Lawyer Syed Amir Syakib Arsalan Syed Ibrahim wants the JAC to suspend its activities until the conclusion of his main suit.
KUALA LUMPUR : A lawyer has filed an application to compel the Judicial Appointments Commission to suspend its activities of recommending judges for elevation and to hold administrative positions pending the outcome of a legal suit.
However, Syed Amir Syakib Arsalan Syed Ibrahim said in his application filed in the High Court here today the prime minister may advise the Yang di-Pertuan Agong on judicial appointments without being bound or subject to the recommendations of the JAC.
Syed Amir, who is challenging the constitutionality of the JAC Act 2009, said the prime minister could perform that function under Article 122B of the Federal Constitution.
Article 122B states that judges and administrative position holders shall be appointed by the Yang di-Pertuan Agong acting on the prime minister's advice, after consultation with the Conference of Rulers.
He said he did not intend to suspend or paralyse judicial appointments, or obstruct the exercise of constitutional functions by the prime minister or the king.
'Rather, this application is only intended to prevent any further reliance or implementation of the challenged legal framework pending the final decision of the court,' he said.
Syed Amir told FMT that unsealed copies of the stay application have been served on the defendants – the government and the JAC, and the Bar Council, which is allowed to come in as an intervener.
In his main suit filed last month, Syed Amir contends that the powers conferred on the nine-member JAC violate the doctrine of separation of powers and the basic structure of the constitution.
He is seeking a mandamus order compelling the prime minister and the government to strictly adhere to the judicial appointment process prescribed under Article 122B of the constitution.
He claims the JAC Act is inconsistent with Article 4, which states that the written constitution is the supreme law of the land.
Under the JAC Act, the commission proposes the nomination of judges to the High Court, the Court of Appeal, and the Federal Court.
It also recommends nominees for the posts of chief justice, Court of Appeal president, chief judge of Malaya, and chief judge of Sabah and Sarawak as and when they fall vacant.
Justice Amarjeet Singh has fixed July 16 to hear the main suit.

Sagah is also the minister responsible for the state-level celebration. 'We want the people, especially youths, to better understand the history and importance of the Yang di-Pertuan Agong's institution as the symbol for national unity and justice,' said Sagah after chairing the main committee meeting of the Official Birthday Celebration in Sarawak. Apart from the royal exhibition, various religious, cultural and entertainment events will also be held from June 11 to 14, including a multi-religious thanksgiving ceremony, a concert by local artists, and a tea ceremony with Sarawak Governor Tun Dr Wan Junaidi Tuanku Jaafar and Sarawak Premier Tan Sri Abang Johari Openg. Sagah added that in order to enliven the event, the celebration also targeted the presence of visitors from the Federal Territory of Labuan and Sabah as well as neighbouring countries Brunei and Indonesia. To facilitate this, the organisers have requested an extension of the operating hours of the border gate with Brunei until midnight. 'We are targeting 10,000 people throughout this celebration. 'This festival is not only a national event but also a platform to foster unity and identity among people of various races,' he said. The Limbang Division Resident's Office will also organise various side activities, such as Limbang Kitchen, to introduce local cuisine to visitors.

‘Adopt balanced approach when handling unlicensed S'gor traders'

A BALANCED approach, which upholds the law should be adopted when tackling unlicensed hawkers in Selangor. Sungai Buloh Umno legal and electoral bureau head Adzly Ab Manas said the state government and local authorities should also promote social inclusiveness. He said enforcement actions were insufficient to deal with the issue, which was increasingly complex and challenging. 'The challenge is not solely about legality or city planning. It is also deeply associated with aspects such as economic survival, bureaucratic obstacles and the public's right to livelihood. 'Proactive reforms and empathetic engagement with micro-entrepreneurs must be the standard when dealing with this issue,' he said. He also said while the Local Government Act 1976 (Act 171), Food Act 1983 and other local council by-laws required hawkers to obtain licences and follow specific health and safety regulations, many were forced to operate informally due to various problems. 'These problems include lengthy and rigid licensing procedures, delayed site approvals, lack of designated trading spaces in high-demand urban areas, financial constraints among B40 traders and poor legal awareness, especially among the elderly and foreign-born citizens,' he said. He urged the authorities to introduce temporary or daily trade passes and 'mobile licences' for new or low-income hawkers. 'Controlled trading zones should also be declared under Section 101 of Act 171 to avoid blanket prohibitions and allow managed and rotational hawking. 'The authorities should also shift from punitive actions to advisory and corrective methods, including the introduction of a 'Hawker Verification Programme' for legal transition support. 'Centres for legal briefings, fast-track licensing and free legal clinics in collaboration with non-governmental organisations and the Bar Council should also be established.' He said unlicensed hawkers must be seen not as criminals, but as essential contributors to the urban micro-economy. 'Under Articles 5 and 8 of the Federal Constitution, every citizen has the right to livelihood and equal treatment under the law. 'A fair law does not criminalise poverty, but creates paths for legal participation. 'The Selangor government and local authorities in the state must lead with compassion and initiate legal reforms on this matter. 'We must ensure that every hawker, regardless of capital or background, has the right to trade with dignity and legality.' Adzly said he was ready to work with all stakeholders, to create policy solutions that honour both the law and the people.

KUALA LUMPUR: Prime Minister Datuk Seri Anwar Ibrahim has filed an application to stay trial proceedings in connection with a sexual assault suit filed against him in 2021 by former research officer, Muhammed Yusoff Rawther. Anwar's lawyer, Datuk Seri Rajasegaran Krishnan, confirmed the filing to the New Straits Times. "We filed the stay application last night. Case management will be held online this afternoon, during which a hearing date will be fixed," he said. This came after High Court judge Roz Mawar Rozain dismissed Anwar's bid to refer eight constitutional questions to the Federal Court, which included whether he possessed immunity from a civil suit filed by Yusoff. Roz Mawar had also rejected Anwar's application to stay trial proceedings in the sexual assault suit, which she will preside over beginning June 16. The suit was filed before Anwar's appointment as prime minister on Nov 24, 2022. One of the main grounds in Anwar's stay application was that the High Court decision relied on two cases which had already been overruled by the Federal Court. It also said the judge erred in law by relying on overruled and discredited Federal Court precedents, resulting in a decision that lacks legal foundation and breaches the principle of constitutional fidelity. Rajasegaran had said a notice of appeal against Roz Mawar's entire decision had been filed on Wednesday. Roz Mawar, in her decision, ruled that Anwar's referral application on the eight constitutional questions was speculative and did not meet the requirements under Section 84 of the Courts of Judicature Act. Anwar had sought the apex court to rule whether Articles 5,8,39,40 and 43 of the Federal Constitution grant him qualified immunity from Yusoff's suit. Anwar had asked the court to decide whether Yusoff's suit would impair the effective discharge of his executive duties and undermine the constitutional separation of powers. He had also requested the court to consider whether the lawsuit impacts his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the Constitution.
