
Errol Samuelson: I work at Zillow and I know the harms of private listing networks
It is common knowledge that more competition maximizes sales price.
But there are a few real estate brokerages insisting in ever-louder voices that competition doesn't matter, because if enough people fall for that idea, it gives them cover to double dip on commissions and attract more clients.
We must 'preserve seller choice,' they argue. And they talk up as 'innovative' a marketing strategy that puts a broker's interests ahead of their clients'.
To be clear, sellers and their agents have the choices they need to market their homes, whether their goal is to maximize price or privacy, or something in between. They can sell their home completely privately off the Multiple Listing Service and third-party websites. They can make it available only to other agents in the market to share with their buyers one-on-one. They can keep the address or photos from being shown online. They can even list it on the MLS but keep the listing off the internet entirely.
None of that is changing, nor should it. Sellers should retain full control over how and where they market their homes.
So what choice are these handful of outspoken brokerages trying to preserve? Their own. They are choosing to make more money by persuading sellers that limiting which and how many buyers can see their home is somehow good. They are engineering private marketplaces that benefit themselves while actively harming buyers and sellers, all the while framing the practice as pro-consumer.
That's especially bold when you consider that every consumer advocacy group that has weighed in on the issue — including the National Fair Housing Alliance, the Consumer Policy Center, the National Association of Hispanic Real Estate Professionals the National Association of Real Estate Brokers and Consumer Advocates in Real Estate — disagrees with them.
Here's the reality: Home sellers aren't bursting through brokerage doors begging for a multitiered private marketing strategy. They're asking for help and representation, and going along with what's being pitched to them because they trust their agent.
These brokerages use catchy marketing speak as they pitch sellers on their plans, but it all boils down to: 'Give us a few weeks to see if we can find a buyer we're already working with so we can get both commissions and use your listing to attract more clients. Odds are, it'll take longer and you'll probably lose some money, but if it doesn't work we'll put it on the MLS and sell it the way we should have all along.'
If they're being forthright, they'd ask, 'Would you like 1,000 buyers or 50,000 buyers to know about the home you're trying to sell?'
The result, of course, is that sellers waste time. And for sellers unfortunate enough to find a buyer within the private network, it almost always comes at a cost of thousands of dollars. Sometimes much, much more. And they rarely ever know.
It's too bad these brokerages are choosing this path. Study after study after study — and common sense — tell us that marketing only to a few buyers who happen to be working with the same brokerage isn't how a seller makes the most money. It's how the brokerage makes the most money.
Just last week in these pages, one Chicagoland brokerage ignored mountains of research and instead cited a 'study' by Midwest Real Estate Data showing privately listed homes sold for more money and sold faster. A quick glance shows that it wasn't a study, but a chart in an MRED white paper detailing the harms of private listing networks.
They left out the part of the same white paper that says: 'Limiting the exposure of a listing to a subset of the market can reduce its ultimate selling price, which brings the ability of the listing agent to fulfill their fiduciary responsibilities to their seller into question.' And they also didn't share the part that says: 'Legal and ethical issues regarding off-MLS listings include the ability of agents to fulfill their fiduciary duties to clients, fair housing discrimination concerns, and proper disclosure of marketing practices to clients.'
The harms of private listing networks proliferating are clear:
Remember before Zillow, Redfin and other similar sites when you didn't know what houses were for sale until your agent showed you the listing in a big book in their office, or drove you around? When you couldn't do your own vetting and deep diving and comparing? That's the world these brokerages are hoping to revert to — one in which they control the information and buyers and sellers are at their mercy.
And they're trying to somehow sell it as innovation.

Real estate giants crack down on exclusive 'off-market' home listings in major shift for buyers
Two major real estate marketplaces are making big changes to what home listings can appear on their websites. Zillow and Redfin are both taking aim at listings of homes up for sale that have been publicly marketed prior to being entered into the multiple listing service (MLS), taking steps to bar them from their respective platforms. In April, Zillow unveiled new "listing access standards" for its site under which the real estate marketplace said it will not publish listings if they are "marketed directly to consumers without being listed on the MLS and made widely available where buyers search for homes" within one business day. The company has argued that a listing "marketed to any buyer should be marketed to every buyer" and that consumers "deserve fair access to listings without having to get access behind a velvet rope controlled by any one company." Home Sellers Face Harsh New Reality As Listings Hit Record $69B Value Zillow began sending out notifications of listings in large U.S. markets that don't meet them to agents starting in late May, with each one getting recorded as a violation. Read On The Fox Business App At the end of June, Zillow will bar an agent's third noncompliant listing and any listings by the agent that violate its listing access standards from its platform as well as Trulia "for the life of the listing agreement between that listing broker and seller," according to the company. Its new standards are being implemented "in phases" with a national expansion taking place over the summer. Zillow said the new policy affects all listings of for-sale homes "subject to an exclusive for-sale listing agreement between a broker