Use foreign drivers, lose your lorry, JPJ warns companies under strict new rule

GOMBAK, Aug 8 — The Road Transport Department (JPJ) will enforce strict action including confiscating vehicles owned by companies and licensed operators that employ foreigners to drive commercial vehicles, effective yesterday.
JPJ's Senior Director of Enforcement Muhammad Kifli Ma Hassan said the action involves lorries, public service vehicles (PSV) and tour (sightseeing) buses that use foreign drivers.
According to him, based on current regulations, foreigners are not allowed to hold a Vocational Licence such as Goods Drivers Licence (GDL) or Public Service Vehicle (PSV) and any violation is a serious offence.
'In this case, enforcement action can be taken according to Sections 22, 41, 57 of the Land Public Transport Act (APAD) 2010 for violating permit conditions and Section 80 of APAD 2010, which is that officers can seize and take to court to forfeit the commercial company's vehicle if found guilty,' he said at a press conference at the JPJ Enforcement Station here today.
He said the action follows an increasing trend of companies and licensed operators employing foreigners for around RM2,500 a month, as well as drivers with repeated offences.
As of July this year, the JPJ had issued 2,733 summonses against foreigners driving commercial vehicles — involving 2,551 cases of no GDL, 93 cases or no PSV and 89 cases of overloading.
'Licensed companies and operators in the transport industry are urged to always comply with the regulations set and ensure that every employee hired has valid documents and qualifications.
'Continuous inspection and monitoring operations in collaboration with other enforcement agencies and uncompromising firm action will be taken against any party found to be violating any Act 333 of the Road Transport Act 1987 (suspension or endorsement/penalty points on driving licence), Act 715 of the APAD 2010 and other related acts,' he said.
Meanwhile, in an operation in Selayang yesterday, JPJ identified a foreign lorry driver who was using a fake MyKad and fake driving licence.
'Further checks found that the identity card and Competent Driving Licence (CDL) as well as the Goods Vehicle Licence (GDL) were all fake... this issue of forged documents is a serious offence,' he said, adding that his party would investigate the syndicate involved in issuing the fake licence.
In a separate case, an Indonesian lorry driver was also arrested in Sungai Pusu, Gombak for driving without any documents and handed over to the KL Immigration Department (JIM) for further action.
He explained that based on previous operations, JPJ also detected several cases of foreign drivers using fake licence. — Bernama

KUALA LUMPUR, Aug 8 — Two friends pleaded not guilty in the Sessions Court here today to a charge of gang robbery against property belonging to a female Chinese national, involving losses amounting RM2.1 million, last month. Mohd Syaqir Mohd Ami, 30, and Nur Mohamed Mahsar Mohamed Nor, 34, were jointly charged with two other individuals who are still at large with committing gang robbery against property belonging to Chen Kexue, 31. The assets include a branded wristwatch worth RM1.2 million, three gold bars weighing 300 grammes, RM100,000 in cash, and five mobile phones of various brands, with an estimated loss of RM2,146,000, at a villa in Bukit Damansara here, at 10.10pm on July 21. The charge was brought under Section 395 of the Penal Code, which provides for a prison sentence of up to 20 years and whipping, if convicted. Deputy Public Prosecutor Nidzuan Abdul Latif did not offer bail because the offence is non-bailable, and also requested the court to consider the offence serious, involving high losses. 'If the court grants bail, there is a risk of the accused fleeing because during the arrest, one of the accused tried to escape. 'However, if the court grants bail, I request that each accused be granted bail of RM60,000 along with the additional condition that they must report to the nearest police station and surrender their passports to the court,' he said. Lawyer Hazwan Hassan, representing the two men, requested the court to grant his clients bail between RM10,000 and RM15,000 with certain additional conditions, as bail is only to ensure the accused's attendance in court. Mohd Syaqir works as a salesman and earns RM2,000 per month. He supports his mother, who has stage four cancer, and he just recovered from paralysis after being involved in an accident in August last year. 'Meanwhile, Nur Mohamed Mahsar, who also works as a salesman and earns RM2,000 a month, has to support his wife and two young children,' the lawyer said, adding that there was no risk of the two accused fleeing. Judge Siti Shakirah Mohtarudin, who set the case mention for September 30, granted bail of RM15,000 to each accused, along with additional conditions requested by the prosecution. — Bernama

