
'Judges also human': Justice Abhay S Oka admits error in judgment
NEW DELHI: Judges are also human and they can make mistakes while judging,

said Monday while admitting that he committed a mistake in deciding a case as a Bombay HC judge in 2016 relating to interpretation of the
Domestic Violence Act
and said it was a continuous learning process for judges.

While holding that HCs have jurisdiction under Section 482 of CrPC to quash proceedings of an application filed under Section 12(1) of DV Act, which says an aggrieved woman may approach a magistrate for relief such as payment of compensation, Justice Oka, who penned the verdict for the bench comprising himself and Justice Ujjal Bhuyan, said as an HC judge, he had taken a contrary view on the issue.
SC said that HCs must keep in mind that DV Act is a welfare legislation specially enacted to give justice to women who suffer from domestic violence.
'Even for judges, learning process always continues'
Therefore, while exercising jurisdiction under Section 482 for quashing proceedings under Section 12(1), the high court should be very slow and circumspect. Interference can be made only when the case is clearly of gross illegality or gross abuse of the process of law, the bench said.
Generally, the high court must adopt a hands-off approach while dealing with proceedings under Section 482 for quashing an application under Section 12(1).
Unless high courts show restraint... the very object of enacting the Domestic Violence Act, 2005 will be defeated, the bench added.
Justice Abhay S Oka, who penned the verdict for the bench, said: "Before we part with this judgment, we must mention here that one of us (Abhay S Oka) is a party to a judgment dated Oct 27, 2016, of Bombay high court (HC) in writ petition 2473 of 2016 in which the view taken is that remedy under Section 482 of Code of Criminal Procedure (CrPC) is not available for quashing the proceedings under Section 12(1) of DV Act, 2005."

"This view was found to be incorrect by a full bench of the same high court. As judges, we are duty-bound to correct our mistakes in properly constituted proceedings. Even for judges, the learning process always continues," he said.
"There are decisions of high courts taking a view that the jurisdiction under Section 482 of CrPC is not available to quash proceedings... under Section 12(1) of Domestic Violence Act. The decisions are primarily based on the premise that the proceedings..
. predominantly of a civil nature. The said view is not correct for the reasons set out earlier," Justice Oka said while correcting the orders of high courts and also correcting his stand taken as an HC judge nine years ago.

Chittoor: Senior Civil Judge and Secretary of the District Legal Services Authority (DLSA), MS Bharathi noted that elderly parents who are neglected by their sons or daughters are legally entitled to claim maintenance under Section 125 of the Criminal Procedure Code (CrPC). She held an awareness programme at an old age home in Tapovanam in Chittoor on Friday, which was organised as per the directives of the Supreme Court and the State Legal Services Authority. During the event, Judge Bharathi interacted with the elderly residents, inquiring about their health, the medical services being provided, pension disbursement, and any other issues they may be facing. She encouraged them to voice their concerns, assuring that legal help is available free of cost through the DLSA. Speaking at the event, she highlighted that in many cases, elderly parents transfer property to their children through gift deeds, expecting care and support in return. However, when the children fail to fulfill their responsibilities, the parents have the right to approach the court under Section 144 of the Code of Civil Procedure to revoke such deeds. Judge Bharathi reiterated the commitment of the District Legal Services Authority to provide free legal services to the elderly in such matters. She also stressed the importance of awareness about the constitutional rights and protective laws available to senior citizens. Former president of the Retired Employees Welfare Association Kesavulu, Murali, staff nurse Aruna from the Disabled Welfare Hostel, and several elderly residents of the ashram participated in the programme.

HC tells CBSE to rectify student records by updating official DoB
New Delhi: Delhi High Court has emphasised the "presumption of correctness" attached to official birth certificates and directed the Central Board of Secondary Education ( CBSE ) to amend a student's academic records accordingly. A division bench comprising Justices Subramonium Prasad and Harish V Shankar, in a recent order, underlined the "imminent need" to ensure consistency across official documents. This, the court said, not only affirms the accuracy of personal details in public records but also protects a citizen's identity—of which the date of birth is a crucial component. "A citizen of this country is entitled to a true and correct narration of all necessary and relevant particulars in the public documents that pertain to them. CBSE is a record keeper of considerable importance," the court observed, while dismissing CBSE's appeal against a single judge's order to correct the date of birth in certificates issued in 1999. The bench noted that documents like official birth certifiscates, issued by a competent authority, carry a statutory presumption of correctness under Indian law. The court reiterated that the matriculation certificate is widely regarded as "unassailable proof of date of birth", and citizens are entitled to have all public documents reflect accurate and consistent information. The plea before the court involved a student seeking rectification of her date of birth in CBSE records based on a birth certificate issued by the Greater Chennai Corporation. The HC noted that the genuineness of the birth certificate had not been disputed. It also observed that discrepancies between CBSE record and other official documents such as the individual's passport could cause serious complications, including for employment or immigration. In its defense, CBSE argued that the request for correction was filed beyond the time limit prescribed under its examination bye-laws, and that it no longer retained relevant records more than a decade later. However, the single judge had earlier ruled that the incorrect date of birth in the CBSE records appeared to result from a genuine mistake—not a clerical or typographical error. HC to monitor probe into drug racket involving Hoshiarpur jail officials
Chandigarh: Taking cognisance of the sale of drugs within Hoshiarpur central jail in Punjab, the Punjab and Haryana high court observed that it was shocking to note that senior-most jail officials were acting as a drug mafia. The HC made it clear that it would monitor the investigation in the present case and asked SP, Anti-Narcotics Task Force (ANTF), Rupnagar range, to furnish a status report on the investigation. Expressing dismay over the non-arrest of jail officials involved in the drug racket inside the jail, the HC was also of the view that it was equally shocking to note that SIM cards and mobile phones were supplied to the hardened criminals by these jail officials, and they were acting as conspirators in the drug racket. "It is equally shocking to note that the senior-most jail officials were acting as a drug mafia, and it is the fittest case for invoking the extraordinary jurisdiction of this court under Section 528 of BNS in the present case.
