Wayanad tunnel: Experts question green clearance, cite lack of proper studies

Kozhikode: The expert appraisal committee (EAC) decided to grant environmental clearance (EC) to the Rs 2,134-crore Wayanad tunnel road project by laying down 60 conditions—despite acknowledging a month ago that the tunnel would pass through vulnerable, landslide-prone terrain.

This has raised serious concerns, including questions about the reliability of the studies used to justify EC and the inadequacy of proposed mitigation measures.
At its first meeting on April 4, EAC deferred clearance citing several issues. It raised concerns that blasting vibrations could affect surrounding areas and nearby structures and said a detailed study was needed to assess if the project could worsen landslide risks.
EAC specifically asked for an evaluation based on recent landslide events in the region including their causes and impacts. However, the final clearance report does not mention any new study that carried out a detailed evaluation as suggested.
The only new study in the final report, titled Geological and Geomorphological Features of Proposed Anakkampoyil-Meppadi Tunnel Alignment and Impact Area, was done by K Soman, a retired scientist from Centre for Earth Science Studies, Thiruvananthapuram.
The other two studies mentioned in the clearance report—a geotechnical investigation and a water drainage study—were done earlier during preparation of the detailed project report.
The final EC agenda report only said that state expert appraisal committee, while recommending environmental clearance in March, advised micro-scale mapping of landslide-prone zones to enable regular monitoring and prevent activities that could further destabilise the land.

The report also said that Konkan Railway, on behalf of the project proponent, passed on these requirements to Geological Survey of India and approached it to carry out necessary investigations.
Environmental scientist and former water resources department director V Subhash Chandra Bose said this could be the first time EC was granted to a project with so many conditions. "That alone shows the risks involved in the project.
What they have overlooked is that the project area falls in a region the state govt classified as high-risk for landslides and the project goes against the principle that activities causing disturbances should not happen in such areas," he added.
Bose questioned the reliability of doing studies after deciding to go ahead with a project, saying such studies only aim to clear the way for it.
Wayanad Prakrithi Samrakshana Samiti president N Badusha said the state got clearance for the project from MOEF using false information.
He added that EAC used a similar approach to approve the project without proper multidisciplinary studies to assess landslide risks in the mountainous area, especially after recent cloudburst events.
"Some recent ECs given by MOEF bodies, including the one for Great Nicobar Island Development Project, sand sea mining and mega tourism in Lakshadweep islands, show how the process is weakened and staged. EC for the Wayanad tunnel is the latest example," he said.
Samiti plans to approach HC or other bodies within 10 days to challenge MOEF's clearance for the project. Badusha added that most conditions set by EAC are vague, unclear and impractical.
"For example, EAC recommended monitoring the endangered Banasura Chilappan bird. But monitoring does not help when tunnelling destroys its mountain habitat. Will they stop the project if monitoring shows the bird has been displaced? Many other recommendations also just call for more monitoring without real action," he added.

Bengaluru: A case has been filed in the Supreme Court seeking permission to denotify HMT forest land worth over Rs 14,000 crore, and action has been recommended against a retired IAS, IFS and two sitting IFS officers, Forest, Ecology and Environment Minister Eshwar B Khandre said. Speaking to reporters who met him in Bengaluru on Friday, he said that the land in the possession of HMT has not been converted to non-forest purposes. 'Therefore, according to several judgments given by the Supreme Court and the Forest Conservation Act, 1980, it remains a forest even today. However, this land is alienated, real estate companies have built hundreds of flats. Shooting of serials and films is going on. The land is being used for commercial purposes. How this was allowed is questionable', he said. Responding to a journalist's question about why no action has been taken even after seven months of giving notice to officials in the case of IA for denotification of HMT forest land without the permission of the cabinet, the minister said that the forest land in the possession of HMT is the property of 7 crore Kannadigas, which a few officials did not even bring to the attention of the then Forest Minister and applied for denotification without seeking the prior permission of the cabinet. He said that notices have been issued to four officials, including two retired and two serving ones, and that he has recommended action to the Chief Minister. Additional Chief Principal Conservator of Forests R Gokul has written a letter to the CBI seeking protection, saying that he is being victimised because he got the ruling party MLAs punished in the Belikeri case. Responding to a journalist's question whether the government is victimising officials, Khandre said that this is a completely false allegation made against the government. 'On September 24, 2024, I sent a written note to the Additional Chief Secretary, asking for a show cause notice to the officers who had issued IA without the prior approval of the Cabinet and asked them to take action' the Minister said. 'A month after the notice was given, the verdict was delivered in October 2024. R. However, the IA was submitted by giving false information to the Supreme Court that the said land has lost its forest status. The officer writing the letter to the CBI in his defence questioned why he did not write a letter to the Chief Minister saying that there is forest on the HMT land. It cannot be submitted as an IA because it has lost its forest status. A high-level committee headed by the Chief Secretary was formed in 2015 to discuss and recommend to the government the forest land held by other institutions in Bengaluru. Without even bringing it to the attention of that committee, a petition was filed in the Supreme Court on June 20, 2020, seeking permission for denotification without the permission of the Cabinet. In just 25 days, i.e. on 15 July 2020, a high-level meeting was held to decide the issue 'I have asked the Additional Chief Secretary, Forest, Environment and Ecology Department to submit a proposal for denotification of such forest areas after seeking the opinion of the Advocate General regarding the sanction of areas to various/government institutions before 1980 for a decision.' However, he said that ex-post facto permission was not obtained for this. Hence, notices were issued to four officers. He said that he has now submitted a file to the Chief Minister to suspend Gokul and conduct an inquiry, conduct a departmental inquiry against another officer and take action against a retired IAS officer and an IFS officer as per the rules. As soon as this matter came to his notice, an application was filed in the Supreme Court to withdraw the IA. The Cabinet's permission has also been obtained to withdraw the IA, said Eshwar Khandre. The government's intention is to build another huge park in North Bengaluru on the forest land in the possession of HMT. 'Our goal is to save breathing space for the next generation' Eshwar Khandre said and added that he had made this point clear even before filing an application in the Supreme Court to withdraw the IA.

