BMC covers up Dadar Kabutarkhana once again
This move comes two days after the civic body lodged an FIR against a 55-year old resident for feeding pigeons on the roof of his car roof.
'The premises of the kabutarkhana have been covered on the directions given by the High Court (HC), since feeding of pigeons has been banned by authorities.. The structure will remain covered till the court directs us to the next course of action,' a senior civic official told the Indian Express on Monday. Civic sources said that the structure was covered early on Monday to avoid any further clash with citizens. The sources also maintained that the BMC has already written to the Mumbai Police asking them to monitor the area.
Kabutarkhanas are open public spaces where feeding of pigeons is a regular practice, particularly at major junctions in Mumbai. The Dadar Kabutarkhana, built in 1933, is managed by a local trust and has been a focal point for bird lovers and religious communities alike.
The BMC had earlier acted on the Bombay High Court's July 30 order directing the civic body to curb 'illegal' and 'defiant' feeding of pigeons in public areas such as Dadar West, citing health hazards like fungal infections and respiratory issues.
The HC had also asked BMC to install CCTV cameras to monitor 'mischievous' feeders, depute beat marshals or civic officers at feeding sites, and use nets to prevent pigeons from congregating. However, the HC's decision led to a public eruption with members of the Jain community breaking the scaffolding of the Kabutarkhana at Dadar. Following the incident on August 7, the court reiterated its previous order stating that since the BMC had not revoked or diluted its decision, the ban on feeding in public spaces 'very much stands'. The court however allowed the petitioners to apply to the BMC if they intended to feed pigeons, and said the civic body should consider the 'larger issue of public health' before making its decision.
'We have written to the police department before covering the structure following which barricades were also set up around the Kabutarkhana premises. Meanwhile our officials are keeping a watch at the ward level, where people who are feeding pigeons illegally are being penalised on the spot. The civic body is also considering a proposal to install CCTV cameras around the periphery of Kabutarkhana and other known feeding spots to keep these actions on check,' the official added.
In its last hearing the HC had also directed setting up a committee of experts, and if this committee agreed with the BMC's decision, the authorities should consider an alternative workable mechanism for the pigeons. Meanwhile civic officials said that the BMC may allow feeding of pigeons in a staggered manner, however this decision will be taken up following consultation with the committee.
The court will hear the Advocate General for Maharashtra and other parties on the setting up of the committee on August 13.

Kochi: High court has stayed further proceedings in a criminal case against Malayalam film actor Nivin Pauly and director Abrid Shine , accused of swindling Rs 1.90 crore from a film producer in connection with the making of the upcoming movie 'Action Hero Biju 2'. Justice V G Arun on Tuesday issued the interim stay on petitions filed by Pauly and Shine seeking to quash the cheating case registered at Thalayolaparambu police station in Vaikom on the basis of a private complaint by P S Shamnas, a co-producer of the movie. Police had booked the petitioners under Sections 406 (criminal breach of trust) and 420 (cheating) of the IPC, following a directive from the judicial first-class magistrate court, Vaikom. The petitioners contended that the magistrate ordered the registration of the case without considering an earlier police report, which concluded that the dispute was civil in nature. HC found merit in the petitioners' contention. According to the complaint, Shamnas invested Rs 1.90 crore in April for the production of the movies, but a budget dispute arose. The accused allegedly conspired to defraud him by selling the film's overseas rights for Rs 5 crore to another company, receiving Rs 2 crore in advance. The complaint adds that the parties had earlier collaborated on Pauly's previous film, 'Mahaveeryar', which was a financial failure, and Pauly had promised to pay Rs 95 lakh to Shamnas and agreed that he could be a co-producer in the new film. Shamnas further alleged that although the film's title was initially registered with Abrid Shine Productions, it was later transferred to his company, Indian Movie Makers. However, he claimed the accused concealed the title transfer and sold the overseas rights to another company. Meanwhile, Palarivattom police registered a case against Shamnas based on a petition filed by Pauly, alleging that Shamnas had obtained the title registration of the film using a forged letter purportedly issued on Pauly's behalf. ‘Scrutiny of documents necessary': HC denies bail to alleged Bangladeshi national arrested for 'illegal' entry in India
