
Exceptionalism versus state credibility
The literally en mass convictions (related to the May 9, 2023 protests) on account of terrorism and the resultant disqualifications of several PTI stalwarts including Omar Ayub, Shibli Faraz, Senator Ejaz Chaudhry, MNA Muhammad Ahmad Chattha and Punjab Assembly opposition leader Ahmad Khan Bhachar by the Election Commission of Pakistan (ECP) exemplify a new brand of exceptionalism.
Exceptionalism is a term often associated with the policies of the United States and its European allies in defending their interests, regardless of logic or morality. However, Pakistan has also been experiencing exceptionalism of a different kind in recent years.
The ongoing terrorism in Balochistan and Khyber-Pakhtunkhwa provinces, the state's narrative against violence and the disqualification of PTI MPs suggest exceptional approaches. Are these routine occurrences or consequences of Pakistan's exceptionalism in recent years?
Ayub, Faraz, Chaudhry, Chattha and Bhachar were sentenced to 10 years in prison each under anti-terrorism charges related to the May 9 protests and riots. Their convictions were not surprising.
Similarly, an opposition MP in the Punjab Assembly, Rana Shahbaz Ahmad, recently questioned the institution of multiple cases against him under the Anti-Terrorism Act. While holding the Holy Quran, he asked other MPs if he looked like a terrorist.
This context fits the term exceptionalism, which denotes selective application of laws, subversion of regulations for expedience and socio-political discrimination in favour of certain groups.
This approach distorts governance, stunts the rule of law and raises questions about the conduct of state institutions, which often claim to uphold the rule of law and justice for all but engage in actions that contradict their exhortations to the public.
Exceptionalism undermines the state's integrity and authority by discrediting narratives against non-state actors. While certain segments face state-sponsored wrath and attacks on rights, the official advocacy for justice, equality and expectation of loyalty to the state loses credibility.
Rhetoric on the rule of law becomes meaningless when protectors of state lands ally with lawbreakers and land grabbers. Citizens doubt the rule of law when state institutions turn a blind eye to political, non-political or religious groups intruding on public spaces, occupying green areas and disregarding laws. When religio-political groups are seen as tools for power politics, the state loses credibility. Can the rule of law thrive without action against anti-state elements?
If the status quo persists and short-sighted policies continue, threats from within will also persist. State institutions use parties and individuals as socio-political crutches, disregarding the fact that most hosts (mosque/madrassas) and their guests (often militants/insurgents of different shades) are actually ideological partners. Many mosques and madrassas run by factions of mainstream parties serve as conduits and shelters for proxy terrorists but state institutions can't dare check them out.
Such duplicity and inaction — a kind of exceptionalism vis a vis certain groups — also drain investors' confidence and casts doubt on the intent against terrorist groups. Even China's strategic patience in economic engagement can wear thin if Pakistani leaders continued the path of ambiguity as far as order and justice is concerned.
Certainty of punishment is the primary reason for lower crime rates in countries like China, Iran, Central Asian Republics and Middle Eastern countries. Quick institutional responses and certainty of punishment deter such crimes.
Until state institutions showcase exemplary case settlement through efficient policing, quick prosecution and a justice-focused judiciary, law-breaking will increase without fear of punishment. Until the state demonstrates indiscriminate justice to all law-breakers, crime will thrive, damaging the integrity of the rule of law narratives.
Narrative is abstract, but its outcomes - indiscriminate due process of justice — are not. When people see the state's top brass indulge in expedient actions that run contrary to the notion of rule of law, they stop trusting the state.
Compassion, favouritism and expedience subvert law and weaken public belief in it. Common people will believe only when justice is served to victims, and violators are punished. A people-centric rights-based advocacy campaign should accompany strict punishment. Indiscriminate commitment to and execution of the rule of law facilitates state narratives on rights and justice. Exceptionalism undermines state narratives against subversive groups or non-state actors. The civil and military leadership may peddle the anti-terrorism notions or scream day and night about their commitment to the rule of law, yet not many would accord any credence as long as people at large view that rhetoric being at variance with actions on ground.
The most current example of exceptionalism's bitter outcomes is the genocide of the Palestinians at the hands of Israelis who are willfully starving tens of thousands of besieged, helpless Gazans, including women and children. Few people across the globe trust the sympathetic statements that ring out of major capitals because people at large view them as Israel-abettors.
Similarly, exceptionalism is accruing huge credibility costs to the Pakistani society too. The sooner this approach ends the better it may be for the integrity and credibility of the state institutions. The latest round of convictions will only further erode the state credibility and deepen the wedge between the people and the state.

