Federal Court Dismisses Roku Lawsuit Against Access Advance, Declines to Set Global Patent Pool Pricing
BOSTON — Access Advance LLC today announced that the US District Court for the District of Massachusetts has dismissed a lawsuit filed by Roku Inc. seeking to compel the Court to set a global fair, reasonable and non-discriminatory (FRAND) royalty rate for the HEVC Advance Patent Pool. Judge Richard G. Stearns determined that his Court 'lacks jurisdiction to determine' a global FRAND royalty rate, noting that the 'US patents constitute only a fraction of a larger portfolio.' The Court further concluded that its 'opinion on the appropriate royalty rate would merely be advisory', which is prohibited under US law.

In December 2024, Roku sued Access Advance LLC, along with patent pool licensors Dolby Laboratories Inc. and Sun Patent Trust, in the District of Massachusetts seeking judicial determination of whether any of the numerous offers the Defendants made to Roku for three separate licenses to global patent portfolios – including the HEVC Advance Patent Pool containing more than 27,500 patents owned by dozens of non-parties to the litigation and issued in 117 different countries and territories – were FRAND, and if it was not, then to set a worldwide FRAND rate. Roku's Massachusetts complaint raised issues already pending for months in three cases involving the same licensors before the European Unified Patent Court ('UPC') in Germany. By seeking a second opinion from the Massachusetts Federal Court, Roku attempted to circumvent the UPC's determination of these same questions, forum shop to address the same or similar disputes in multiple venues, and obtain from the Massachusetts Federal Court an opinion on license terms.

In its order dismissing the lawsuit, Judge Stearns determined that the Court does not have jurisdiction to set a global FRAND rate as requested by Roku. The dismissal also effectively precludes any conflict between the Massachusetts lawsuit and the UPC actions well underway in Europe.

The Roku decision is consistent with the decisions to date in ongoing litigation in the United Kingdom, where Tesla is appealing the UK Appeals Court's affirmance of the UK Patents Court's denial of Tesla's attempt to obtain worldwide FRAND rates for the Avanci patent pool, which does not own any UK patents.

The decision adds to a growing body of cases in which national courts are reluctant to set worldwide FRAND rates absent agreement from the parties. This is expected to maintain stability in standards essential patent licensing and encourage good-faith participation in SEP pool licensing negotiations.