Punjab and Haryana High Court retired Chief Justices or their spouses to get a consolidated amount of Rs 50,000 per month and retired Judges or their spouses to get Rs 45,000 per month to engage domestic help(s) and driver(s), besides Rs 15,000 per month towards expenses of rental and calls of mobiles, and/ or landline, Internet service, secretarial services and security service. However, all these benefits come with riders. Exercising powers conferred by Article 229, read with Article 231, of the Constitution of India, Haryana Governor Bandaru Dattatraya on Friday notified a set of rules called the Retired Chief Justices and Judges Domestic Help(s) and other Benefits Rules, 2025, that 'applies to a person who has held office either as Chief Justice or as a Judge of the High Court of Punjab and Haryana and their spouses'. As per the rules, 'a retired Chief Justice or a Judge of the High Court or their spouse shall be entitled to avail the services of Domestic Help(s), Driver(s), Secretarial Assistance, Security and Telephone facility at the expenses of the High Court', subject to a few conditions, including 'they are not availing such or similar facility from any other High Court'. 'The retired Chief Justice/ Judge or their spouse may at her or his discretion select persons to be engaged as Domestic Help(s)/ Driver(s)', the rules mentioned. 'To enable the retired Chief Justice/ Judge, or their spouse, to engage domestic help(s), driver(s), the High Court shall provide a consolidated amount of Rs 45,000 per month to a retired Judge or spouse and Rs 50,000 per month to a retired Chief Justice or spouse,' the rules state. The rules also have a provision of 'secondment' that states: 'The retired Chief Justice/ Judge or their spouse may request to avail the services of maximum of two employees working in Last Grade Service of the High Court, one of whom may be a Driver; (OR) If any employee working in Last Grade Service of the High Court furnishes to the Registrar General of the High Court, a request in writing to serve a retired Chief Justice/ Judge or their spouse, as the case may be, and the services of such employee(s) is/ are acceptable to the retired Chief Justice/Judge or their spouse, as the case may be; They may be seconded to work with the retired Chief Justice/ Judge or their spouse until the employee(s) attain(s) the age of superannuation and/ or so long as the retired Chief Justice/ Judge or their spouse is entitled to this facility. It is made clear that if employees of the High Court are seconded, the retired Chief Justice/ Judge or their spouse, as the case may be, are not entitled to full reimbursement as stipulated in Rule-7 if two employees are provided by the High Court or 50% of the reimbursement mentioned in Rule-7 if only one employee of the High Court is provided. The said secondment shall be at the discretion of the Hon'ble Chief Justice and subject to the availability of staff'. The rules further state: 'The retired Chief Justice/ Judge or their spouse, shall be paid Rs. 15,000 per month towards expenses of rental and calls of mobiles, and/ or landline, internet service, secretarial services and security service. However, this facility shall not be available if the retired Chief Justice/ Judge or their spouse, as the case may be, has accepted some assignment and has been provided the same facilities under that assignment, during the continuation of such assignment.' 'These Rules shall be in addition to and not in derogation of any other benefits, which are available to retired Chief Justice(s)/ Judge(s) and/ or their spouse(s)', the rules state.