and a seller." The new listing access standards "are consistent with NAR's Clear Cooperation Policy and reflects our belief in fair access for all," according to the company. The Clear Cooperation Policy mandates the sharing of listings on the MLS within one business day of public marketing. The option for sellers to delay the marketing of their homes on the MLS is slated to come into force in September, the NAR announced earlier this year. There are, however, some exemptions to Zillow's new listing access standards policy. The site will allow home listings that were "only shared among agents within the listing brokerage and the seller has signed a waiver or opt-out form" as well as "delayed marketing" and "coming soon" listings uploaded to the MLS. Additionally, listings of newly built homes marketed by their builder, rental properties and "for sale by owner" homes will not be subject to Zillow's new rule surrounding public marketing, the company said. The New Palm Beach? Jupiter, Fla, Is Drawing Luxury Homebuyers Fellow real estate marketplace Redfin is taking a similar stance. CEO Glenn Kelman said in a mid-April Redfin post that the platform "will not publish any listings that have been publicly marketed before being shared with all real estate websites via the MLS." The company is also calling for the MLS to set up a "coming-soon" designation that "precludes" search sites from displaying the amount of time a home has been on the market and their prices, according to the post. Redfin believes "all buyers should be able to see all listings," Kelman said. The real estate marketplace will start implementing its policy barring listings that were publicly marketed ahead of being shared on the MLS beginning in September, a Redfin spokesperson told FOX Business. "Delayed marketing exempt listings will be displayed on Redfin as long as they're shared in the MLS and disseminated to sites like Redfin through a Virtual Office Website (VOW) where buyers can access them," the spokesperson added. Welcome to America, the ATM of world soccer
Ladies and gentlemen, esteemed guests, football (soccer) fans around the globe, welcome to America! In just a few days, you'll descend upon the United States to cheer on your team, witness some of the planet's biggest stars gracing the world stage one more time before they head off into their summer break — albeit a brief one. Advertisement This is an extraordinary time for soccer in this part of the world. The Copa América was here in 2024. The Club World Cup kicks off this weekend. The World Cup — the grandest soccer show of all — is in 365 days. The 2027 Women's World Cup and 2028 Olympic Games will be upon us before we know it. But while the U.S. is going to be a summer soccer paradise, it's not going to be a cheap one for those who like to budget with caution. Last year, MLS commissioner Don Garber told The Athletic: 'There's no question now that America has become the ATM for the soccer world. We have raised the commercial value of the sport in our country in ways where it now is perhaps the most valuable soccer market, commercially.' Garber's comments reflect reality. Part of the reason America is such an attractive proposition for FIFA, international leagues and elite global teams is that large numbers of fans are willing to pay sky-high prices. For decades, the U.S. was soccer's purgatory. While the rest of the world was obsessed with the jogo bonito, Americans were busy with football, basketball and baseball — their favorite pastime. But that's changed. Over the past decade, especially once American investors started putting money into soccer teams abroad, the sport's footprint and impact in the U.S. haven't just grown, but surged. With interest in soccer at an all-time peak, clubs, leagues and governing bodies are racing to capitalize on the American fan base and to tap into the U.S.'s commercial and economic might. On top of all the global events mentioned above, there is also a continuously steady stream of high-profile summer friendlies in between, as has been the case for well over a decade. No one is pretending soccer has the same foothold and history in the U.S. as it has in Europe or South America, but what it does have is a potential audience that is accustomed to paying top dollar for its entertainment interests. Advertisement As FIFA tries to fill more seats for its Club World Cup opener between Inter Miami and Al-Ahly on Saturday, it was revealed Tuesday that Miami Dade College students could acquire five tickets for $20, a phenomenal deal aimed at avoiding the embarrassment of having banks of empty seats for the kickoff game. However, without your college ID card, it should be noted that regular seats still start at $69, and that figure was more than $300 when they first went on sale. Add in parking, food and other expenses, and the total cost for a family of four could easily exceed $1,000, especially for a highly sought-after match, with the dynamic pricing model used to set costs. 'Football has been industrialized,' professor Simon Chadwick, who teaches geopolitics of sport at Emlyon Business School in Lyon, France, told The Athletic. 'Very often people talk about commercializing, but the sport has been industrialized with the objective to extract as much financial value from customers as is possible. 'Clubs and governing bodies are developing products that take advantage of the latest developments in markets, and this means that the football product now, instead of just being a game that you go and watch, or you go and buy a ticket to watch, the product is now an experience.' Alas, soccer has become a very expensive experience in the U.S. When you break down the costs of attending events like Copa América or marquee summer friendlies, the numbers add up fast. Last summer, tickets for Argentina vs. Chile were starting at $391 on Ticketmaster. According to ticket resale platform TickPick, the average purchase price for the 2024 Copa América group stage was $187, a 61 percent rise from 2016, when it was $116. The most expensive group stage ticket was for the match between Argentina and Peru, with an average purchase price of $478. For the final, tickets were priced anywhere from $1,300 to $7,000 through websites such as Ticketmaster and SeatGeek. Another report from the Local 10 News claimed tickets for the final ranged from $1,670 to nearly $97,900 on resale