New Delhi: Supreme Court Thursday refused to entertain a doctor's plea seeking suspension of the sentence of life imprisonment awarded to him after being convicted under the Protection of Children from Sexual Offences Act (Pocso) for raping his seven-year-old daughter.
A bench of Justices B V Nagarathna and Satish Chandra Sharma said he was not entitled to bail, considering the kind of things he did to his daughter.
The convict's lawyer contended that he was framed because of differences with his wife, and that she tutored the child to testify against him. His wife is also a doctor but despite that the medical examination of his daughter was delayed by three months and no injury marks were found on her body, the advocate said.
The bench, however, said there was no reason to disbelieve the child's statement and she also withstood the cross-examination. "The man became a beast. Please don't force us to say anything more... She testified against her father. Why should we disbelieve her," it asked.
Pressing for relief, the convict said it would take years for Allahabad HC to decide his appeal and he would have to languish in jail during the pendency of the case. He said 12 lakh cases were pending in HC, and appeals filed in 1981 were being heard now. But SC refused his plea and granted him permission to file a fresh bail petition after some time.
"This is the most liberal bench and if we are not granting bail it means there is something. We cannot help it," Justice Sharma said.
The man was convicted by a Varanasi court and sentenced to life imprisonment.

The Supreme Court has set aside the cognisance of a prosecution complaint (equivalent to a chargesheet) taken by a lower court in a money laundering trial involving M/s Rathi Steel and its top executive, who were booked by the Enforcement Directorate (ED) in connection with a coal allocation case . A division bench comprising Justices AS Oka (who retired last month) and Ujjal Bhuyan set aside the cognisance order dated November 20, 2024, solely on the ground of "non-compliance" with new provisions under the Bharatiya Nagarik Suraksha Sanhita (BNSS). These provisions require trial courts to issue a show-cause notice to an accused before summoning them to face trial. Clarifying that it had not expressed any opinion on the merits of the ED's complaint, the bench directed executive Kushal Kumar Agarwal to appear before the trial court on July 14, "so that he can be given an opportunity of being heard in terms of the proviso to sub-section (1) of Section 223 of the BNSS." The order also stated, "We make it clear that no further notice shall be issued by the Special (trial) Court to the appellant (Agarwal)." Section 223 of the BNSS applies specifically to "complaints" and not to cases investigated by the police or the CBI. Advocate Vijay Aggarwal, representing the petitioners, argued that under Section 223, accused persons are entitled to be heard before being summoned by the trial court. He emphasized that this section stipulates that "no cognisance of an offence shall be taken by the magistrate without giving the accused an opportunity of being heard." In response, ED's counsel argued that under the new BNSS provision, the hearing granted to the accused is limited to determining whether a case is made out to proceed based solely on the complaint and its accompanying documents. The ED further contended that cognisance is taken of the offence-not the offender. Thus, once cognisance is taken, it need not be taken again when supplementary or further complaints are filed. "Therefore, at that stage, there will be no occasion to give the accused the opportunity to be heard," the ED's counsel argued. Addressing these arguments, the Supreme Court stated in its order that the ED's submissions "need not be considered, as the same do not arise in this appeal at this stage." However, it added, "We make it clear that the said contentions are expressly kept open and can be raised before the Special Court."

The 29-year-old man was arrested on Saturday based on a complaint by the children's mother, they said. In her complaint, the mother alleged that her children were beaten up and sexually assaulted by the caretaker of the school, the police said. Following this, a case was registered against the accused under sections of the BNS and Protection of Children from Sexual Offences (POCSO) Act, they said. Taking immediate action, the police sent the children for medical examination and informed the Child Welfare Committee about the case, they said. Punjab teacher booked for sodomising student

A national awardee teacher has been booked for allegedly sodomising his student in Nabha. The physical education teacher, posted in a government school in a village near Nabha of Patiala district, is absconding, police said. According to the FIR that has been registered under Section 6 of the Protection of Children from Sexual Offences Act (POCSO) Act and 351 (2) of the Bharatiya Nyaya Sanhita (BNS), the victim, a 15-year-old player, stays in the school hostel. He reached school for biometric attendance in the evening on May 28 when the accused took him to his house and committed the crime, officials said. The police said raids were being conducted to nab the accused. Repeated attempts to contact the teacher went futile. According to information, the accused was conferred the National Award in 2018 for his efforts to transform the government schools of Punjab without any financial aid or government intervention. He was also felicitated by Prime Minister Narendra Modi.
