Real estate underquoting: Industry leaders back calls to reveal auction reserve prices after report

McGrath Estate Agents founder and chief executive John McGrath strongly supported any changes that created greater transparency, but said sellers should retain the right to accept or reject any offer.
'The real issue isn't reserve pricing, it's agent compliance with existing price guide regulations,' McGrath said. 'If agents follow a straight bat with current quoting rules, transparency issues largely disappear.'
On Monday, Premier Chris Minns said he reserved the right to look at legislation that would force agents to publish the vendor reserve before auction, but there were no immediate plans to do it.

The NSW Office of Fair Trading is looking at potential industry reforms by way of a series of roundtable forums with stakeholders. Key among those measures are increased penalties for underquoting and a similar model to Victoria that offers better pricing guides for buyers.
Tim McKibbin, chief executive of the Real Estate Institute of NSW, is among those working in the background with Fair Trading on the reform process.
'What I can say is that we are committed to finding a solution, everything is on the table and some encouraging progress has been made,' said McKibbin.
McKibbin's industry lobby group chief counterpart in Victoria, Jacob Caine, revealed on Sunday that the institute would support the introduction of reserve price disclosure as well the adoption of a new model that would provide free building and pest reports to prospective home buyers.
The rules around property pricing are tighter in Victoria than in NSW.
Victorian legislation makes price guides mandatory on marketing, and price estimates must be accompanied by a statement of information showing comparable sales that inform the estimate.
In NSW, Liberal leader Mark Speakman said he would consider the issue of whether vendor reserves should be published, but as yet the party hadn't committed to a position.

Construction work to replace the MCG's Shane Warne Stand won't begin any earlier than 2030 or 2031, the Melbourne Cricket Club says, confirming that a slate of major events at the iconic Melbourne institution will impact the timing of the proposed major stadium overall. Plans to rebuild or refurbish the stand – which covers half the MCG and was built in 1992 – have been in the mix for some time, as it had an anticipated lifespan of about four decades and is considered an ageing asset. The Victorian government and the MCC have already completed a feasibility study to determine the future of the 45,000-seat stand – previously known as the Great Southern Stand – which caters for nearly half the stadium's capacity. MCC chief executive Stuart Fox told the club's annual general meeting on Tuesday night that the Warne stand overhaul would 'certainly be challenging' and would require additional public and private funding support as the club 'wouldn't be capable of doing that on our own'. This masthead reported three years ago that the Victorian government, emboldened by its agreement with the AFL to host every grand final until 2057, would be expected to foot the majority of the bill. The MCC has recorded a net profit of $38.35 million for the financial year ending March 31. The latest result came after the club posted a net profit of $32.1 million last financial year. The club has also reported having cash reserves of nearly $80 million. Loading Fox and MCC president Fred Oldfield told the meeting that the project remained a high priority. 'We've done the initial work on the Shane Warne Stand, and that was in conjunction with the Victorian government,' Fox said.

For a place that, let's be honest, rarely crosses the mind of most Sydneysiders, Rosehill racecourse is punching above its weight in the Harbour City's news cycles of late. Responsibility for that partly lay with Chris Minns' well-intentioned plan to buy the site for $5 billion and build 25,000 new homes, a move rejected by most Australian Turf Club members keen to stick a middle finger up at the premier and Peter V'landys. The botched deal was the subject of many a deranged tirade from NSW upper house MP Mark Latham, one of its loudest opponents, for whom Rosehill has been the site of many a recent humiliation. On the day of the Rosehill vote, Latham separated from former girlfriend Nathalie Matthews, who later made a series of allegations of abuse against the former Labor leader. Latham has denied Matthews' claims. Rosehill was also the site of an earlier embarrassing incident for Latham, who in April launched into an expletive-laden rant against the ATC's head of corporate affairs Steve McMahon, a friend of Minns, when the two crossed paths in the members area. The ATC slapped Latham with a 12-month good behaviour bond, while the MP later rage-quit the club. Loading Racing NSW drafted in former Australian Criminal Intelligence Commission boss Michael Phelan to conduct its own investigation into the incident. This week, they charged Latham in connection with abusing officials. 'Some people have taken their defeat at Rosehill really hard,' Latham sniggered on X, with a picture of an email from the regulator's operations manager – integrity, Michael Cleaver, relating to 'charges issued by Racing NSW stewards'. Latham could face penalties in the form of a fine, or at the most severe, being 'warned off', which would leave the upper house rogue banned from racetracks, unable to have a punt and restricted from ownership of a horse.

The premier was similarly open to the idea of allowing businesses to require employees to work full-time from the office during the probationary period of their contracts. Loading 'That's a terrific example of how undertaking the consultation is about getting this right,' she said. 'It's about hearing from both businesses and also from workers about their real-world experience. 'We know not everyone wants to work from home. There are many who want to be in the office. This legislation is about protection for those who can, for those who need to.' The most reliable national data on working from home, gathered by the Australian Bureau of Statistics, is that 36.3 per cent of people usually work from home – a figure that appears to have stabilised to a post-pandemic normal. Victorian public service employees are entitled to work from home two days a week, but Treasurer Jaclyn Symes confirmed that the real rate of such work was most likely higher. 'Anecdotally, whether that is being complied with strictly is probably questionable,' she said. 'It is certainly our expectation that staff are in the office three days a week. That's certainly happening in my office, and I know it's happening in many workplaces, but I can't confirm it's happening across the board. 'That's something that I think these conversations will help generate.' The government's online survey, which asks respondents how many days they work from home, their reasons for doing so and the benefits and disadvantaged associated with it, will provide a more detailed snapshot of working-from-home practices in Victoria. Politically, the Allan government is convinced that its work-from-home pledge is a winner. During question time on Tuesday, the government used its entire allotment of ministerial statements – Victoria's version of Dorothy Dixer questions – to spruik the benefits of working from home. While reported productivity gains of work-from-home are more pronounced for individual workers than the companies that employ them, Allan said increased participation of women in the labour market was one of the clear benefits of more flexible workplaces. 'It broadens the talent pool that employers can draw on for their workplaces,' she said. 'We know that balancing family responsibilities is a significant barrier, particularly for women to enter the workplace. 'At a time when we have skill shortages, at a time when that is a real constraint on our economy, getting more people into the workforce is good for the economy, it's good for those businesses and it's great for the individuals who feel that they are making a meaningful, productive contribution to society.' The online survey, results of which will be published in anonymised form, is open until September 28.
