Epic Games wins partial victory in Australian court against Google and Apple
Federal Court Justice Jonathan Beach on Tuesday upheld key parts of Epic's claim that the tech giants breached Australian competition laws by misusing their market power against app developers and using restrictive trade practices.
Google and Apple 's dominance of the app market had the effect of substantially lessening competition and breached Australian law, Beach found.
But the judge rejected some of Epic's claim including that Google and Apple engaged in unconscionable conduct as defined by Australian law.
Sweeney is also challenging Google and Apple dominance in the app markets through the courts in the United States and Britain.
The litigation began in August 2020 when Apple's App Store and Google's Play Store expelled Fortnite because Epic installed a direct payment feature in the extraordinarily popular game.
The court ruled both companies pressured app developers including Epic through contracts and technology to sell their products through the two dominant app stores.
Epic posted online that the judgment was: 'Another HUGE WIN for Epic Games!'
Apple said the company 'faces fierce competition in every market where we operate.'
'We welcome the Australian court's rejection of some of Epic's claims, however, we strongly disagree with the Court's ruling on others,' Apple said in a statement.
Google said it would review the judgment. Google and Apple could potentially appeal the ruling before the Federal Court full bench.
'We disagree with the court's characterisation of our billing policies and practices, as well as its findings regarding some of our historical partnerships, which were all shaped in a fiercely competitive mobile landscape on behalf of users and developers,' a Google statement said.
Beach has yet to release a 952-page judgment on Epic's case against Apple or his 914-page judgment on the case against Google.
The judge gave an oral summary of his findings during a 90-minute hearing Tuesday.
Lawyers will return to court on a date yet to be set to argue what Epic is entitled to in terms of damages.

Jetstar passenger's warning after 'confusing' Bali flight ordeal: 'Don't wait'
A Jetstar passenger has hit out at the budget airline after an apparent airline tactic of overbooking flights left her potentially facing a long wait for another plane. Young Aussie Sky Kennedy told Yahoo News she was getting ready to fly home after a two-week solo adventure around Bali when, at the check-in desk, she was told she may be refused boarding because she hadn't pre-booked a seat. "When I got to the desk, the lady mentioned that the plane was full and because I hadn't selected a seat, that I didn't actually have one secured on that flight," Sky recalled for Yahoo News. Sky said she was "confused" because she'd booked the flight months ago. "She explained that even though I bought the ticket, because I hadn't selected a seat, it wasn't guaranteed," she said. Seat selection on Jetstar flights – do you have to buy a seat? Basic seat selection on Jetstar flights costs around $8, while seats closer to the front and on exit rows can go for up to $32. For Sky, she usually doesn't select a seat because she's "happy to sit anywhere". "If I had known that choosing a seat meant my booking wasn't secured, I would have, of course, selected one," she said. "But when you book online, it doesn't say that and even gives you the option to skip seat selection. If it's essential to secure your ticket, in my opinion, it should be included in the price or mentioned at the time of booking." Yahoo contacted Jetstar to find out if what Sky was told in Bali is airline policy. Jetstar advised that customers aren't required to pre-purchase seats to guarantee travel. If a flight is overbooked, Jetstar can choose passengers to change to another flight. It will provide affected passengers with compensation, reimbursement and assistance to secure another flight, the airline's policy says. New Zealand's population exodus hits 13-year high as economy worsens
SYDNEY (Reuters) -New Zealand citizens leaving the country have hit the highest levels in 13 years, with more than a third of those emigrating aged under 30 years as unemployment rises and economic growth remains soft. Data released by Statistics New Zealand on Friday showed 71,800 New Zealand citizens departed New Zealand in the year ended June 2025, up from 67,500 in the previous 12-month period and below the record 72,400 in the year ended February 2012. New Zealand's net migration, which is the number of those arriving minus those leaving, also fell with foreign nationals moving to the country of 5.3 million nearly halving from 2024. The rush to leave comes amid one of the worst economic downturns since 1991, which analysts blame on low productivity and various policy missteps. Unemployment ticked up to a near five-year high of 5.2% in the second quarter, data showed last week, while the labour force participation rate - which includes workers either employed or actively looking for work - fell to its lowest since the first quarter of 2021. Since August 2024, the Reserve Bank of New Zealand has cut its cash rate by 225 basis points to support an economy which sank into recession last year. The economy showed signs of improvement with gross domestic product increasing 0.8% in the first quarter. New Zealanders aged 18 to 30 years made up 38% of the departures, compared with a peak of 60% in 1979. Economists and analysts have said New Zealanders, stung by fewer job opportunities and the cost of living, are looking to move to neighbouring Australia, Britain and elsewhere.
