
Fraudster jailed for duping luxury hotels into buying his fake Scottish tea
Thomas Robinson, 55, who also went by Thomas O'Brien or Tam O'Braan, was found guilt of deceiving luxury stores and hotel groups into buying his 'unique' Scottish-grown tea that was in fact wholesale leaves he had imported from around the world and repackaged.
His victims included five-star hotels like London's Dorchester and Edinburgh's Balmoral which are known for their grand afternoon tea experiences.
The tea menu at the Balmoral's Palm Court included names like Scottish Antlers Tea and Highland Green and based on descriptions Robinson gave them, boasted 'Our Scottish-grown teas come from gardens in our farming heartlands in Perthshire and Dumfries and Galloway'.
He even claimed his Scottish tea was 'the Queen's favourite'.
He also defrauded a group of genuine Scottish tea growers by selling them plants under false pretences.
Operating under the business name The Wee Tea Plantation, he pretended to cultivate unique Scottish tea plants on his Perthshire estate but prosecutors proved the product had been purchased elsewhere before being repackaged.
Robinson then fraudulently sold the plants to high-profile clients in the hospitality and retailers between January 2014 and February 2019 for five times the cost.
The court heard he was importing the plants for three Euros each – around £2.50 - and collecting them from a mailbox in Glasgow and then selling them for £12.50.
Robinson also fabricated his academic status by falsely claiming he had qualifications in agronomy and agriculture and had obtained awards for his tea from industry bodies.
He claimed to have found a way to make his tea grow in half the usual time – using a 'special biodegradable polymer' which the prosecution said looked like black bin liner – and claimed to have given a presentation on his methods to the Royal Horticultural Society.
He was sentenced at Stirling Sheriff Court after a jury found him guilty of two charges of being concerned in a fraudulent scheme following an investigation by Food Standards Scotland.
He will now be subject to confiscation proceedings under Proceeds of Crime legislation to recover monies illegally obtained.
Ron McNaughton, Head of the Scottish Food Crime and Incidents Unit (SFCIU) at Food Standards Scotland, said: 'We welcome today's sentencing as a clear signal that food fraud is a serious crime with serious consequences.
'A three-and-a-half year custodial sentence reflects the scale and impact of Mr Robinson's deception. His actions caused real financial and reputational harm to individuals, businesses and a developing sector of genuine Scottish tea producers.
'This outcome is the result of a complex and painstaking investigation involving a dedicated team at FSS and the cooperation of partner agencies and key witnesses.
'It demonstrates that those who set out to mislead consumers and defraud businesses will be held accountable.
'Food fraud undermines consumer trust and damages the integrity of Scotland's globally respected food and drink sector. We remain committed to detecting and disrupting criminal activity of this nature.'
Helen Nisbet, Procurator Fiscal for Tayside, Central and Fife, said: 'This was a planned and deliberate fraud. 'Thomas Robinson misled genuine Scottish tea growers by selling them plants he falsely claimed were a unique, locally grown variety.
'Fraud is not a victimless crime. Individuals, businesses, and genuine Scottish tea growers suffered financial and reputational harm as a consequence of Robinson's deceit. 'But thanks to partnership working between Food Standards Scotland, Police Scotland and the Crown Office and Procurator Fiscal Service, he has been brought to account for his crimes.
'We are committed to tackling financial crime of this kind.'

Firework control zones expanded after death of red pandas at zoo last year
The ban will cover nine Edinburgh neighbourhoods this year, after being trialled last year in a handful of areas of the Scottish capital. Firework control zones (FCZ), which ban the use of fireworks in a specific area to mitigate the misuse of fireworks and the protection of animals and vulnerable people, were first implemented in Balerno, Calton Hill, Niddrie and Seafield. On Thursday, members of the City of Edinburgh Council's Culture and Communities Committee voted to reintroduce FCZs in these areas for two years, in addition to new bans in Moredun, Gracemount, Longstone, Sighthill, and Corstorphine. Baby red panda Roxie choked to death on her own vomit on November 5, aged three months, and her mother Ginger died five days earlier, which zoologists said could have been attributable to stress from fireworks. Police also dealt with serious disorder in areas of the city including Niddrie, Gracemount and Moredun on Bonfire Night last year. A public consultation found 'overwhelming support' for the introduction of the FCZs, according to the council. Culture and communities convener Councillor Margaret Graham said: 'We want everyone to be able to enjoy Bonfire Night safely and responsibly and these FCZs are part of our efforts to ensure that. 'The new FCZs being introduced are based on community requests and respond to real concerns around the safety of people and animals in these areas. This is in addition to the FCZs first introduced last year, which we found had a really positive effect. 'This is just one tool for minimising the negative impact of fireworks at this time of year, and we'll continue to work closely with partners to look at different ways of addressing the issue.' RZSS deputy chief executive Ben Supple said: 'We are very grateful to the council for creating a fireworks exclusion zone around Edinburgh Zoo. 'Roxie the baby red panda sadly choked to death on her sick last Bonfire Night and it is very likely that this was due to stress from fireworks. 'The loud bangs would have been incredibly frightening for her and fireworks may have also contributed to the death of her mum Ginger five days earlier. 'Firework exclusion zones are an important step to protect animals in zoos, pets, horses, livestock and wildlife. 'We are also supporting calls from animal welfare charities to ban the sale of fireworks to the public, with only drone or light displays used at organised events.'

The case called last month where it emerged van Veen was set to be seen by psychiatrists. Today, the court heard he had been assessed but that a final report had not been provided to his legal team. Van Veen, who recently signed for Dutch club FC Eindhoven, was not in the dock for the brief hearing and is understood to be back in the Netherlands. He played in Scotland for Motherwell, Kilmarnock and St Mirren, with the latter ripping up his contract when the allegations first came to light. Sheriff Shirley McKenna said he should be present when the case calls next week. Andy Thomson, defending, said: "We were waiting on a psychiatric report and he has been seen. "It is suggested that this case be continued until next week where we will furnish the court and the Crown with the report and can decide the course of action." Sheriff McKenna said: "He needs to be here. "He has not been here the last couple of times, I understand he is not in the country but he needs to be here if there is to be resolution unless there is going to be an examination of facts." Depute fiscal Scott O'Connor said he had 'no difficulties' with the case being continued. A trial had earlier heard Van Veen's ex-girlfriend, 33, allege he twisted her wrist at his home in Uddingston, Lanarkshire. She further alleged a holiday in Mexico was 'two weeks of mental torture' because of him 'shouting and screaming' in her face as well as being accused of being a 'slag and a slut' over a dress he deemed too tight. And she claimed that he kept tabs on her Instagram account in case she had liked photos of other men. He faces one charge under domestic abuse laws which alleges incidents between September 2021 and July last year. Prosecutors allege he repeatedly prevented her from sleeping and turned up at the homes of her family members and refused to leave when asked. The footballer is said to have repeatedly demanded that she attend at his property and persistently called and texted her and her family members. He is also accused of locking her inside his home.