PTI calls protest start of struggle for justice
The civil administration in Rawalpindi on Monday imposed Section 144 across the district from August 4 to August 10 ahead of the PTI's protest scheduled for today, August 5. According to a notification issued by Rawalpindi Deputy Commissioner Hassan Waqar Cheema, public gatherings and political rallies are banned in the garrison city, whose Adiala Jail is the place where the PTI founder Imran Khan has been detained for around 2 years. Under Section 144, pillion riding on motorcycles and display of weapons are prohibited while loudspeakers cannot be used during this period. To prevent any law and order situation near Adiala Jail, a red alert has been issued and Adiala Road will be completely sealed with containers. According to the official notification, the Punjab Rangers will be deployed around the jail and the rangers will conduct joint patrols with Rawalpindi Police. Anti-riot police equipped with tear gas and batons will also be stationed at all barricades. Traffic from Kacheri to Adiala Jail and from the Chakri Motorway Interchange will be diverted to alternate routes. Legal action will be taken against anyone attempting to remove official blockades. Meanwhile, ahead of the planned protests, senior PTI leader and former National Assembly speaker Asad Qaiser issued a video message stating that on August 5, there will be protests all across the country "This is not just a protest, but the beginning of a movement. Two years ago, on this very day, the fascist government unjustly arrested Imran Khan, and for the last two years, he has remained imprisoned without due cause. "We demand justice and merit-based decisions from the judiciary. Unfortunately, after the 26th Constitutional Amendment, the judiciary has practically become subordinate to the government. It is saddening to see the public's trust in the courts diminishing day by day," he added. The PTI leader asked as to what has come out of the numerous operations conducted in merged districts of Khyber Pakhtunkhwa which were earlier part of the Federally Administered Tribal Areas (Fata). "These operations have neither brought peace nor ended unrest. Let it be clearwe will not allow any military operation on our soil. We want peace on our land. "Our demand is simple and clear: justice for Imran Khan. When justice is denied, the principle of 'might is right' prevails. A system of disbelief can survive, but a system based on oppression cannot," he added. According to Qaiser, the country is heading further into tyranny and the current rulers are sitting on power through force. He said people do not want violence, explosions, or extortion but peace, jobs, and education for our children. "The movement starting today is not just PTI's battleit is the struggle of the entire nation, for the rule of law, justice, merit, and equal rights for all citizens," he said. Afghan FM visit postponed at last minute
The long-awaited visit of Afghan Interim Foreign Minister Amir Khan Muttaqi to Islamabad was postponed at the last minute due to what officials cited as a "technical issue". Muttaqi was scheduled to begin a crucial three-day trip to Islamabad from August 4, as part of renewed efforts by both sides to reset their troubled relationship. Preparations had been finalised and all of the Afghan foreign minister's engagements confirmed. However, before Islamabad and Kabul could formally announce the visit on Sunday, a "technical issue" forced a delay. While officials did not elaborate on the nature of the issue, it is believed to be related to the UNSC-imposed travel ban on Taliban leaders. The two sides are expected to work together to sort out the technical hitch, with the visit likely to take place sooner rather than later. Muttaqi's visit had been long overdue, as both countries have been working to de-escalate tensions. Foreign Minister Ishaq Dar has travelled to Kabul twice since April in a renewed diplomatic push to resolve the issues bedevilling bilateral ties. The high-level exchanges yielded some progress, particularly on concerns regarding the presence of the banned Tehreek-e-Taliban Pakistan (TTP) and other anti-Pakistan groups. According to officials, the Taliban administration has taken certain steps, including discouraging Afghan nationals from joining the ranks of the TTP. In another sign of improving ties, Pakistan and Afghanistan also agreed to upgrade their diplomatic relations to the level of ambassadorial appointments. Sources confirmed that Muttaqi remains keen to visit Pakistan and will do so as soon as the issue is resolved. This would mark his first visit to Islamabad since May 2023, when he attended a trilateral meeting involving the foreign ministers of Pakistan, Afghanistan and China. According to sources, Beijing has also played a key role in bringing Islamabad and Kabul closer. Pakistan had long been urging the Taliban-led government in Kabul to tackle threats posed by banned groups such as the TTP. While Kabul has publicly denied the presence of such groups, it has privately cited an inability to take action against them. Nonetheless, Pakistan has succeeded in persuading the Afghan regime to take some concrete steps, including crackdowns on Afghan nationals involved with the TTP. The Afghan authorities have also taken action against those facilitating others to join the group. The measures have helped ease tensions between the two neighbours. Officials said Pakistan would continue to encourage the Taliban government to pursue similar actions. In return, Pakistan and China are prepared to support Kabul both economically and diplomatically.

