
Eaton fire could wipe out California's $21-billion wildfire fund, documents show
Investigators are seeking to determine whether Southern California Edison's equipment sparked the Jan. 7 inferno, which killed 19 people and destroyed 9,000 homes. If Edison is found responsible, 'the resulting claims may be substantial enough to fully exhaust the Fund,' state officials who administer the wildfire fund wrote in a draft annual report to the Legislature.
The seven-member state Catastrophe Response Council, which oversees the fund, is scheduled to meet Thursday to discuss how potential damage claims from the Eaton fire could affect it.
Concerns are already emerging that, should Edison be found liable, it would have little incentive to keep damage claims from becoming excessive since the utility itself would be spared from covering most of the costs.
'Are we impressing on the utilities that they need to settle claims with diligence?' wrote one of the council members, according to meeting materials released ahead of Thursday's meeting. 'Since the claims they settle are just passed on to us, they don't have much incentive to keep claims low.'
Asked for comment on that statement, Edison spokeswoman Kathleen Dunleavy said that officials 'need to be wise and cautious about how this money is spent.'
'We agree that the wildfire fund should go to those directly affected by wildfires,' she said.
The council member who raised the concern wasn't identified by name.
Wade Crowfoot, California's secretary of Natural Resources, holds one of the nine council seats. His spokesman, Tony Andersen, said Crowfoot is 'engaged very closely' on the wildfire fund issue, but had no additional comment at this time.
Other council members include Gov. Gavin Newsom, other state leaders and their appointees.
According to the state documents, the insured property losses alone could amount to as much as $15.2 billion, according to materials released ahead of a Thursday meeting.
That amount does not include uninsured losses or damages beyond those to property, such as wrongful-death claims. An earlier study by UCLA estimated losses from the fire at $24 billion to $45 billion.
Newsom and legislative leaders are now talking about how to shore up the fund. The Times reported last month that one option under discussion behind closed doors is to have electricity customers pay billions of dollars more into the fund.
Newsom and lawmakers created the wildfire fund in 2019, saying it was needed to protect the state's three biggest for-profit utilities from bankruptcy if their equipment sparked a catastrophic fire. Newsom said at the time that the legislation, known as Assembly Bill 1054, would 'move our state toward a safer, affordable and reliable energy future.'
Six years later, however, utilities' electricity lines continue to be a top cause of wildfires in California. And in 2024, the state had the second highest electric rates in the country after Hawaii.
Edison said in April that a leading theory of the cause of the Eaton fire is that one of its decades-old transmission lines, last used in 1971, somehow became reenergized and sparked the fire. The investigation into the cause of the fire is continuing.
Already lawyers have filed dozens of lawsuits against Edison on behalf of families who lost their homes, nearby residents who say they were harmed by toxins in the smoke and governments that lost buildings and equipment.
Under the 2019 law, Edison would be allowed to settle those lawsuits. Then the state fund would reimburse the company for all or most of those costs.
The Palisades fire, which also ignited Jan. 7, isn't covered by the wildfire fund because Pacific Palisades is served by the Los Angeles Department of Water and Power, a municipal utility.
Newsom's staff didn't respond to questions about how the fund's life could be extended and whether he believed AB 1054 should be amended so that excessive settlements or attorney fees aren't allowed to deplete the fund.
One idea being debated is to have the 30 million Californians served by Edison, Pacific Gas & Electric, and San Diego Gas & Electric pay billions of dollars more into the fund. That plan could involve extending a monthly surcharge of about $3 on electricity bills beyond its planned expiration in 2035.
Officials at the California Earthquake Authority, which serves as administrator of the wildfire fund, say they are also worried that attorney fees could eat up a large portion of the money.
Attorneys can receive 30% to 40% of the victim settlements, according to a 2024 study. An additional 10% to 15% can go to lawyers defending the utility from fire claims, the study said. That means as much as 50% of settlement amounts could go to legal fees, the paper said.
The consolidated lawsuit against Edison in Los Angeles County Superior Court lists more than 50 law firms involved in the litigation.
Officials at the Earthquake Authority say the Legislature may have to change the 2019 law to limit attorney fees or give priority to some settlements over others.