Capital Markets Bounce Back: What This Means for JPMorgan's Prospects
JPMorgan 's JPM capital markets operations, housed in its Commercial & Investment Bank (CIB) segment, are a core earnings driver, contributing roughly 40% of total net revenues. The segment's performance is highly correlated with deal-making momentum, trading activity and overall market conditions, making it a key beneficiary of a sustained capital markets revival. After a slowdown in 2022 and 2023 due to geopolitical tensions, recession fears and inflationary pressures, the capital markets staged a notable rebound last year. JPMorgan's investment banking (IB) fees within the CIB surged 36% year over year, reflecting improved underwriting volumes and advisory mandates, while markets revenues rose 7% on elevated volatility and trading demand. Importantly, the bank retained its #1 position in global IB fees, underscoring its competitive strength and client franchise depth even in challenging conditions. While early 2025 saw mixed sentiment, with optimism tempered by tariff-driven policy shocks, deal-making has regained momentum. JPMorgan captured an 8.9% IB wallet share in the first half of 2025, with IB fee growth expected to continue at a steady pace. This sustained uptrend in IB fees should provide a stable growth anchor for the CIB segment, as corporates re-enter equity and debt markets for capital raising and strategic transactions. While structural normalization in trading activity is inevitable over time, JPMorgan's broad product coverage across fixed income, currencies, commodities and equities positions it to capture upside during volatility spikes. The revival of capital markets provides JPMorgan with a dual tailwind: a steady lift from the recovery in deal-making and opportunistic boosts from trading in periods of market dislocation. How JPMorgan Stacks Up Against Peers in Capital Markets Similar to JPM, Bank of America BAC witnessed subdued IB performance in 2022 and 2023, with revival happening last year. In 2024, the company's IB fees soared 31% year over year. Then, in the first six months of 2025, Bank of America's IB fees declined on a year-over-year basis on muted industry-wide trends. Coming to the trading business, Bank of America's sales and trading revenues have been increasing since 2022 (the metric increased 13% year over year in the first half of 2025). Yet, the volatile nature of the business and expectations that it will gradually normalize toward the pre-pandemic level are likely to make growth in the same challenging. Another key peer, Morgan Stanley MS, leans heavily on the IB business to sustain profitability, with IB revenues jumping 36% last year after plunging in 2023 and 2022. But performance of the company's IB business has been subdued this year, with the metric rising just 1% from the prior-year quarter. Nonetheless, Morgan Stanley remains cautiously optimistic about the performance of the IB business, supported by a stable and diversified M&A pipeline. Also, Morgan Stanley's trading business performance has been stellar over the past several quarters, attributable to uncertainty surrounding the tariff plans and macroeconomic headwinds. As market volatility and client activity are expected to remain decent, the company's trading business will likely continue to grow. JPMorgan's Price Performance, Valuation and Estimates JPMorgan's shares have soared 21.2% this year, outperforming the S&P 500 Index's gain of 9.5%. Los Angeles Olympics to sell naming rights to some venues
Organizers of the Los Angeles Olympics will sell naming rights for a handful of its venues in deals expected to bring multiple millions of dollars to the 2028 Games while breaking down the International Olympic Committee's long-sacrosanct policy of keeping brand names off its arenas and stadiums. The organizing committee announced the landmark deal Thursday, saying contracts were already in place with two of its founding partners – Honda, which already has naming rights for the arena in Anaheim that will host volleyball, and Comcast, which will have its name on the temporary venue hosting squash. LA28 chairman and CEO Casey Wasserman said revenue from the deals goes above what's in LA's current US$6.9-billion budget. He portrayed the deal as the sort of paradigm-shifting arrangement that Los Angeles needs more than other host cities because, as is typical for American-hosted Olympics, the core cost of these games aren't backed by government funding. 'We're a private enterprise responsible for delivering these games,' Wasserman said in an interview with The Associated Press. 'It's my job to push. That doesn't mean we're going to win every time we push, but it's our job to always push because our context is pretty unique.' Looking ahead to Los Angeles: 10 Canadian athletes to watch for in the 2028 Olympics No-car Games: 2028 Los Angeles Olympic venues will only be accessible by public transportation Wasserman said he also spent time explaining to IOC members how arena and stadium names are part of the lexicon in American sports. 'People know 'Crypto' as 'Crypto,' they don't know it as 'the gymnastics arena downtown,'' Wasserman said of the home of the Lakers, Arena, which will host gymnastics and boxing in 2028. Rights for up to 19 temporary venues could be available. The IOC's biggest sponsors – called TOP sponsors – will have first chance to get in on the deals. Wasserman said no venues will be renamed – so, for instance, if organizers don't reach a deal with SoFi (opening and closing ceremonies, swimming) or Intuit (basketball), no other sponsor can put its name on the arena. Not included in this new arrangement are the LA Coliseum, Rose Bowl and Dodger Stadium, some of the most iconic venues in a city that hosted the Olympics in 1932 and 1984. Organizers said IOC rules that forbid advertising on the field of play will still apply. The deal adds to a growing list of accommodations pushed through for Los Angeles, which is once again poised to reshape the Olympic brand, much the way it did in 1984. In 2017, the city was bidding for the 2024 Olympics against Paris, but agreed to instead host the 2028 Games. It was part of a then-unheard-of bid process that rescued the IOC from the reality that cities were becoming reluctant to absorb the cost and effort to bid for and host the Summer Games. Olympic watchers viewed the return of softball and baseball for 2028, along with the introduction of flag football (with help from the NFL) as changes that maybe only Los Angeles could've pulled off. LA will also make a major scheduling change for the Olympics, moving track and field to the opening week of the games and swimming to the end. Wasserman said the organizing committee's position as a private entity plays a major role in its relationship with the IOC. 'We spend the time, we do the work, we make the argument, and we don't settle for a 'No,' because we don't have that luxury,' he said.
