Blake Lively Abandons Claims Against Justin Baldoni of Infliction of Emotional Distress
Blake Lively is attempting to withdraw her claims against Justin Baldoni of intentional infliction of emotional distress and negligent infliction of emotional distress. The move comes after Baldoni's legal team sought discovery that included her medical records in their efforts to defend the 'It Ends With Us' director against her claim that she suffered 'severe emotional distress and pain, humiliation, embarrassment, belittlement, frustration and mental anguish.' Lively's attempt to withdraw the two claims surfaced in a filing Monday by Baldoni's attorneys, who are seeking to compel the actress to sign a HIPAA release for access to therapy notes and other relevant information.
'Instead of complying with the Medical RFPs, Ms. Lively's counsel recently advised us, in writing, that Ms. Lively is withdrawing her [infliction of emotional distress] Claims,' today's filing states. 'However, Ms. Lively has refused the Wayfarer Parties' reasonable request that the withdrawal of such claims be with prejudice. She is only willing to withdraw her claims without prejudice. In other words, Ms. Lively wants to simultaneously: (a) refuse to disclose the information and documents needed to disprove that she suffered any emotional distress and/or that the Wayfarer Parties were the cause; and (b) maintain the right to re-file her IED Claims at an unknown time in this or some other court after the discovery window has closed.'

The court will now need to decide whether to compel Lively to turn over the information on her mental health, which she has sought to avoid, or dismiss the two claims with or without prejudice. It is standard procedure in cases alleging physical or emotional injury for the defense to access the plaintiff's medical records that would shine a light on the root and scope of alleged distress. What is unusual is for a plaintiff to abandon the claims midstream given that it is well known heading into such a lawsuit that medical records will be an unpleasant but inevitable part of the discovery process.
The filing, addressed to Judge Liman in U.S. District Court Southern District of New York and signed by Baldoni attorney Kevin Fritz, offers a window on a back and forth that appears to have played out between lawyers for the dueling sides. It continues: 'Ms. Lively cannot have it both ways. If Ms. Lively wants to withdraw her frivolous IED Claims, the Wayfarer Parties are entitled to a dismissal with prejudice to ensure they will not be re-filed. If Ms. Lively is unwilling to stipulate to the dismissal of her IED Claims with prejudice, then the Wayfarer Parties will continue to defend against them, and she must produce her medical information and documents as set forth herein.'
The two emotional distress claims were key components of Lively's lawsuit against Baldoni, which she filed in federal court in December after he sued the New York Times for defamation over its story about what happened on the set and in the run-up to the release of the 2024 domestic violence drama, which became a box-office hit, earning $351 million at the box office worldwide off of a $25 million budget. Lively claims she was sexually harassed by Baldoni and producer Jamey Heath and subjected to a smear campaign by his proxies when she complained. Baldoni, who is suing Lively and her husband Ryan Reynolds for $400 million, claims the 'It Ends With Us' star tried to extort him and subsequently defamed him.
'By alleging that she suffered physical and emotional injuries, Ms. Lively has placed her physical and mental condition at issue and, in turn, must produce relevant information and documents [including] psychiatric records,' today's filing states. 'In other words, Ms. Lively has waived any doctor-patient privilege.'
The twists and turns in the saga, which now includes six related lawsuits, have hit the docket quickly. Baldoni is also suing and being sued by his former publicist Stephanie Jones who he claims leaked text messages that sparked the ordeal.

