavit detailing steps taken to fill the vacancies.
The court further suggested convening a joint meeting of the state authorities and the public service commission to address the issue.

Hyderabad: The Telangana high court questioned whether cops can force anybody to undergo a potency test or any medical tests unless they are allowed by the law or with consent. "The investigating officer was trying to serve notice to him under Section 35(3) of BNSS, and as he did not receive the notice, the notice was sent to him by registered post," submitted the govt pleader. Taking a serious view of the allegations made by the petitioner, the HC ordered the cops not to indulge in acts outside the law and to conduct the investigation in strict compliance with the law and recently dismissed the petition.

Pune: Former state minister Eknath Khadse's son-in-law Pranjal Khewalkar and six others, including two women, were arrested after a Pune police team claimed to have busted a house party early on Sunday in a Kharadi studio flat off Pune-Ahmednagar highway where cocaine, marijuana and hookah pots were used along with liquor consumption. Police later took Khewalkar, who is an MD (medicine) and the husband of Rohini Khadse, who heads the NCP (SP)'s state women's wing, and others to Sassoon General Hospital for medical tests and then to his bungalow in Hadapsar where searches were carried out as part of an investigation to trace the source of the drugs. "There were previous attempts by the police in civil clothes to trap my client at two different locations, and CCTV footage from both sites supports this claim," he said. Lawyer Abid Mulani, representing two other accused, submitted, "Police failed to provide the grounds of arrest to the accused at the time of their detention which is in direct violation of Section 50 of the CrPC, which mandates that the arrested persons be informed of the grounds in such an arrest." Lawyer Sachin Zalte, appearing for co-accused Shripad Yadav, submitted that police have failed to mention in their arrest report the quantity of cocaine seized from the accused. The omission is crucial, as possession of less than two grams qualifies as a bailable offence under the current law. The court, while granting two-day custody, said the allegations of illegal arrest can be taken up in subsequent hearings.
