
M&S ad banned by ASA, but ASOS ad complaint not upheld
Upholding a complaint, the Advertising Standards Authority (ASA) ruled the model 'appeared unhealthily thin', concluding that the ad was 'irresponsible.'
It said: 'The pose of the model and the choice of clothing meant the ad gave the impression that the model was unhealthily thin'.
It therefore violated the CAP code, which states'marketing communications must be prepared with a sense of responsibility to consumers and to society.'
The ASA received four complaints about various M&S images but upheld only one and banned its use in the retail giant's app.
M&S said its inclusive womenswear clothing represented a full spectrum of sizes, ranging from eight to 24, adding that it took concerns about the depiction of body image in its ads 'very seriously'.
It has since amended the ads and removed the specific images.
In a separate complaint about the use of another 'unhealthy model' in an ad, the ASA has cleared online fashion giant ASOS of any wrong-doing.
An in-app ad for a dress, seen on 1 April and featuring a model wearing a dress with spaghetti straps and a low V-shaped neckline, received complaints that the image of the model was deemed 'unhealthily thin' and challenging whether the ad was irresponsible.
But under the CAP Code (Edition 12) rule 1.3 (Responsible advertising), the ASA did not find the image was in breach of the rules.
ASOS said it 'recognised [its] responsibility to both consumers and society and did not consider the ad to be irresponsible or in breach of the CAP Code'.
It said all models booked by ASOS 'were measured according to specific industry standard guidelines during casting. [We] collaborate with reputable model agencies worldwide to ensure that all models were healthy and regularly reviewed a model's measurements to maintain those standards'.

Burberry tops list of UK M&A targets in new Bloomberg survey
British companies, including Burberry Group Plc, dominate the ranks of European-listed firms seen as potential takeover targets, with discounted UK equity valuations making them increasingly attractive to buyers. London-listed stocks account for about 60% of companies mentioned in an informal survey conducted by Bloomberg News in July. The poll included 44 risk-arbitrage desks, traders, and analysts. Burberry, the iconic trench coat maker, was the most frequently cited company, selected seven times. UK stocks have remained favored M&A targets over the past year, partly due to their relative undervaluation compared to international peers. This has led to a series of delistings that have further reduced the size of the local stock market. London's FTSE 100 Index trades about 13% below the Euro Stoxx 50 Index and 41% below the S&P 500, based on valuation relative to earnings forecasts. In Burberry's case, there are signs that the brand is beginning to deliver on its turnaround plan under Chief Executive Officer Joshua Schulman. After back-to-back annual declines of 30%, the stock has risen 32% in 2025. According to Emmanuel Valavanis, an equity sales specialist at Forte Securities in London, Burberry's brand equity could be attractive to a larger luxury group 'not afraid to pay up for bolt-on growth and an iconic label.' However, the transformation is not yet complete. 'Burberry's renewal effort still needs more work,' said Graham Simpson of Canaccord Genuity Quest, adding that a potential suitor would likely focus on extracting synergies. BP Plc and Anglo American Plc also featured among the leading UK takeover candidates, consistent with their inclusion in a similar January survey. Rightmove Plc, the online property portal, received four mentions after drawing multiple bids last year from Rupert Murdoch's REA Group. UK dealmaking 'roared back' in the second quarter, said Patrick Sarch, head of UK public M&A at law firm White & Case LLP, in July. 'We anticipate more bids for UK companies from US and corporate bidders, and that the financial services, infrastructure, natural resources, and tech sectors will continue to be active,' Sarch added. Outside the UK, the recent trade agreement between the European Union and the United States is expected to 'encourage corporates to go ahead with planned transactions,' according to Eric Meyer, head of RBC Capital Markets in Paris. Among continental names, Carrefour SA was a frequently mentioned target, cited four times by respondents. The supermarket chain is currently reviewing its portfolio to improve its valuation and recently divested its struggling Italian business. European banking M&A also remains active, continuing a trend from 2024. Commerzbank AG was again a popular name in the latest survey. UniCredit SpA, which has expressed interest in acquiring Commerzbank, increased its stake to about 20% this month. The move makes UniCredit the bank's largest shareholder, overtaking the German government, which remains opposed to a takeover. 'Bank deals are becoming more complicated,' said Nicolas Marmurek, co-head of special situations at Square Global Markets. 'Successful bidders will need strategy, timing, and just the right dose of political finesse.'

