PUTRAJAYA: A Myanmar national has escaped the gallows after the Court of Appeal substituted his death sentence with 30 years' imprisonment for murdering his employer, a local woman.
A panel of three judges, comprising Datuk Nazlan Mohd Ghazali, Datuk Azmi Ariffin, and Datuk Dr Choo Kah Sing, had, on April 17, dismissed Than Nwe Soe's appeal against conviction but allowed his appeal against the sentence.
The court also imposed 12 strokes of the cane on Than and ordered him to serve the prison sentence from the date of his arrest, which was April 13, 2018.
In a written judgment dated June 6, Datuk Azmi Ariffin stated that after reviewing all the evidence, the court found the case suitable for the exercise of judicial discretion under the Abolition of Mandatory Death Penalty Act 2023 to substitute the death sentence with imprisonment.
He added that the Act, which came into force on July 4, 2023, gave the court discretionary power to choose between imposing the death penalty or imprisonment of between 30 to 40 years, along with at least 12 strokes of the cane if the death penalty was not imposed.
Justice Azmi said the appeal filed by Than had no merit, and the conviction for murder was safe to be upheld.
He said that the accused (Than) and an individual still at large were fully responsible for causing injuries and death to Goh Geok Leng.
He added that a colleague of the accused had been informed by Than that he (the accused) had kept the deceased's body in a container, and based on that information, police found the victim's body under the container where the accused resided.
Justice Azmi said there were also findings of the accused's DNA and the deceased's DNA at the location where the body was found under the accused's container, which further strengthened the prosecution's case.
On Jan 30, 2023, the Johor Bahru High Court found Than guilty of murdering Goh, 43, and sentenced him to death. Than subsequently filed an appeal with the Court of Appeal.
He was accused of committing the offence with an individual still at large, at the Yu-Win Motor Trading Sdn Bhd premises in Kg Sri Purnama, Johor, at about 2 pm on April 13, 2018.
The victim was found half-naked, with her eyes blindfolded, her mouth gagged, and her hands and feet shackled with chains.

Chong, the state opposition leader, said his legal team had written five times to the High Court to request for the grounds of judgment but to no avail. He said the appellate court was scheduled to hear his appeal against the High Court's decision today but could not proceed as there were no grounds of judgment. 'Finally, the Court of Appeal has ordered the High Court to provide the grounds of judgment within one month from today. It has postponed hearing of the appeal,' Chong said in a statement. The Sarawak DAP chief also said his lawyers would be writing to the chief judge of Sabah and Sarawak on the matter. The state government and Sarawak Financial Authority (SFA) had sued Chong in 2013 for claiming that RM11 billion in state funds had disappeared into a 'black hole'. The case only came up for trial in January 2021, with 26 days of proceedings before it concluded in July the same year. In August 2022, High Court judge Alexander Siew, then a judicial commissioner, ruled that Chong had defamed the plaintiffs and awarded RM150,000 in damages.

KUCHING: The Court of Appeal has ordered the trial judge in the defamation trial of Stampin MP and Sarawak DAP chairman Chong Chieng Jen to provide the written grounds of judgment within one month from today. This is to enable the hearing of Chong's appeal to be heard. The hearing of the appeal today had to be postponed as the written judgment was not available. "As directed by the Court of Appeal, my lawyers will also be writing to the Chief Judge of Sabah and Sarawak on this matter," Chong said. He hoped to receive the grounds of judgment soon for the appeal to proceed. Chong said the trial had concluded four years ago and "yet there is still no grounds of judgment from the trial judge". In 2012, Chong criticised the state's budget, pointing to what he described as a recurring line item titled "government's contribution towards government-approved agencies trust fund". He argued that this allocation acted as a "black hole" since it lacked transparency as substantial sums in billions of ringgit were transferred without disclosure of the actual recipients or their uses. In 2013, the then Sarawak government and State Financial Authority (SFA) filed a defamation lawsuit against him following his published claims, including in leaflets and news outlets, that RM11 billion in public funds had gone into this "black hole". The suit was filed in the Kuching High Court, and the trial started on Jan 7, 2021. On August 30, 2022, the judge ruled in favour of the state government, determining that Chong's "black hole" remark was defamatory, and that his defences — justification, fair comment, and qualified privilege — did not hold. The judge ordered Chong to pay RM150,000 in damages and RM50,000 in legal costs, and issued an injunction preventing him from repeating the statement. Chong said the trial judge then did not provide the grounds of judgment. "After almost three years from the decision of the High Court judge, or four years after the conclusion of the trial, the judge has not provided the grounds of his judgment. "Over the years, we have written five times to the High Court to request the grounds of judgment, but all to no avail," Chong said. He said because there were no grounds of judgment, his appeal, which was to have been heard today, had to be postponed. Chong filed the appeal on Sept 12, 2022, arguing that allowing the government to sue individuals for defamation was a dangerous erosion of freedom of speech and that the judgment posed a threat to democratic rights across the Commonwealth. The judge who presided over the trial was a judicial commissioner at the time.

A three-member bench comprising Datuk Azimah Omar, Datuk Wong Kian Kheong, and Datuk Ismail Brahim, unanimously made the decision and ordered the judicial commissioner to deliver the written grounds within one month from today. The court further directed Chong's legal team to write to the Chief Judge of Sabah and Sarawak Datuk Azizah Nawawi to inform her of the unavailability of the written grounds. Chong's lawyer Michael Kong pointed out the appeal was adjourned because the grounds of judgment had not been provided to the parties despite the trial concluding 49 months ago. During the appeal, Chong was also represented by counsels Chong Siew Chiang, Sharon Lo, and Brenda Chong. The respondents were represented by legal officers Ronald Felix Hardin, Mohd Adzrul Azlan, Mohamad Muhaimin Zakaria, and Felicity Thomas. In 2013, Chong, who is Stampin MP, alleged that RM11 billion from the state coffers had disappeared into a 'black hole' — implying financial mismanagement by the Sarawak government and the Sarawak Financial Authority (SFA). In a statement today, Chong said the state government subsequently sued him for defamation and the trial ran from Jan 7, 2021 to July 5, 2021. On Aug 30, 2022, Judicial Commissioner Alexander Siew How Wai ruled in favour of the plaintiffs, awarding RM150,000 in damages and RM50,000 in legal costs. 'However, he did not provide the grounds of judgment — the reasoning for his decision in favour of the state government,' Chong said. The court also granted an injunction restraining Chong, whether by himself, his servants, agents, or otherwise, from publishing or causing to be published the same or similar words or statements.