platforms TickPick and StubHub. A year before Copa América, summer friendly games featuring European clubs like Arsenal and Manchester United saw ticket prices exceeding $200, especially in major U.S. cities. At those prices, fans aren't just paying to watch a soccer game, they're paying to be part of a meticulously crafted entertainment experience. FIFA and many other soccer governing bodies are curating entertainment experiences that go well beyond the game. From Coldplay's Chris Martin choosing halftime music to seamless one-touch engagement with teams and tournaments through an app, it's all very much in line with the kind of immersive, branded experiences 'you'd expect from Disney,' Chadwick said. Advertisement 'These immersive, high-touch offerings cost money to build, but FIFA knows fans are willing to pay for them. There's a clear alignment between what FIFA is offering and what consumers want. The proof? Stadiums sell out, sponsors keep lining up, and broadcast deals are still climbing. The takeaway for FIFA is simple: This model works.' But not perfectly, it seems. Earlier this week, tens of thousands of seats remained unsold for the opening Club World Cup match at Hard Rock Stadium, which holds 65,326 fans. The exclusivity of the Club World Cup and other FIFA events, though, goes beyond ticket prices, all the way to concession stands. FIFA Club World Cup matches will be held in 12 NFL and MLS stadiums, including Atlanta's Mercedes-Benz Stadium, Miami's Hard Rock Stadium, New Jersey's MetLife Stadium (where the final of CWC and the World Cup will take place), Philadelphia's Lincoln Financial Field, Seattle's Lumen Field and Washington's Audi Field, where DC United and Washington Spirit plays their home games. The cost of the average classic American combo — a beer and a hot dog — is approximately $15.02 across NFL stadiums, with some venues like Lumen Field charging up to $19.98, according to Food and Wine's 2024 research. However, recent personal experience shows prices are vastly higher than that. Last week at the USWNT's match against Jamaica at Energizer Park in St. Louis, a Reuben sandwich was priced at $18.99, a bottle of water was $8 and a large beer was going for $20, with tax and tip on top. The truth is that the beautiful game is increasingly catering most directly to those who can afford to pay more. 'Let's be brutally honest about this, people who are economically disadvantaged, they are no longer anywhere near the top of football's agenda,' Chadwick said. 'In simple terms, the yield per fan from richer members of society is going to be much higher than the yield per fan from poorer members of society. And so I guess you could say we are going through a kind of period of the gentrification of football.' Unlike the iconic song from 'West Side Story,' nothing in America comes for free. Buying on credit sure feels like a sweet deal, just don't check your credit card statement after the game.

The Justice Department wants to end an agreement it reached with a Pa. bank it accused of redlining in Philly
Two years ago, the U.S. Department of Justice accused a Pennsylvania bank of redlining - avoiding lending in majority-Black and Hispanic neighborhoods in and around Philadelphia. ESSA Bank & Trust, based in Stroudsburg, Pennsylvania, denied the accusations but entered into a settlement agreement with the federal government in which the bank had to give more than $2.9 million in loan subsidies to homebuyers in formerly redlined communities. The bank also agreed to devote resources to soliciting mortgage applications from Philadelphia residents in neighborhoods it was accused of ignoring, to include Philadelphians in its program for low- and moderate-income homebuyers, to work with local groups to provide homebuyer education, and to target historically excluded neighborhoods with its advertising. On Friday, the Justice Department asked the U.S. District Court for the Eastern District of Pennsylvania to allow it to end the five-year agreement three years early. The court filing is in line with other recent Justice Department moves across the country to end similar fair-housing and antidiscrimination settlement agreements. Lisa Rice, president and CEO of the National Fair Housing Alliance, said in a statement that by taking these actions, "this administration is empowering bad actors and leaving millions of our nation's most vulnerable unprotected and exposed." The Justice Department said in its motion Friday that ESSA Bank "has demonstrated a commitment to remediation," including disbursing required loan subsidies, and is "substantially in compliance" with other terms of the court order. The bank did not respond to a request for comment Tuesday. The department noted that its motion was "unopposed." But on Monday, the National Fair Housing Alliance and local civil rights organizations filed a motion asking to join the case and opposing cutting short the legal agreement. "This effort would strip West and Southwest Philadelphia communities of the hard-won protections they were promised just two years ago," Rachel Wentworth, executive director of the nonprofit Housing Equality Center of Pennsylvania, said in a statement. "For decades, banks of all kinds have used redlining to deny neighborhoods of color access to wealth and opportunity, and ending this consent order sends a devastating message to these communities." The Philadelphia-based Public Interest Law Center and the law firm Stapleton Segal Cochran LLC, which has offices in Philadelphia and Marlton, are representing the Housing Equality Center, the National Fair Housing Alliance, and POWER Interfaith, the Pennsylvania faith-based community organizing network, as they oppose the Justice Department's motion to end the agreement. Eli Segal of Stapleton Segal Cochran said in a statement that "the rule of law demands more here than vague assurances of 'substantial compliance.' It demands court-ordered action." Olivia Mania, attorney and Penn Carey Law Catalyst Fellow at the Public Interest Law Center, said in an interview that "communities in and around Philadelphia deserve access to a lending market that's free from discrimination." "This isn't just about one bank," Mania said in a statement. "It's about whether the federal government will honor its role in dismantling structural racism in the housing market - or walk away when the cameras are off.
