Polls to elect next vice president to be held as soon as possible

New Delhi, Jul 22 (PTI) With Jagdeep Dhankhar quitting as the vice president, the election to appoint his successor will have to be held 'as soon as possible".
According to Clause 2 of Article 68 of the Constitution, an election to fill a vacancy in the office of the vice president occurring due to his death, resignation or removal, or otherwise will be held 'as soon as possible" after it becomes vacant.
The person elected to fill the vacancy will be entitled to hold office 'for the full term of five years from the date on which he enters upon his office".
The Constitution is silent on who performs the duties of the vice president in case of his death or resignation before the expiry of his term, or when the vice president acts as the President of India.
The vice president is the second highest constitutional office in the country. He serves for a five-year term, but can continue to be in office, irrespective of the expiry of the term, until the successor assumes office.
The only provision in the Constitution is with regard to the vice president's function as the chairperson of the Rajya Sabha, which is performed, during the period of such vacancy, by the deputy chairperson or any other member of the Rajya Sabha authorised by the President of India.
The vice president may vacate his office by submitting his resignation to the President. The resignation becomes effective from the day it is accepted.
The vice president is the ex-officio chairperson (holding the office of the Rajya Sabha chairperson by virtue of being the vice president) of the Rajya Sabha and does not hold any other office of profit.
During any period when the vice president acts as, or discharges the functions of the President, he does not perform the duties of the office of the chairperson of the Rajya Sabha and is not entitled to any salary or allowances payable to the chairperson of the Upper House.
According to Article 66 of the Constitution, the vice president is elected by the members of the Electoral College consisting of the members of both Houses of Parliament in accordance with the system of proportional representation by means of the single transferable vote.
A person cannot be elected as vice president unless he is a citizen of India, has completed the age of 35, and is qualified for election as a member of the Rajya Sabha.
A person is not eligible if he holds any office of profit under the Government of India, a state government, or any subordinate local authority. PTI NAB DIV DIV

Trinamool Congress Rajya Sabha MP Ritabrata Banerjee has accused that despite claims of Union Government, the creches in tea gardens run by the Centre in north Bengal are non-functional. Mr Banerjee had posed an unstarred question at Rajya Sabha on July 25 (Friday) to the Minister of Heavy Industries regarding the issue. 'Whether it is a fact that there are no operating Creche houses in Karbala, New Dooars, Banarhat and Choonabhutti tea gardens of Andrew Yule group,' he asked. In response, the Minister of Heavy Industries, Bhupathiraju Srinivasa Varma gave a list of five creches that are functioning in these tea gardens. Notably, these tea gardens are not directly Central Government owned, but managed by Andrew Yule and Company, which is a public sector enterprise owned by the Ministry of Heavy Industries, Government of India. After the Ministry's response came in, Mr Banerjee issued an official statement and said that before the Monsoon Session of the Parliament begun, they had conducted a survey among the tea gardens workers of north Bengal, among many problems, non-functional creches were sighted as one of the major problems by the workers. 'Since Saturday morning our Trinamool Cha Bagan Shramik Union (TMC Tea Garden Workers Union) members have individually visited these creches and none of them are functioning. We made videos and taken photos. How did they claim these to be operating?' The videos which were shared widely show that houses which are known as the creche are mostly closed or in dilapidated condition. Mr Banerjee accused that the creches which the government has called an 'operating creche' is not even suitable for 'animals, let alone humans.' He said that the creches mentioned are better suited as 'cattle sheds.' On the other hand, the MP also highlighted that the West Bengal government and Chief Minister Mamata Banerjee have already decided to make creches for the tea garden workers and the ease of their children. 'We can also make creches in the four tea estates of the union government, but we would need their No Objection Certificate,' Mr Banerjee added. Mr Banerjee then went to shed light on the other plights of the tea garden workers including lack of a provident fund and irregular wage payments, and more.

Lucknow: To renew its "resolve to protect the reservation system enshrined in Indian Constitution", the Samajwadi Party functionaries on Saturday assembled in large numbers across the state to observe July 26 as the Samvidhan Mansthambh Divas. Party workers attended special events organised to outline the ways and means that the BJP government has devised to subvert the right to reservation and constitutional frameworks to undermine the rights of the oppressed and exploited sections of the society. The party leaders across the state cited outsourcing of government jobs as a major onslaught on right to reservation. They explained in detail to people how the BJP has devised the "Not Found Suitable" option to deny jobs to PDA community members in various universities, colleges and institutes. He said Samvidhan Mansthambh Divas encapsulates the spirit of PDA Prakashsthamb which is about lighting up the path for the Pichhde (backward classes) Dalits and Alpsankhyaks (minorities) to reclaims their rights as enshrined in the Constitution and which they were being deprived of by the BJP in a systematic manner. SP MP from Azamgarh Dharmendra Yadav, who was the chief guest of the Samvidhan Mansthambh Divas event held in Jaunpur, called upon the PDA community to come forward to help save the Constitution and protect reservation.
