
Unproven Sexual Allegations Against Father-In-Law, Husband Amount To Cruelty: Madras HC

Such unsubstantiated or uncorroborated claims cause stigma and mental agony to the husband and his family, and unless proved, they amount to defamation, court said.
The Madras High Court recently dissolved the marriage of a couple embroiled in a protracted matrimonial dispute, holding that unsubstantiated sexual allegations made by the wife against her husband and father-in-law constituted mental cruelty.
A division bench of Justices J Nisha Banu and R Sakthivel allowed the husband's appeals against the 2023 family court orders which had dismissed his plea for divorce and directed restitution of conjugal rights in favour of the wife. The high court held that the allegations, though later withdrawn, were serious, defamatory, and left unproven, thereby causing irreparable mental agony.
The couple married in 2015 and had a son in 2016. According to the husband, the marriage began to deteriorate when the wife refused to live with his family, insisted on a separate residence, and frequently left for her parental home without cause. He also claimed that she threatened to lodge false complaints and eventually accused his father of sexual harassment and him of having illicit relationships with other women.
The wife later withdrew her October 2017 complaint against the husband and his father, allegedly based on his assurance of reconciliation. However, the husband never began living with her. She then sought restitution of conjugal rights, stating that she still wished to maintain the marriage for the sake of their child.
The family court accepted the wife's version and dismissed the husband's divorce petition, stating that merely withdrawing the complaint did not imply it was false. The court also held that asking for a separate residence due to allegations of harassment by in-laws could not be treated as cruelty.
The high court, however, took a different view. It observed that the wife had failed to substantiate her allegations with any evidence or pursue the complaint further when reconciliation did not occur.
'Unsubstantiated or uncorroborated defamatory averments cause stigma and mental agony and, in the facts and circumstances of this case, amount to cruelty," the court held.
The bench noted that the couple had been living separately for over seven years and attempts at mediation had failed. While the wife may still be willing to resume the marriage, her past conduct gave the husband reasonable cause to fear further harm, the court said.
'His apprehensions about continuing the marital life with the respondent, even after the defamatory and derogatory allegations of sexual nature against him and his father, cannot be brushed aside simply," court said.
In its concluding remarks, the court granted the divorce under Section 13(1)(i-a) of the Hindu Marriage Act but clarified that the order would not affect the wife's and their child's right to claim maintenance under applicable laws. The husband was already paying Rs 25,000 per month in maintenance, and the court allowed her to seek enhancement if needed.

Mumbai: The police arrested a 36-year-old man from Badlapur for allegedly luring a 46-year-old western suburbs resident into buying a 3BHK flat in Dadar and cheating him of Rs 1.07 crore. The deal for the flat was finalised through emails and phone calls only. In 215 transactions, the complainant sent money to the accused to buy the flat without even seeing the flat, site, or the seller. Six years later, he learned he was taken for a ride. A west region cyber crime police station team, led by senior inspector Suvarna Shinde and assistant inspector Dr Nitin Gacche, is probing the case. The crime occurred between Nov 2018 and Nov 2024. The complainant wanted to buy a house in Mumbai and saw an advertisement on Facebook about cheap flats available in Andheri, Bandra, Borivli, Dadar, etc. He contacted the email ID given in the advertisement and began communicating. The accused sent him a form and asked him to fill in his details for booking the flat. He told police he splurged money on flight tickets for Meghalaya, Shillong, Chandigarh, Goa, etc., and stayed in hotels. Pandey, who studied up to class X, is the son of a doctor.

Religious structure with bathtub inside, and other buildings: Why Jamnagar administration is clearing ‘encroachments' along Rangmati river
On Sunday, a video of a bathtub inside a religious structure in Jamnagar went viral on social media. Built on the banks of river Rangmati, the structure is among several others demolished by the Jamnagar police on Saturday as part of an ongoing anti-encroachment drive. On Sunday, police said, they cleared 71,933.5 square metres of encroached land on both banks of the river in an area known as Bachu Nagar, located at the heart of the city. 'There are all sorts of residential, commercial and religious encroachments here, totalling more than 600 structures. While we cleared 294 structures yesterday (June 14), in total, we have cleared about 400 till now,' said Jamnagar Superintendent of Police (SP) Premsukh Delu on Sunday, adding that the drive is being conducted in a phase-wise manner. The local administration has cited severe flooding, alleged encroachment by what they termed as miscreants, and plans for a riverfront development project, to rationalise the demolitions underway on Rangmati banks, one of the two rivers that flow through Jamnagar, the other being Nagmati. The Jamnagar Municipal Corporation (JMC) told the police that the valuation of the encroached land stood at approximately Rs 193.57 crore. Talking about the religious structure, the largest that the JMC and the police have cleared till now, Delu said, 'This particular religious structure was built like a fort and the inside was like a maze. The premises were large and built over 11,000 square feet (1,021 sq metres). There were several rooms and a bathtub inside. Outside the room, there was a warning that entry is restricted and allowed only by permission.' Detailing on who took the action, Delu said, 'It is a joint action by the JMC and the District Police. Apart from illegal homes of miscreants on our list, the civic body is also working on its pre-monsoon plan. There are plans to develop this area into a riverfront as well.' Delu stated that encroachments are located mainly outside the walled city of Jamnagar, on the river banks. 'Because of this, the river used to extend right up to the walls, causing the encroachments to enter deep into the river bed,' he added. SP Delu said that Jamnagar city has regularly been facing a problem of severe flooding. 'The CM's (Bhupendra Patel) first visit after assuming office was to Jamnagar due to the floods. Last year (2024), again there were floods. The encroachment on the river is the reason why this problem was exacerbated,' the SP added.
