Irish Nationwide Building Society (INBS) was providing millions of euro in commercial loans and top-ups to clients before its board could approve them, including one to a commercial client who already had an exposure of a quarter of a billion euro at the time of their granted loan for developing luxury holiday residences in France, the High Court has heard.
The civil case against former INBS chief Michael Fingleton is in its second day before the High Court, where it has been alleged that he negligently mismanaged the building society and engaged in property 'gambles' with high net-worth individuals in an informal and speculative manner.
Mr Fingleton (87), who is in ill health after a stroke, ran the building lender from 1971 to 2009, as managing director and chief executive. At its height in 2007, INBS had reported assets of €16 billion but was a high-profile casualty of the financial crisis of 2008.
Liquidators for IBRC have taken the case against Mr Fingleton, who denies the allegation of negligent mismanagement.

The losses, relating to property loans, had been estimated by the Irish Bank Resolution Corporation (IBRC) at €6 billion. However, only €250 million in damages is now being pursued by IBRC relating to five loans made by INBS, allegedly approved by Mr Fingleton, who the court was told was also 'nodding through' top ups and extensions to certain clients.
At the High Court on Wednesday, Lyndon MacCann SC, for IBRC, said the building society operated 'flawed policies', which were then ignored by the lender and made worse by what he called 'flawed practices'.
Mr MacCann said an expert witness for IBRC will give evidence to the court that the level of 'delegation of power' given to Mr Fingleton 'was hideously flawed'.
Counsel said that in one instance a borrower was approved a loan of €28 million by Mr Fingleton months before it came before either the board or the credit panel of INBS in January 2009.
The loan was for the purchase of two run-down hotels in the French alps despite them not having planning permission for proposed a luxury residence development and that the actual application for the loan came before the board after it was already approved.
The court heard that Mr Fingleton 'nodded' through loans, top-ups and loan extensions by phone or by 'scribbling' a note on memos that reached him, as he did not have a computer or email.
Mr MacCann said the France loan, referenced 'Ice Mountain', was allegedly approved by Mr Fingleton despite the borrower's company and his daughter already having a combined exposure of 'a third of a billion euro' to INBS and that the company was 'coming in at number seven in a Top of the Pops' – at €260 million – of those lenders with the most exposure to the bank.
The court also heard that a different loan for £71 million was 'topped up' by a further £10 million to £81 million, with only Fingleton's approval being any record for the expanded loan.
In the case of a separate loan valued at €130 million in 2009, after Mr Fingleton had retired, INBS asked the borrower to repay the outlay. However, the borrower told INBS that the loan had been granted on a 'non-recourse basis' which was disputed by the society.
The court was told that the borrower provided INBS with a letter from Mr Fingleton allegedly confirming the non-recourse status of the loan but INBS took legal advice which stated that the loans were of full recourse and that the borrower could indeed be pursued for the money, said counsel.
Mr MacCann described the letter stating the loans were non-recourse was an 'extraordinary document' for Mr Fingleton to write and that a handwriting expert will feature in the case.
In opening the case yesterday, Mr MacCann said Mr Fingelton 'gambled' with the society's money when he allegedly approved 'speculative, risky' commercial loans, which sometimes had already been greenlit by him before they were taken before the board of directors, on which he also sat.
The return on the loans and interest from INBS was that if the properties could get planning permission, they were to be 'flipped' for a profit, making it a 'joint-venture' for INBS in profit agreements.
The five loans 'approved' by Mr Fingleton relate to property land development projects between 2006 and 2008 despite them having no zoning or planning permission, counsel said.
It is further alleged that there was no securities in place on the loans and no personal guarantee sought for or provided by the borrowers.
Mr Fingleton was a prominent presence in Irish business during the Celtic Tiger and was reported to have been worth around €75 million in 2006. However, his son has told the courts that his father is reduced to €25,000 in two personal bank accounts and has outstanding judgment debts of more than €10.7 million.
The case continues at the High Court.

Airport chiefs have been urged to give a security worker his old job as a supervisor back after he was demoted for kissing a subordinate while they were at work together on a screening line two summers ago. The decision to demote the worker from airport search supervisor to a junior position on the airport search unit was 'excessive', a Workplace Relations Commission (WRC) adjudicator decided in a non-binding recommendation under the Industrial Relations Act 1969. The tribunal heard the supervisor had more than five years' service on the airport search unit, screening passengers and baggage, with two years as supervisor, when he was placed under investigation in September 2023 and suspended. The employer said it considered the complainant to have committed gross misconduct by 'kissing a colleague during active operational duties' on the two days before his suspension. READ MORE The other worker, a more junior airport search unit officer, had been operating an x-ray machine on one occasion, and was working in a 'premium services area' under the supervisor on the other occasion. The outcome of the disciplinary process was that the complainant was demoted from his €46,000 a year supervisor post and placed on a final written warning. The decision reflected the 'safety-critical nature of the breaches, the worker's leadership responsibilities and the need to preserve the integrity of security operations', the employer submitted. The disciplinary officer's view was that the kissing 'had the potential to compromise both safety and the employer's reputation'. The demotion and warning were upheld on appeal, an internal appeals officer taking the view that the sanction was 'consistent with those issued in comparable cases', the tribunal heard. Joseph Ateb of the Siptu Workers' Rights Centre, who appeared for the worker, said his client had appealed the decision as being 'excessively harsh' and contended that his previous good record in employment was not given due consideration. The final written warning had expired by the time the WRC heard the case, leaving only the demotion as an issue, the tribunal noted. Adjudicator Breiffni O'Neill wrote that the employer's decision not to consider transferring the supervisor to another department 'calls into question the true extent of the safety concerns'. 'This inconsistency undermines the credibility of the employer's rationale and suggests a lack of proportionality,' he wrote. 'In light of the worker's unblemished prior record, his acceptance of responsibility and the employer's failure to consider a less punitive and reasonable alternative, I find that the additional sanction of demotion was excessive,' Mr O'Neill wrote. His recommendation on the dispute was that the demotion be rescinded and that the worker be reinstated as a supervisor 'with full restoration of duties and remuneration' within a week. The recommendation was published without the names of either the worker or his employer, in line with the WRC's usual practice under the Industrial Relations Act's voluntary arbitration process.

