
Gupta-linked Saxonwold mansions head to auction after seven-year legal battle
Three properties in business rescue will go under the hammer on 24 July.
After seven years of drawn-out litigation, three luxurious Saxonwold properties tied to Gupta-owned Confident Concept (Pty) Ltd are set to be auctioned.
The properties – including the family's former Johannesburg residence – are being sold by Park Village Auctions following a Supreme Court of Appeal ruling, marking what auctioneer Clive Lazarus calls 'the beginning of the end' of a long-running legal and business rescue saga.

Creditors can breathe a sigh of relief
The simulcast auction will take place on 24 July at 11am, with the sale expected to bring long-awaited relief to creditors.
Confident Concept held a substantial property portfolio including land adjacent to the infamous Saxonwold compound in Johannesburg. The company became embroiled in litigation with the City of Johannesburg, allegedly owing R726 695 in rates and taxes as of 2022.
It has faced two major areas of legal contention: business rescue proceedings due to financial distress, and disputes with municipal authorities over property development.
The business rescue process, which began in 2018, ran alongside the municipal disputes and involved other Gupta-linked companies.
It was characterised by internal conflict and protracted legal battles over the management of the company and its assets.

Opulent and decadent
The first property to be sold will be number 5 Saxonwold Drive, measuring 4 207 m², which is a three-storey residence featuring eight bedrooms, extensive living and entertainment areas, an indoor swimming pool, expansive rooftop patio, staff accommodation, and ample garaging.
Second on the list is number 7 Saxonwold Drive which also comprises three storeys with 17 en suite bedrooms.
The property also features a grand triple-volume foyer with an atrium-like domed skylight, multiple lounges, a cinema lounge, beauty salon, and staff accommodation.
The final property to be sold is number 3 Saxonwold Drive which is a single-storey, three-bedroom home with a single garage, storeroom and staff accommodation.
The entire contents of each house, namely furniture and appliances, will be sold as a single lot (not individual items) following each respective property.
Lazarus says he is humbled by Park Villages Auctions being entrusted to dispose of assets of such political significance once again, recouping millions for the corruption-afflicted creditors.

The statement followed an incident at the purification plant when the new guidelines were enforced, and some private vendors who were outraged insisted that they could continue to release their effluent as was previously the case. One vendor allegedly tried to bribe a municipal worker at the plant, offering him R16 000, according to Ramabitsa. After threatening to complain to the authorities about the recent spillage at the station, the vendor approached Ramabitsa directly and offered him R20 000 to allow the continued release of effluent at the plant. EFT payments and cybercrime: Court says car buyer is liable to ensure money is paid into the correct account
In a case involving cybercrime, the Supreme Court of Appeal ruled that it is the duty of a buyer to ensure that the money is paid into the seller's correct bank account. Image: File Cybercrime was once again the topic of a legal wrangle - this time before the Supreme Court of Appeal, which found that payment via electronic transfer (EFT) is only complete when the funds are received by the correct account holder. This judgment followed legal proceedings between two car sale companies – with the one who bought two bakkies from the other only to discover after delivery of the vehicles that cybercriminals had intercepted the electronic payment made for the vehicles. None of the parties were prepared to take the financial loss, and the seller initially turned to the regional court in Louis Trichardt to get its R290,000 back – the price at which it sold the two bakkies. The lower court earlier ruled that Hyundai Louis Trichardt had to pay Northcliff Nissan the R290, 000 for the vehicles. The magistrate reasoned that the two car dealerships had a contract in place and, cybercrime or not, Northcliff Nissan was due payment for the two bakkies. Aggrieved with this judgment, Hyundai successfully turned to the Limpopo High Court, sitting in Thohoyandou, to appeal the lower court's verdict. But Northcliff Nissan took the matter on appeal to the SCA. The risk of erroneous payment due to the cybercrime was that of the payer in this instance, the SCA found. 'Cybercrime risks do not automatically shift liability to the payee, and the courts will not impose an overarching legal duty on creditors to protect debtors from cyber fraud,' the court said. The court was told that in October 2018, Hyundai purchased two Nissan bakkies from Northcliff Nissan for the sum of R145,000,00 each. Northcliff Nissan emailed the invoices for both vehicles to the buyer. The invoices provided details of the nominated bank account for payment of the purchase price for the bakkies. On the same day, Hyundai paid for one bakkie and emailed proof of payment to Northcliff Nissan, after which the bakkie was then delivered. A few days later, Hyundai made another payment and took delivery of the second bakkie. At that stage, no one realised that cybercriminals were at work. Approximately a week later, Northcliff Nissan told Hyundai that payment of the purchase price for the bakkies had not been reflected in its bank account. It then became clear to the parties that the emails had been intercepted and the bank account details on the invoices were altered by a cyber fraudster. The parties realised that they were victims of business email compromise (BEC), a cybercrime that has become popular in this technological age of electronic communication and payment.
