
7/11 blasts acquittal: Bombay HC disbelieved recovery of RDX on technical ground, Maharashtra Govt tells Supreme Court
Chief Minister Devendra Fadnavis-led government rushed to the top court on July 22, a day after the high court acquitted all 12 accused, saying the prosecution utterly failed to prove the case against them and it was "hard to believe" that the accused had committed the crime.
Earlier on Tuesday, Solicitor General Tushar Mehta, on behalf of the state government, mentioned the plea before an apex court bench headed by Chief Justice B R Gavai and sought an urgent hearing. The court agreed to hear it on July 24.
Seven blasts had ripped through Mumbai local trains at various locations on the western line on July 11, 2006, killing more than 180 persons and injuring several others.
Nineteen years later, the Bombay High Court on Monday acquitted all 12 accused, saying the prosecution utterly failed to prove the case and it was "hard to believe theycommittedthe crime".
The state government, in its appeal against the Bombay HC verdict, has raised several serious objections to the high court's order of acquittal.
The plea asserts that due procedural safeguards under Section 23(2) of the Maharashtra Control of Organised Crime Act (MCOCA) were observed, including proper sanctioning by senior officers like prosecution witness (PW) no. 185 Anami Roy, news agency PTI reported.
It said the high court overlooked the validity of these approvals despite no substantial contradiction in the prosecution's evidence.
The plea has assailed the high court's rejection of the recovery of 500 grams of RDX from one of the accused on the ground that it lacked a lac seal.
The plea has said that RDX, being highly inflammable, was not sealed for safety reasons and the recovery was duly sanctioned and documented.
"That, the Hon'ble High Court has disbelieved the recovery of 500 gms of RDX from Accused No. 1 on a hyper-technical ground that the RDX which was seized was not sealed with a lac seal. It will be pertinent to note that the same was not sealed with a lac seal because RDX is an inflammable substance, according to the PTI report.
"It is pertinent to note that the High Court records that the sanctioning authority for explosive substances has been examined by the prosecution. However, the Hon'ble High Court has not found any infirmities in the evidence of PW 26, who is the sanctioning authority under the Explosive Substances Act for seizure of RDX from Accused No. 1. Therefore, the High Court has erred in disbelieving the recovery of RDX from Accused No. 1," the plea has said.
It has also disputed the high court's dismissal of the confession of an accused for lacking minute details, such as the date of arrival of the Pakistani co-conspirators in India, the description of the six Pakistanis and information like whether they had trained in terrorist camps.
"The entire confessional statement has been disbelieved which is an unacceptable conclusion," the plea has said, adding that omissions regarding the identities and origins of the Pakistani co-conspirators do not invalidate the overall confession.
The appeal also challenges the high court's disregard of the recovery of detonators and explosive granules from another accused, pointing out that these items cannot be easily procured or planted, and their evidentiary value should not have been dismissed over technicalities.
The petition says the high court failed to address the validity of the convictions under various provisions of the Unlawful Activities (Prevention) Act (UAPA) and relevant provisions of the Explosive Substances Act.
It says the high court ignored key findings and legal interpretations from previous landmark judgments.
The plea addresses the defence's contention that the accused did not meet the definition of "continuing unlawful activity" under the MCOCA because earlier offences were punishable by less than three years.
The plea cites Supreme Court precedents, saying the conspiracy and scale of the attack clearly fall under MCOCA provisions.
Of the 12, five were sentenced to death and seven to life imprisonment by a special court. One of the death-row convicts died in 2021.
More than 180 people were killed when seven blasts ripped through Mumbai local trains at various locations on the western line on July 11, 2006.

Satcom spectrum allocation rules likely to be in place within two months
New Delhi: Rules for the allocation of spectrum for satellite communications services are likely to be in place within two months, a government official said on Monday. The spectrum allocation rules are the last lap that will enable Elon Musk-led Starlink , Bharti Group-backed Eutelsat Oneweb and Jio SES to apply for the radiowaves and start rolling out their services. "Spectrum allocation rules are likely to be fixed in two months. After that, it will be at the discretion of satcom services when they want to roll out their services," the official said. The Telecom Regulatory Authority of India (Trai) has recommended that the government should allocate spectrum without auction and through an administrative process-- a move that has seen huge resistance from telecom operators Reliance Jio and Bharti Airtel initially. The regulator has suggested that spectrum for satcom services can be for a period of up to five years and considering the market conditions, the government may extend it for a further period of up to two years. Trai has suggested that spectrum charges for both GSO-based and Non-Geostationary Orbit (NGSO) Fixed Satellite Services should be levied at 4 per cent of adjusted gross revenue (AGR). OneWeb and Starlink fall into the LEO (low earth orbit) category which are considered to be Non-Geostationary Orbit (NGSO) satellites. Besides, NGSO-based Fixed Satellite service providers should also pay an additional per subscriber charge of ₹500 per annum in urban areas while exempting the rural and remote areas from this additional charge. While allaying the threat to land-based telecom networks from satcom services, Union Minister Pemmasani Chandra Sekhar said that Musk-led satellite communication services provider Starlink can have only 20 lakh connections in India with a peak speed of 200 megabits per second. A government official mentioned that the limit on Starlink connections is due to its existing capacity. The minister said that the upfront cost for satcom services will be too high and the monthly cost may be around ₹3,000. PTI

Mahayuti alliance to have friendly fights on certain contentious seats, says CM Devendra Fadnavis
Maharashtra Chief Minister Devendra Fadnavis on Monday (July 28, 2025) stated that the alliances of the Mahayuti government will contest together in seats where it's feasible, while friendly contests will be held in constituencies where a united contest isn't possible in the upcoming local polls in the State. 'Mahayuti is a rule, friendly fights are an exception but not a rule for upcoming elections,' said Mr. Fadnavis, while speaking in Wardha district, after the party meeting with BJP Ministers, MPs, and MLAs from Vidarbha. Speaking about Mumbai, Mr. Fadnavis asserted that people have already decided in their heart that the Mayor of Mumbai will be of Mahayuti, adding, 'Whether Thackeray brothers contest unitedly or independently doesn't matter.' Pahalgam mastermind among 3 killed in Operation Mahadev
ANI J-K: Three terrorists killed in 'Operation Mahadev' encounter Srinagar: The armed forces on Monday killed three infiltrators in the Lidwas area, located in the upper reaches of Dachigam National Park in Harwan on the outskirts of Srinagar. The Army launched 'Operation Mahadev' in the early hours of Monday and later reported the recovery of three bodies from the encounter site. A senior J&K police official told ET that the group was led by 'Sulaiman', who was allegedly involved in the Pahalgam massacre. "Sulaiman and two others were killed in this encounter. He was involved in the Pahalgam attack," the official said. The armed forces are expected to formally brief the media on the operation on Tuesday. However, there has been no official confirmation yet on the identity or involvement of the three suspected the Baisaran Valley of Pahalgam 25 tourists and one local were killed by unidentified gunmen from point blank range on April 22, this year, which triggered a mini war between India and Pakistan in May. The army and police have also not issued any official statement about the connection of this group with the Pahalgam attack but the investigation continues. "Three Pakistani terrorists have been eliminated in Dachigam area and police will share details of the operation. Such kinetic operations have been happening for several months now and I congratulate the forces for this success," Lieutenant Governor of J&K Manoj Sinha told reporters on the sidelines of a function. Earlier, on April 12, three foreign infiltrators were killed in the Chatroo area of Kishtwar and the army sais an AK rifle, an M4 Rifle and other equipment were recovered from the spot. The officials claimed that a top Jaish-e-Muhammad commander was killed in that encounter.