Rejecting the bail plea of a Thane resident, an alleged Bangladeshi national who police claimed illegally entered India, the Bombay High Court on Tuesday observed that his claim of being Indian citizen and identity documents be strictly examined under Citizenship Act. 'The applicant has failed to produce any document duly verified or authenticated by the concerned government authorities that could conclusively establish his Indian citizenship,' a single-judge bench of Justice Amit Borkar observed in an order on bail application of Babu Abdul Ruf Sardar, who claimed that he had valid Indian identity proofs including Adhaar card, Voter ID, PAN Card, and Passport. 'Merely relying on the existence of certain identity documents such as Aadhaar, PAN, or Voter ID, without verification of the process through which these were obtained, cannot be treated as sufficient proof of lawful citizenship at this stage, particularly when the very authenticity of such documents is under investigation,' the HC noted. 'In such circumstances,' the Justice Borkar added, 'where the investigation is at a crucial stage, and where serious allegations involving national security, illegal entry, and use of forged government documents are involved, the Court finds it neither proper nor prudent to enlarge the applicant on bail at this juncture.' Wagle Estate Police station in Thane had last year arrested Sardar under provisions of Bharatiya Nyaya Sanhita (BNS), Passport (Entry into India) Act, and Foreigners Order for entering India without valid passport or travel documents, deliberately suppressing foreign nationality by creating and using forged Indian identity documents such as Aadhar, PAN and falsely showing himself as Indian citizen. The Police claimed that he not only misrepresented his status before the authorities but also obtained an Aadhaar Card by submitting fabricated documents. Moreover, as per police, the mobile phone found in possession of the application contained digital copies of his and his mother's birth certificates allegedly issued by Bangladesh authorities which raised suspicion that he was a Bangladeshi national who illegally entered India. The probe also revealed frequent communication with several numbers linked to Bangladesh. The prosecution said that official verification regarding the genuineness of the Aadhar card was awaited from the authority. Advocate Jyotiram S Yadav for the applicant denied prosecution's claims and argued that his client was a bona fide citizen of India and there was no reliable or conclusive evidence produced by the prosecution to prove that he was Bangladeshi national. He also argued that his applicant had no connection with alleged Bangladeshi birth certificates. Additional Public Prosecutor Megha S Bajoria for Thane Police, while opposing the bail plea, claimed the possibility of the applicant being part of 'larger organised network involving illegal immigration and identity fraud,' and his release would have implications for national security. The court said that whether the documents were true or false will be decided in the trial, documents such as Bangladeshi birth certificates found on the applicant's own phone were 'important and cannot be ignored,' and if found genuine, it would impact the question of his citizenship. Observing the allegations were 'not small,' the judge said 'the fact that he was allegedly able to get official documents through fraud shows that he has the ability to misuse the system and create a false identity again if given the chance.' Rejecting the bail plea, the HC noted that fear expressed by prosecution of applicant destroying evidence in case released on bail was 'not empty' or 'imaginary' and the 'danger of applicant running away from the law or interfering with investigation was real.'

Police nab 3 suspects in Jhajjar road loot case after encounter in Rohtak
1 2 Rohtak: In a late-night encounter on Sunaria Road, police apprehended three suspects involved in Jhajjar Road loot case, leaving all three injured. Two of the accused sustained gunshot wounds to their legs, while the third was injured after their motorcycle skidded. They were immediately taken to the trauma centre at PGIMS by the police. According to officials, on July 7, a daring daylight robbery took place at the shop of iron trader Ashok Jain in the Arya Nagar police station area. The assailants held Jain, his wife Sumita Jain, and a worker hostage at gunpoint and knifepoint, making away with Rs 1.5 lakh in cash, gold and diamond jewellery, and silver coins. Acting on a tip-off, police intercepted three suspects on the Sunaria Jail Road on Tuesday night. When signalled to stop, the suspects allegedly attacked the police, prompting retaliatory firing. The injured have been identified as Ayush (19) of Balambha village, and Pushpendra (21) and Azad (22), both residents of Rajasthan. Police said the trio were wanted in Jhajjar Road loot case and the motorcycle they were riding was also reported stolen.
