
Enoch Burke wins appeal over composition of disciplinary appeals panel
Mr Burke claimed a member of the three-person appeals panel, Association of Secondary Teachers in Ireland (ASTI) general secretary, Kieran Christie, was a 'promoter of transgenderism'. The appeals panel denied his claim.

Ms Justice Mary Faherty, on behalf of the three-judge Court of Appeal (CoA) , said with "a great deal of reluctance", she would grant an injunction to Mr Burke restraining the appeals panel, as presently constituted, from hearing the respondents from holding a hearing.
Mr Burke spent more than 500 days in prison for repeatedly disobeying High Court orders not to attend at Wilson's Hospital School in Co Westmeath where he had been employed as a history and German teacher.
He went through a disciplinary hearing after publicly clashing with school management when the then-principal Niamh McShane requested that teachers call a transgender child 'they' instead of 'he'.
He has argued transgenderism is against his Christian religious beliefs and requiring him to do so was unconstitutional and contrary to the ethos of Wilson's of which the Church of Ireland is school patron.

When he was dismissed in 2023, he sought an appeal through the normal employment process but then brought a High Court challenge claiming that appeals panel member, Mr Christie, was "an activist for transgenderism" within the ASTI and was personally or objectively biased.
In December 2023, the High Court rejected his challenge, saying Mr Burke had not discharged the burden on him of establishing that there was a fair question to be tried of a reasonable apprehension of bias.
He appealed to the CoA and the panel opposed his appeal.
On Friday, Ms Justice Faherty, for the CoA, said that while accepting Mr Christie does not sit on the appeals panel in his capacity as General Secretary of the ASTI, it must nevertheless be the case that Mr Christie's role in the ASTI, which has advised schools to use a transitioning student's preferred choice of pronoun, would be influential to the reasonable independent observer.

In those circumstances, she could not agree with the High Court judge that there was not a fair question to be tried in relation to any issue on which it was claimed the ASTI had taken a position.
She rejected Mr Burke's suggestion that if his objection to Mr Christie was well-founded, the objection must similarly be well-founded in relation to any other person nominated by the ASTI.
The judge said there remained the question as to whether Mr Burke, with his history of contempt of court "gets to pick and choose how and when he gets to invoke the court's protection and jurisdiction'.
Mr Burke, apart from spending more than 500 days in prison over several periods, was also the subject of daily €700 and later €1,400 fines for every time he turned up at the school.

Recently, the High Court made orders permitting the seizure of money to pay the fines from the bank account into which his school salary continued to be paid pending the CoA decision.
Ms Justice Faherty said she considered his contempt no less egregious now than when he was before the High Court challenging the appeals panel.
However, the distinguishing feature of the present case was the spectre of unfairness that will hover over the disciplinary appeal process if he has to face that body as presently constituted, given that he has made out a case of a reasonable apprehension of objective bias, she said.
While it was normal for the loser in a case to pay the winner's costs, the court was "not in normal territory" here. The judge said there would be no costs order in Mr Burke's favour save an order setting aside the costs order made against him in the High Court.