For example, Wall Street hedge funds have been offering to buy claims that insurance companies have against Edison. The funds are gambling that they can get more from the state's wildfire fund in the future than they are paying insurers for the claims now.
Council members discussed in May whether AB 1054 should be amended so that claims from Californians who lost their homes be given precedence over those owned by Wall Street investors trying to profit from the fire.

Traditionally, the boundaries are changed every 10 years with the latest U.S. Census data but Texas Gov. Greg Abbott has called a special legislative session after pressure from the White House to preserve the GOP majority in the U.S. House. President Donald Trump believes an additional five seats could be created by changing the borders. Of the state's 38 districts, 25 are held by Republicans. Democrats hold seats in big cities of Austin, Dallas, El Paso, Fort Worth, Houston, Laredo, McAllen, San Antonio. Ahead of the 2026 midterm elections, Republicans hold a 219-212 advantage in the House with four vacancies -- three Democrats who died and one Republican who resigned this week. More than a dozen Texas House members flew to Illinois and California -- two blue states -- on Friday for a meeting with California Gov. Gavin Newsom and Illinois Gov. JB Pritzkeper, during which they revealed their intentions. "Donald Trump called up Governor Abbott for one simple reason: to rig the 2026 elections. California's moral high ground means nothing if we're powerless because of it," Newsom said after meeting with Democrats from the Texas House. In California, an independent commission approved by voters in 2010 works on the maps. Newsom said he is considering having a referendum to change the rules before the 2026 election, unless the Legislature comes up with another solution, which would take two-thirds of legislators voting in favor of. Florida's congressional delegation is controlled by Republicans, 20-8. In Ohio, legislators are required to redraw maps before 2026. The GOP has 10 of the 15 seats. Colorado Gov. Jared Polis is against redistricting more frequently. The state's maps are overseen by an independent commission and it's eight U.S. House seats are evenly split 4-4. Texas situation Texas last redrew its borders in mid-cycle in 2003 after the GOP gained control of both chambers for the first time since Reconstruction. In Texas, Abbott noted a July 7 letter from the Justice Department that said majority Black and Hispanic districts in Dallas need to be redrawn based on a decision by the U.S. Court of Appeals for the Fifth Circuit last year. The DOJ said those districts are "unconstitutional racial gerrymanders," but Abbott argued the opposite in 2021. In federal court in El Paso, he argued race had not been taken into account there. "We are no longer compelled to have coalition districts," Abbott said in an interview with KDFW in Dallas. U.S. Rep. Joaquin Castro, a San Antonio Democrat, appeared at a state House hearing. "That's what's at stake here, whether you all are going to work for the people of Texas, as we used to do, to try to do, or whether you take your commandments from Donald Trump and the White House," Castro said. "I hope that you all will choose to do the business of the people of Texas, as this body has a history of being independent from the federal government."

Democrats desperately look for a redistricting edge in California, New York and Maryland
Hochul's political allies believe there is little upside to drawing new lines. 'I understand those in New York who are watching what's happening in Texas and Ohio want to offset their unfair advantage,' said New York Democratic Chair Jay Jacobs. But 'the constitution seems pretty clear that this redistricting process should be done every 10 years. I don't know where someone could interpret it as something you can do every two years.' Beyond Texas, Republicans have their eye on picking up seats in other states like Missouri and Florida — which would put Democrats in a tough spot, given they don't have as much leeway to squeeze out extra seats. New Jersey Gov. Phil Murphy was noncommittal when asked by reporters earlier this week if he plans to pursue redistricting, noting that it's 'too early to make any definitive statement about it.' But he echoed what many other Democrats across the country have said when talking about the possibility of early redistricting: 'Never bring a knife to a gunfight.' New Jersey has its own constitutional impediment, which states that congressional districts, which are drawn by an independent commission, 'shall remain unaltered through the next year ending in zero in which a federal census for this State is taken.' Even if they were able to circumvent the state constitution, Democrats already have the majority in the New Jersey congressional delegation, and just two seats — the 7th, held by Republican Rep. And Minnesota State Sen. Aric Nesbitt shut down the idea quickly: 'We're not power-crats, we're Democrats. We should do things that improve democracy, even if that means sometimes we don't get our way.' Voters in Taiwan reject bid to oust China-friendly lawmakers in closely watched poll
