Chhattisgarh HC dismisses man's plea for call records of wife citing right to privacy

Raipur: The Chhattisgarh High Court dismissed a petition filed by a man seeking the call detail records (CDR) of his wife's cellphone. The court observed that privacy is a constitutionally protected right under Article 21, encompassing personal intimacies and the sanctity of marriage.
The court noted, "Marriage does not grant the husband automatic access to the wife's private information, communications, and personal belongings. The husband cannot compel his wife to share her passwords for the cellphone or bank account, and such an act would amount to a violation of privacy and potentially domestic violence. There should be a balance between marital privacy and the need for transparency and, at the same time, trust in the relationship," observed the high court.
Justice Rakesh Mohan Pandey upheld the order passed by the first additional principal judge of the family court, Durg, which rejected the husband's application for his wife's CDR.
The couple married on July 4, 2022, in Sankara, Rajnandgaon. The husband filed for dissolution of marriage under the Hindu Marriage Act, 1955, alleging a drastic change in his wife's behaviour soon after she visited her parents' house and that she misbehaved with his mother and brother.

He also claimed she refused to return with him after going to her parental house again in September-October 2022.
He initially sought restitution of conjugal rights. Subsequently, the wife filed an application under Section 125 of CrPC and initiated domestic violence proceedings against her in-laws. A complaint was also lodged at Mahila Thana, Rajnandgaon, against her in-laws. The husband then filed for divorce on grounds of cruelty.
The petitioner approached the senior superintendent of police, Durg, on 24 January 2024, and again on 30 November 2023, seeking the wife's CDR, citing doubts about her character. He then moved the family court on 12 October 2023, with a similar request.
The husband's written arguments before the family court alleged that his wife frequently spoke to her brother-in-law (jija) for extended periods, suggesting a possible illicit relationship and stating that the CDR was necessary for the case. The family court rejected this application on 27 June 2024.

The top court was hearing a plea filed by the woman against an interim order passed by the Bombay High Court in the matter. The lawyers appearing for both parties said after several rounds of negotiations during the pendency of appeal, they had decided to seek dissolution of marriage by a decree of divorce by mutual consent on certain terms and conditions. The bench noted the aspect of their child's custody and visitation rights which indicated the child's custody would remain with the mother with the rights of visitation would be with the father in line with the joint application. It came on record that the man would pay Rs 50,000 every month towards his minor daughter. The terms and conditions of settlement in the joint application filed under Article 142 of the Constitution read with section 13B of the Hindu Marriage Act, 1955. While Article 142 empowers the apex court to pass any decree or order necessary for doing "complete justice" in any cause or matter pending before it, Section 13B of the Hindu Marriage Act deals with divorce by mutual consent.

The man, identified as Jivan Khan from the Sankada area, was caught by Military Intelligence (MI) and later handed over to Kotwali police. Officials said Khan had previously worked at a restaurant inside the military area in Jaisalmer. On Tuesday, he was stopped at the Army station gate while trying to enter the premises. His mobile phone was checked due to suspicious activity, after which MI officers took him into custody. During questioning, Khan reportedly admitted that he has relatives in Pakistan. He will now be presented before the Joint Interrogation Centre (JIC), where multiple security agencies are expected to question him further. Briefing about the arrest, SP Jaisalmer Abhishek Shivhare said, "One suspicious person has been detained and is being taken for investigation. It has been revealed that he communicated with someone in Pakistan. His mobile phone is currently under investigation...