New cars sold in Britain will follow European laws and be fitted with black box-style recorders and new equipment that enables breathalyser installations, amid claims the move is a political ploy by Labour to reset its post-Brexit relationship with the EU. Sir Keir Starmer 's Government argues that differences in car manufacturing between Britain and Europe will lead to higher costs being passed on to the customer. But critics argue such a move shows a desire by Labour to closely align Britain to rules and regulations implemented by Brussels. Labour previously agreed the UK would align with EU plant and animal health rules as part of concessions to form a closer relationship with the bloc. Now Lord Hendy, Minister of State for the Department for Transport, stated earlier this week in parliament that the government 'takes an explicit presumption in favour of alignment' in regards to how cars are manufactured. He added that the Government would be 'considering options for requiring the fitment of the safety technologies mandated by the EU's general safety regulation' and would discuss these with individual manufacturers, the Society of Motor Manufacturers and Traders, and the National Franchise Dealers Association. Under the regulation, all new models must have equipment in place to facilitate a breathalyser installation. These are likely to only be fitted to vehicles used by motorists with a record of driving driving. Event Data Recorders (EDRs), which can provide information on how fast a car was travelling before an accident, and Driver Drowsiness Warning (DDAW), which can alert a driver if they are becoming sleepy, are also required to be fitted into new vehicles. Northern Ireland follows GSR2 rules as part of the Brexit deal to prevent a hard border with the Republic of Ireland. But differences between new cars made under EU and UK rules could mean customers in Northern Ireland would face higher costs for purchasing a new vehicle from the mainland. Labour is understood to back an 'alignment' of the EU and UK safety laws to stop Northern Irish consumers being treated unfavourably. Car manufacturers are also said to see the advantage of aligning the rules. Mike Hawes, chief executive of the Society of Motor Manufacturers and Traders told The Telegraph : 'With the heavily integrated nature of the UK and European automotive sectors, regulatory alignment supports efficient production, keeping costs down for consumers while retaining the widest possible model choice.' On the back of this evidence, the RAC is pushing for the Government to take up this method - already in use in other countries including Australia, Belgium and parts of the US - in a bid to reduce drink-driving. 'It's also very apparent that many of the drink-drivers caught by the police are reoffenders which implies something different needs to be done to change this dangerous behaviour.' Alcolocks – what are they? Could they become standard? Not everyone will have heard of alcolocks or alcohol-interlocks as they're properly known. Alcolock is actually a brand name – founded in the 70s – but has become the common name for breathalysers fitted to the car's ignition system. Once fitted a driver has to provide an alcohol-free breath sample in order to start the engine – usually blowing for five seconds. If there's little to no alcohol the engine will start. If it exceeds a set level it won't start.

Australia to ban children from YouTube
Australia will ban teenagers and children from having accounts on YouTube as part of a contentious new law to restrict access to social media sites. In a move not dissimilar to Britain's online safety act, Australia passed a law in November which requires 'reasonable steps' by social media platforms to keep out Australians younger than 16, or face a fine of up to A$49.5 million (£24 million). YouTube had been exempt from the sweeping social media law, but Australia's internet regulator urged the government last month to include the site, citing a survey that found 37 per cent of minors reported harmful content on the platform. 'I'm calling time on it,' Anthony Albanese said in a statement highlighting that Australian children were being negatively affected by online platforms, and reminding social media of their social responsibility. 'I want Australian parents to know that we have their backs,' the prime minister said. The law is due to come into force in December. Social media restrictions in the UK In Britain, every child in the UK under the age of 13 must be barred from social media platforms such as Facebook, Instagram and X, Peter Kyle has said. In an interview with The Telegraph, the Technology Secretary said he was aiming for '100 per cent' enforcement of the new laws, which came into force last Friday, requiring tech firms to block children aged under 13 from their platforms. He said he 'expected' the estimated 1.8 million children aged eight to 12 in the UK who already have social media accounts to be removed from the sites. All companies that host pornography on Friday introduced robust and 'highly effective' age checks to prevent any child under 18 accessing the content. YouTube not 'classified as social media' YouTube says it is used by nearly three-quarters of Australians aged 13 to 15, and should not be classified as social media because its main activity is hosting videos. 'Our position remains clear: YouTube is a video sharing platform with a library of free, high-quality content, increasingly viewed on TV screens. It's not social media,' a YouTube spokesperson said by email. The government said in 2024 it would exempt YouTube, due to its popularity with teachers, but platforms covered by the ban – such as Meta's Facebook and Instagram, Snapchat and TikTok – have complained. They say YouTube has key similarities to their products, including letting users interact and recommending content through an algorithm based on activity. The ban outlaws YouTube accounts for those younger than 16, allowing parents and teachers to show videos on it to minors. 'Teachers are always curators of any resource for appropriateness (and) will be judicious,' said Angela Falkenberg, president of the Australian Primary Principals Association, which supports the ban. 'I will not be intimidated by legal threats when this is a genuine fight for the well-being of Australian kids,' Communications Minister Anika Wells told parliament on Wednesday.

EU trade deal will take a toll on German economy, minister says
BERLIN, July 30 (Reuters) - German Finance Minister Lars Klingbeil is dissatisfied with the European Union's trade deal with the United States, as he thinks it will take a toll on Germany' economic growth, he said on Wednesday. "I have no illusions about it, it is rather growth-weakening," Klingbeil said in the presentation of the 2026 draft budget, lamenting that the EU was "too weak" in the negotiations. The U.S. struck a framework trade agreement with the EU on Sunday, imposing a 15% import tariff on most EU goods. "I would have wished for a different outcome," Klingbeil said. "Still, all in all, it is good that there is an agreement with the U.S., that there are no further escalations."