Asia China Election securityFacebookTweetLink Follow TAIPEI, Taiwan (AP) — Taiwanese voters rejected a bid to oust about one-fifth of their lawmakers, all from the opposition Nationalist Party, in a recall election Saturday, dampening hopes for the ruling party to flip the balance of power in the self-ruled island's legislature. The independence-leaning ruling Democratic Progressive Party won last year's presidential election, but the China-friendly Nationalists, also known as the KMT, and the smaller Taiwan People's Party have enough seats to form a majority bloc. Official preliminary results showed that the recall efforts failed to remove any of the two dozen KMT lawmakers. The scale of the recall elections is unprecedented, with another seven KMT lawmakers facing a similar vote on Aug. 23. The KMT currently holds 52 seats, while the ruling DPP holds 51 seats. For the DPP to secure a legislative majority, at least six KMT lawmakers would need to be ousted, and the ruling party would need to win the by-elections, which must be held within three months of the announcement of results. For the recall to pass, more than a quarter of eligible voters in the electoral district must vote in favor of it, and the total number of supporters must exceed those voting against. The poll closed at 4 p.m. local time. Taiwan's Central Election Commission will announce the official results on Aug. 1. If next month's poll results are also unfavorable to the DPP, it would mean that the government of Taiwan President Lai Ching-te could continue to face strong resistance from within the legislature before elections expected to take place in 2028. KMT chairman Eric Chu told reporters that voters had used their ballots to prove Taiwan's democracy is mature and great, calling for an apology from Lai. 'All Taiwanese people chose stability, chose that the government should focus on getting things done, rather than engaging in bitter political fighting,' he said. Despite their huge effort, those backing the recall were facing an 'uphill battle' in trying to unseat lawmakers in well organized, strongly KMT districts, said Lev Nachman, a professor of political science at National Taiwan University. The result is going to make it even harder for Lai to push his agenda forward, especially ahead of local elections next year, said Nachman, who is an expert on Taiwan's elections. 'At the moment, there is very little Lai can do other than try to think of other creative ways to appeal to the public,' he told The Associated Press. Fu Kun-chi, one of the most powerful and controversial lawmakers targeted, said the result left Lai with no option other than to meet with the opposition and 'find a way for Taiwan to proceed in a more stable way in this chaotic world.' DPP Secretary-General Lin Yu-chang said they humbly accepted the results, saying the recall should not be reduced to a victory or defeat for political parties and that it should be seen as a demonstration of civic power. He said his party has the responsibility to reflect on public sentiment more cautiously and adjust its approach to meet people's expectations. Those who support removing the 24 lawmakers have criticized the KMT and its allies for blocking key legislation, especially the defense budget, and passing controversial changes that are seen as diminishing the power of the executive and favoring China, which considers the island its own territory. The opposition parties' actions sparked concerns among some Taiwanese about the island's democratic integrity and its ability to deter Chinese military threats, leading to the recall campaigns. But the KMT has accused the ruling party of resorting to political retaliation after it lost the legislative majority, saying the recalls were undermining and challenging Taiwan's democratic system. The elections have intensified tensions between those backing the status quo and those favoring improved ties with Beijing. Critics accuse China-friendly politicians of compromising Taiwan and take issue with their meetings with mainland Chinese politicians. But these Taiwanese politicians claim their connections are vital for dialogue given Beijing's refusal to interact with the DPP. When asked about the recall election, China's Taiwan Affairs Office spokesperson Zhu Fenglian said in June that since the administration of Lai came into power, it has sought to achieve 'one-party dominance' and practiced dictatorship under the guise of democracy, state broadcaster CCTV reported. The office is a branch of China's ruling Communist Party government, which itself maintains strict one-party rule. Zhu said that Lai's government has spared no effort in suppressing opposition parties and those who supported the development of cross-strait relations. Taiwan's mainland affairs council said Wednesday that the Chinese authorities and state media had tried to blatantly interfere with the vote.