Imran's fate hinges on high courts
Though ex-prime minister Imran Khan has been convicted in five cases since August 5, 2023, none of his convictions has so far been endorsed by any high court. Likewise, serious questions are being raised on the fairness and non-adherence to due process during his trials. Imran Khan's legal team is consistently alleging that due process and the requirements of fairness enshrined in Article 10-A of the Constitution have not been adhered to during his trials. Though the PTI leadership has been unable to evolve any effective strategy for the release of Imran Khan during the last two years, the non-adherence to due process during his trials has raised serious doubts among the masses, which is also giving political advantages to his party. Despite the absence of a joint symbol and the non-availability of a level playing field, the February 8 general election results were shocking for other major political parties. Until Imran is considered a political victim, his opponents cannot defeat him in a free and fair election, says a senior lawyer. He said that the two major political parties, the PML-N and the PPP, should have realized that if they want to defeat Imran on the political ground, then the victim card should have been taken away. First, Imran Khan was convicted in the Toshakhana case on August 5, 2023. The trial court, presided over by Additional Sessions Judge (ASJ) Humayun Dilawar, had given a three-year sentence. However, some lawyers believe that there were serious defects in the judgment. They questioned why the trial court was in such a hurry to decide the case without recording statements of the witnesses whom Imran Khan wanted to present in his defence. Even the trial court did not wait for his counsel, Khawaja Haris, to give his final arguments. Faisal Siddiqi, while commenting on the judgment on August 5, had expressed grave concern over the trial court's decision, viewing it as a symbolic destruction of political justice in the country. Siddiqi also asserted that the judgment was "a result of revenge politics on the part of the PDM government and political manipulation by the deep state." He not only called for the judgment to be overturned but also urged the superior judiciary to investigate the author judge for tarnishing the entire judicial system's reputation. Soon after the announcement of the decision, Imran Khan was arrested in Lahore. After a couple of weeks, the Islamabad High Court led by then Chief Justice Aamer Farooq suspended the trial court decision. The main appeal in this case is still pending in the IHC. Later, Imran was convicted in three cases wherein trials were conducted in Adiala Jail. These convictions were awarded before the general election of February 8, 2024. There are serious allegations of manipulation of trials in those matters. Interestingly, Imran's conviction in the Cypher case has been set aside by a division bench of the IHC led by Justice Aamer Farooq. Likewise, in a second matter, the appellate court also quashed Imran and his wife Bushra Bibi's convictions in the Iddat case. The IHC suspended their convictions in the Toshakhana case. The final appeal is still pending in this matter before the IHC. Meanwhile, the trial court conducted the jail trial of Imran and his wife in the 190 million pounds case. Though the judge fulfilled all procedural requirements during the trial in the 190 million pounds case, questions are being raised on the maintainability of the case after the NAB law amendments. Likewise, the judge postponed the date for the announcement of judgment three times. Despite the passage of more than five months, the IHC is yet to decide Imran and Bushra's petitions seeking suspension of the judgment in the 190 million pounds case. Imran's legal team is consistently filing early hearing applications, but the high court is yet to decide the case. Now, two trials of Imran Khan are continuing in Adiala Jail. One is related to Toshakhana and the other to the May 9 rioting. Recently, the Lahore High Court (LHC) rejected the post-arrest bail of Imran Khan in the May 9 cases. Subsequently, the legal team has approached the apex court against the LHC order. The matter is listed for hearing in the SC on August 12. Post-26th Amendment, as well as the transfer of judges to the IHC, Imran Khan is struggling to get relief in the superior courts. Though the IHC passed an order conditionally allowing meetings with Imran Khan in Adiala Jail, the decision has not been implemented by jail authorities. At present the government is in a strong position and Imran Khan is still receiving massive support, the only loser is the justice system, which has so far failed to adhere to due process and the requirements of fairness enshrined in Article 10-A of the Constitution during the last two years. Recently, Supreme Court judge Syed Mansoor Ali Shah issued an additional note in the ex-PM Zulfiqar Ali Bhutto presidential reference case. He said judges must uphold their oaths with courage in the face of oppression, for only then can the judiciary truly safeguard democracy and the rights of the people. "Let the lesson of transitional justice be clear transitional justice, however, often becomes necessary because, during oppressive rule, some judges fail to uphold their constitutional duty, succumbing to the pressure of illegitimate authority. "This failure not only enables violations of due process and fair trial rights but also erodes public trust in the judiciary," wrote Justice Shah. He said the Bhutto case serves as a classic example of a political trial, illustrating how such trials can be manipulated to advance authoritarian designs. Likewise, present CJP Yahya Afridi in a similar case said that the extraordinary political climate of the time and the pressures inherent in such an environment appear to have influenced the course of justice in a manner inconsistent with the ideals of judicial independence.