IPOH, Aug 8 — The High Court here today sentenced a man to death by hanging for killing a Bangladeshi man in Sungai Kinta, Sungai Galah area, Kampung Gajah in Perak Tengah district, seven years ago. Judge Su Tiang Joo sentenced Mohamad Amier Amzar Mohamad Aspar, 28, after the man was found guilty of killing MD Ovaidul, 32, at the location between 8.20pm and 10.25pm, December 15, 2018, under Section 302 of the Penal Code. Su in his judgment said he agreed with the prosecution that the murder was premeditated and committed in an extremely brutal manner by the convict. 'It could have caused much pain and agony to the deceased over a prolonged period of time in between the beating in his house and then being taken to the riverbank before the fatal cut was administered by the accused and the body unceremoniously dumped into the river to hide traces of the crime. 'In other words, the death was not sudden and quick. In the second circumstances, I accept the presumptions of the prosecution that the death sentence would be appropriate and I sentence the convict to be punished with death and pursuant to Section 277 of the Criminal Procedure Code, the accused is to be hanged by the neck until he is dead,' he said. Su said he found that there are more aggravating circumstances than mitigating circumstances, among them are the convict interfering with prosecution witness, the pain and suffering from the injury suffered and the extent of the injuries, and the accused dumping the body of the deceased into the river. 'The convict is a Malaysian and the deceased a Bangladeshi national. This is a neutral circumstance because under Article 8, Sub-Article 1 of our Federal Constitution, all persons are equal before the law and are entitled to the equal protection of the law,' he said. Earlier, MD Hossain Khan, the victim's brother, also delivered a victim impact statement with the help of an interpreter on behalf of his family in Bangladesh. MD Hossain said MD Ovaidul was the third of six siblings with both parents still alive, besides the family was dependent on the victim working in Malaysia to support their livelihood in Bangladesh. 'Before the incident, my brother had told me that he planned to return to Bangladesh within a month to get married. 'Our family had made preparations in the village, but those dreams were shattered when he was brutally murdered and more sadly, murdered by the son of his own employer, the accused,' he said. MD Hossain said the death of MD Ovaidul left a deep impression on him and his family because his younger brother was not a criminal but a good son and brother and was the hope of the family. 'My younger brother did not die of illness, did not die of an accident but he died because he was brutally murdered by the person who was supposed to protect him as an employer. The accused's actions against my younger brother were inhumane,' he said. The prosecution was conducted by deputy public prosecutor JS Geetha while the accused was represented by lawyer V. Santhiran. After the judgment proceedings today, the accused was seen hugging his family members who were crying after hearing the verdict. The trial, which began on January 6, 2020, involved 24 prosecution witnesses and one defence witness, the accused himself. On December 19, 2018, the media reported that the body of a man with one leg tied to a motorcycle was found in Sungai Kinta, Sungai Galah area, Kampung Gajah on the evening of December 18. — Bernama

ALOR SETAR, Aug 8 — Four men, who were in a sports utility vehicle (SUV) and are suspected of fatally hitting a policeman in an incident at Taman Golf, here, yesterday, have been remanded for seven days, starting today. The remand order, issued by Magistrate Siti Nor Hasliza Md Ali at the Alor Setar Court Complex, will allow investigations under Section 302 of the Penal Code to continue until Aug 14. Before the proceedings, the suspects, aged between 24 and 26, were brought to the court complex in a police van at 8.45 am and left the premises at about 9.55 am. Yesterday, the media reported that a policeman was killed after being struck by an SUV with four men on board, believed to be criminals attempting to flee after committing a burglary at a house in Taman Golf. In the 3.30 pm incident, the victim, Corporal Mohd Hafizul Izham Mazlan, 35, of the Kedah contingent police headquarters' Criminal Investigation Department, died at the scene from severe injuries. — Bernama