Next powers ahead as UK and international ops boom in heatwave
UK fashion retail giant Next issued a Q2 trading update on Thursday and showed that its seemingly unstoppable progress is continuing. In the 13 weeks to 26 July, Next full-price sales rose 10.5% year on year. As usual, it also showed that earlier guidance was excessively cautious, the firm having predicted 6.5% growth with expectations of sales £49 million lower than it actually achieved. For Next 'full-price sales' include items sold in its Retail division (that is its stores) and Online, plus Next Finance interest income. They exclude Sale events, Clearance, Total Platform commission and sales from subsidiaries. On this basis, it said sales 'over-performed in both the UK and overseas'. But this wasn't just down to its own efforts. The company cited better than expected weather and trading disruption at a major competitor' for the UK success. That major rival was clearly M&S, which suffered huge disruption following the cyberattack that crippled its webstore. Overseas, the International division prospered as its 'digital marketing proved more effective than anticipated, enabling us to increase profitable marketing expenditure'. Looking at the performance in more detail, UK Online sales for the Next brand increased 9% in the second quarter and 6.8% in the first half overall. UK Online sales for its Label operation rose 10.1% in Q2 and 12.6% in H1. The combination of these two meant that overall Online Q2 sales were up 9.5% and H1 sales were up 9.2%. UK Retail sales rose 5.6% in Q2 and 5.4% in H1, showing that its physical stores continued to attract footfall and bringing total UK sales when Online is added in to a 7.8% Q2 rise and a 7.6% H1 increase. Online International sales rose 26.4% in the quarter and 28.1% in the half with total full-price product sales across the UK and abroad rising 11.1% in Q2 and 11.6% in H1. It all means the firm is increasing its guidance for full-price sales in the second half from 3.5% to 4.5%. This adds a further £27 million of full-price sales to its forecast. The increase in sales in Q2, along with that improved guidance for H2, also means it's increasing full-year guidance for profit before tax by £25 million to £1.105 billion. But it expects UK sales including Online and Retail to rise only 1.9% in the second half while International online sales should increase 19.4% (for a full-year total of 23.8%). That means total product sales during the second half should be up 4.8% and will be up 8% for the full year. The extreme caution as far as UK sales are concerned is due to the effects of earlier National Insurance contribution changes continuing to filter through into the economy and denting consumer spending. It's also down to strong comparative numbers in the second half of 2024. And of course, that unexpected boost from the UK heatwave and from the problems at M&S won't impact the second half. Internationally though, it had been originally expecting a second half rise of 13.1% so the latest guidance for a 19.4% jump is a significant change. That's because it believes it can invest more in profitable digital marking than it had originally planned.

ASOS names new chair, adds deputy chair role
ASOS announced some important boardroom changes on Thursday with the appointment of Natasja Laheij as chair with effect from its FY25 year-end results and the appointment of William Barker as deputy chair, effective immediately. The deputy chair post is a new one and is 'designed to support the chair and the management committee on strategy, culture and operational initiatives as required'. It comes as chair Jørgen Lindemann, who joined the ASOS board in November 2021 and has served as chair since August 2022, has decided to step down. Lindemann is also CEO of Viaplay Group and will leave 'following an orderly handover period' at the end of his current term. Laheij joined the ASOS board in April 2023 as an independent non-executive director and was appointed as senior independent director in February 2024. The company said she has 30 years of experience in international commercial and financial management across a range of sectors, including e-commerce and technology, in B2C and B2B environments through roles including CFO of Amazon Fashion Europe. Barker joined the board in September 2023 as a non-exec. He's founder and CEO of Camelot Capital Partners, a California-based investment company, and 'has experience founding, building, and turning around digitally-enabled businesses'. He focuses on 'building cultures and operations that scale long-term competitive advantage, whilst driving high-quality capital allocation'. He continues to waive his board fees in full for this appointment. CEO José Antonio Ramos Calamonte said: 'I would like to extend my deepest thanks to Jørgen, whose support has been invaluable to ASOS throughout his tenure on the board. I look forward to working closely with Natasja given her extensive governance experience, and with William given his knowledge of ASOS and operational expertise as we continue to execute our strategy.'