The Irish and British businesses of struggling jewellery chain Claire's has fallen into administration, putting 2,150 jobs at risk. The retailer formally appointed insolvency practitioners from Interpath Advisory on Wednesday, a week after the chain's parent group filed for bankruptcy protection in the US. Interpath had been recently tasked by the US parent company to find a buyer for the European operation but, according to reports from the UK, the company struggled to find a financial backer. One industry source said that as many as one-third of its shops might be closed under a restructuring programme. Claire's, known for selling colourful necklaces and bracelets and offering ear piercing services, has 306 stores in Ireland and Britain aimed at the teen and preteen market, and 2,150 staff. Administrators at Interpath, which had been trying to sell the business, said shops will remain open for now as they assess options for the chain, including 'exploring the possibility of a sale which would secure a future for this well-loved brand' shorn of its liabilities. Customers will no longer be able to buy goods online. The update comes after the wider Claire's group, which operates 2,750 stores in 17 countries, applied for Chapter 11 bankruptcy protection in a Delaware court. The company last week said that it was in discussions with vendors and landlords about the future of its North American stores. Claire's previously filed for bankruptcy in 2018, exiting Chapter 11 in 2022. The Illinois-based group is owned by a group of investment firms, including Elliott Management and Monarch Alternative Capital. It has also had two failed attempts at a stock market IPO. Last week, the group blamed 'increased competition, consumer spending trends and the ongoing shift away from brick-and-mortar retail' for the bankruptcy, as well as 'debt obligations'. The retailer's trading difficulties are understood to have been exacerbated by uncertainty surrounding tariffs imposed on China by the US administration, which is likely to have seen its overheads increase substantially in recent months. The parent company said it has between 25,001 and 50,000 creditors. Claire's Irish and British business is the second high-street brand to battle to maintain a presence on the high street in as many weeks. France, Germany and UK call on Iran to resume nuclear discussions with US

France , Germany and the UK have told the UN they are prepared to trigger the reimposition of sanctions on Iran unless it resumes negotiations with the US over its nuclear programme. The foreign ministers of the three countries – known collectively as the E3 – wrote to the UN on Tuesday to raise the spectre of implementing a 'snapback' mechanism unless Iran takes action. But they said they had offered to extend a deadline to start the process if Tehran returned to the negotiating table. 'We have made it clear that if Iran is not willing to reach a diplomatic solution before the end of August 2025, or does not seize the opportunity of an extension, [the E3] are prepared to trigger the snapback mechanism,' the ministers said in the letter, which was obtained by the Financial Times. The European powers have to decide whether to invoke snapback a month before crucial clauses of a 2015 nuclear deal Iran signed with the E3, the Obama administration, Russia and China, expire in October. READ MORE The accord, under which Iran agreed to strict limits on its nuclear activity in return for sanctions relief, has been in a state of collapse since US president Donald Trump unilaterally abandoned it during his first term. Iran responded by aggressively expanding its nuclear activity and was enriching uranium at levels close to weapons grade before Israel launched its 12-day war against the Islamic republic in June . Before the conflict, the Trump administration and Iran had been holding indirect talks in an effort to resolve the long-running stand-off over its nuclear programme. But Israel's attack, which was launched 48 hours before Tehran and Washington were to hold a sixth round of talks, upended the diplomatic process. The US briefly joined Israel in bombing Iran's main nuclear facilities. The E3 told Iran at talks in Turkey last month that they could extend the snapback deadline if Tehran agreed to resume talks with the US and co-operation with the International Atomic Energy Agency. One western diplomat said the talks had been 'difficult'. On Tuesday, the E3 said their offer of an extension 'remained unanswered by Iran'. The ministers said a 'limited extension' would provide more time for talks aimed at concluding a new nuclear agreement, while maintaining the ability to reimpose sanctions to prevent nuclear proliferation. He warned that Iran would exclude the European powers from future nuclear talks if they went through with the process. Mr Araghchi accused the E3 of failing to meet their commitments under the 2015 deal and said the snapback mechanism was 'not that important any more'. 'With the Europeans, there is no reason right now to negotiate because they cannot lift sanctions, they cannot do anything,' Mr Araghchi said. 'If they do snapback, that means that this is the end of the road for them.' In their letter, the E3 ministers said they were 'clearly and unambiguously' legally justified in reimposing sanctions on Iran because since 2019 – a year after Mr Trump withdrew from the nuclear accord – Tehran had 'wilfully' departed from its commitments under the deal. Tehran has said it remains open to talks with the Trump administration. But its stance hardened after Israel's assault. Mr Araghchi has said Iran wants assurances from the US that it will not be attacked during future talks, and wants 'confidence-building measures', including the US agreeing to compensate Iran for war damage. Iran announced after Israel's attack that it was suspending co-operation with the IAEA, which has had inspectors in the country. A senior IAEA official met with Iranian officials in Tehran on Monday, Iran's foreign ministry said, but the UN nuclear watchdog has not commented on the trip. The letter to UN secretary general António Guterres and the UN Security Council was signed by French foreign minister Jean-Noël Barrot, German foreign minister Johann Wadephul, and UK foreign minister David Lammy. It comes two months after the US and Israel struck nuclear sites in Iran.
