Man who spent 17 years in prison for rape he did not commit is given six-figure payout
The 59-year-old former security guard had his conviction quashed in 2023 after years protesting his innocence, but has struggled on benefits since then while waiting for his payout.
Mr Malkinson was wrongly convicted in 2004 and chances to free him were repeatedly missed, leading to one of the worst miscarriages of justice in British legal history.
In a statement on Wednesday, Toby Wilton, his lawyer from Hickman and Rose, welcomed the payment, but said the existing £1 million cap on compensation payouts should be lifted.
This is currently the maximum amount that can be paid to victims of miscarriages of justice who are wrongly jailed for at least 10 years.
Mr Wilton said: 'The arbitrary and unfair compensation cap should, at the very least, increase with inflation in just the same way that other compensation in the English legal system, and that – say – MPs' salaries increase over time.
'Andy Malkinson's life was shattered when he was sent to prison for more than 17 years for a crime he did not commit. He is only now starting to rebuild it.
'The Government should lift the current cap on compensation, and end the twisted quirk that whilst awards under other compensation schemes are excluded from assessment for benefits, Andy now faces the risk of losing his social housing flat just because he has been awarded this money.'
It was previously reported that Mr Malkinson, who was working in Salford at the time of his arrest, was struggling to survive on benefits following his release, and had to turn to food banks.
He told The Guardian that he would spend some of the money – said to be a significant six-figure amount – on a trip to Australia to see his half-sisters for the first time since 1990.
He said: 'It's been a mighty struggle, because I could hardly pay for my rent and food ... So I'm very pleased now that I'm financially independent and I've got the freedom I craved whilst in prison.'
Mr Malkinson, whose full compensation is still being assessed, was supported by Appeal, the legal charity, in his attempts to have his case reviewed by the Criminal Cases Review Commission.
Two of his applications in 2009 and 2020 were rejected, before Appeal commissioned fresh DNA tests that eventually led to his release.
It later emerged that he could have been freed a decade earlier if the similarities between his case and another wrongful conviction, that of a man called Victor Nealon, had been spotted and acted upon.

One user recognized the name "Yong Yu Sing 18" not as a person, but as a vessel. Reddit users quickly traced the name to the Yong Yu Sing No. 18, a Taiwanese tuna long-liner that vanished in December 2020. A Taiwan News report, published in early January 2021, said the vessel was last heard from on December 30 that year. Days later, the U.S. Coast Guard spotted it adrift, damaged and empty, in the middle of the Pacific Ocean, over 600 nautical miles [690 miles] northeast of Midway Atoll. There were no signs of the Taiwanese captain surnamed Li or his nine Indonesian crew members. The ship's lifeboat was missing, and its cabin windows were shattered. "My gut tells me it's a hoax," Matthew said, "but Reddit has made me think, 'Just maybe.'" In the comments, people were stunned. "Imagine this is real," wrote one user. ‘Top Boy' Actor Michael Ward Accused Of Rape And Sexual Assault In UK

The 27-year-old Jamaican-born performer is slated to appear before the Thames Magistrates' Court on Thursday, Aug. 28 to answer to the charges, People reports. He is currently facing two counts of rape and three counts of sexual assault levied by an accuser who remains unnamed by UK police. 'Our specialist officers continue to support the woman who has come forward – we know investigations of this nature can have significant impact on those who make reports,' said Detective Superintendent Scott Ware, whose team is leading the investigation for Metropolitan Police. Ward has not been arrested in connection to the crime and will appear before the court under his own free will. The young actor has been making a name for himself over the last few years appearing in projects like The Book of Clarence, The Beautiful Game and The Old Guard. He also received rave reviews for his work in The A List prior to his breakout role as Jamie on the Drake-produced Top Boy . 'I deny the charges against me entirely.