The backstory Viewers of the Thailand-based third season of The White Lotus watched as the star-crossed, age-gapped tragic lovers Rick and Chelsea marched toward doom together in a beautiful resort. Everything appeared to be just as loving off-camera, where they had the kind of relationship that involved Goggins posting things like "You are the brightest light in every room. A Human's Human. Miss you," on Wood's Instagram. But in the months that followed, something changed. Specifically, both of their Following lists. Internet sleuths realized that Goggins and Wood had mutually unfollowed each other on the platform and left it to everyone who cared to connect the dots. And, of course, no one was chill about it. The foundation of the rumor seems to have come from context-free quotes their costar Jason Isaacs gave to The Guardian during a preview piece for the season. "There were alliances that formed and broke, romances that formed and broke, friendships that formed and broke," he said. "It's a long period of time for people to be away from their family with an open bar and all the wildness being in Thailand allows." Talking around it The first big refutation of the rumor came from Goggins. But it wasn't an outright denial and mainly added fuel to the fire. While speaking with The Times, the actor seemed to get frustrated by questions about the potential feud, but that could have been due to the interview being pegged to an entirely different project. "I'm not gonna have that conversation," he said, before later adding, "There is no conversation to be had about that." A few days after that story was published, both Goggins and Wood attended the Met Gala, but were not photographed together. Fielding a question about whether she would stop by her costar's upcoming Saturday Night Live hosting gig, Wood—who had weeks before been mocked on the show—responded "I'm not doing that," then added "Yeah, why not? Why not? Yeah, it would be fun." The interview The cover story dates the interview to the first weekend in May, which winds back the clock a bit for those timestamping the drama. The meet-up was their first in months and was, from the trade's account, quite emotional. "Visibly emotional seeing each other, the two embraced for 30 seconds as the Variety team suddenly felt we were intruding on a private moment." The interview with The Times had come out just days before the Variety interview and was fresh in Goggins' mind. He spoke directly to the rumors. "There is no feud," he said, at one point getting choked up. "I adore, I love this woman madly, and she is so important to me. This is Goldie Hawn. This is Meg Ryan. She can do anything, and she will. You watch what the next 20 years of her experience will be. I'll be on an island, I think Greece. But she's special. There is no feud. She is love and I know that I am that to her. We care about each other very deeply." Wood took a broader view of the controversy, saying that it was indicative of where we are culturally. ‘Wicked: For Good' Trailer Sees Glinda and Elphaba's Friendship Tested
Ariana Grande and Cynthia Erivo prepare for the ultimate frenemy confrontation in the new trailer for Wicked: For Good, set to hit theaters Nov. 21. The clip opens with Glinda and Elphaba meeting on a balcony. 'There's no going back,' Elphaba says. 'This is between the Wizard and I.' Wicked: For Good will pick up immediately after the events of the last year's blockbuster smash, which concluded with Erivo's rendition of 'Defying Gravity.' The song accompanies Elphaba's decision to rebuff Madame Morrible (Michelle Yeoh) and the Wizard of Oz (Jeff Goldblum) after learning they're behind the oppression of animals in Oz, and that they want to use her magical skills for their own gain. He's convinced to come out of retirement and train a rookie prodigy, played by Damson Idris, for the Apex Grand Prix race. Joseph Kosinski, who directed Tom Cruise in the high-flying blockbuster 'Top Gun: Maverick,' helmed the film with producer Jerry Bruckheimer and real-life Formula One superstar Lewis Hamilton. The supporting cast includes Javier Bardem and Kerry Condon. During a virtual press conference earlier this year, Kosinski discussed the making of the film, explaining that he became a fan of Formula 1 racing after discovering Netflix's 'Drive to Survive' series during the COVID pandemic. 'I loved how the first season of the show focused on the last place teams, the underdogs, rather than the Ferrari, the Mercedes, the Red Bull, the teams that you see at the front of the pack,' he said. 'I thought that there was an interesting story to be told about an underdog team trying — not to win the championship — but just trying to win one race against these titans of the sport.' Kosinski and his actors traveled the F1 circuit over the course of a year in order to film at the real races. He explained: 'We get these 10 or 15 minute slots where we'd have to have Brad and Damson ready in the cars, warmed up with hot tires ready to go, and as soon as practice ended, they would pull out onto the track. We'd have 24, 30 cameras ready, rolling, and I'd have to shoot these scenes in these very short, intense, high-speed windows. But the crowd you're seeing was really there in the stands.
