
Court refuses to clarify Omotoso acquittal, dealing blow to NPA appeal efforts
Last week, the NPA launched its first step in its appeal against the April judgment, which found it had failed to prove Omotoso's guilt beyond a reasonable doubt.
The controversial Nigerian televangelist was arrested in 2017, facing 30 counts of rape, sexual assault, human trafficking and racketeering, over alleged crimes committed against his congregants in his church.
The NPA's efforts to resurrect its failed case against Timothy Omotoso appear to be losing momentum, with the Gqeberha High Court refusing to provide additional reasons for his acquittal.
Last week, the prosecution filed its first papers to appeal an April judgment that found it had failed to prove Omotoso's guilt beyond a reasonable doubt, relying heavily on what the court called unreliable witnesses.
Omotoso, who is now barred from entering South Africa leaving, the country for Nigeria has maintained his innocence throughout.
His lawyer, Peter Dauberman, slammed the NPA's appeal as a 'desperate attempt to save face,' accusing prosecutors of wasting judicial resources and further damaging his client's reputation.
He argued the state had ample time to present a strong case and that the acquittal was fully justified by the evidence.
The High Court is expected to hear further arguments next Tuesday but for now, the state's case remains on shaky ground.

The DA said that, due to the brazen antics of the drag racers, innocent lives in Johannesburg's suburbs are being put at risk because of the 'reckless and illegal practice of street racing.' 'Dangerous races' DA Gauteng spokesperson for Community Safety, Michael Sun, said the 'dangerous races' often occur in the early morning. 'They transform quiet suburban streets into hazardous racetracks. The DA in Gauteng has been inundated with complaints from concerned residents, and we demand that Premier Panyaza Lesufi urgently intervene and halt this alarming trend'. Tragedy Sun shared details of a tragic incident that occurred on July 12, 2025 at about 5:30am, on Jan Smuts Avenue in Rosebank. 'Reports indicate that three vehicles were racing on the wrong side of the road when they collided. One of the racers died at the scene. Tragically, an innocent Uber driver was also struck head-on and lost his life. 'The occupants of the other two racing vehicles fled the scene, leaving behind a devastating aftermath,' Sun said. 'Every weekend morning, residents along Cedar Road in Fourways are jolted awake by the deafening roar of modified engines and motorbikes speeding through their neighbourhood. 'On 13 July 2025, yet another incident was reported on Allandale Road in Midrand. At approximately 8:50 am, Ward Councillor Annette Deppe witnessed a group of six or seven high-powered vehicles racing down the public road as if it were a private speedway,' Sun said. Penalties for this offence can range from fines and imprisonment to the suspension or revocation of a driver's license in severe cases. 'The DA Gauteng has engaged the Chief of JMPD and relevant Saps Station Commanders to demand urgent intervention. Our communities cannot become battlegrounds for ego-fuelled speed chases,' Sun said. Safe space Sun added that his party will be tabling questions to Lesufi in the Gauteng Provincial Legislature (GPL) to determine how many illegal racing incidents were reported in the past five years, how many people were killed, and whether gangs or drugs were involved. 'A DA-led Gauteng provincial government would ensure that both the JMPD and Saps fully exercise their constitutionally guaranteed powers to curb the scourge of illegal racing'. Sun said the DA would also explore the creation or support of safe, regulated facilities where motor enthusiasts can enjoy their sport without endangering the lives of others. Another lie? Joslin's mom has 'dream' of her location
Social media users are reacting to rumours that Kelly Smith reportedly had a 'dream' about the location of her missing child, Joslin Smith. This comes as police confirmed that they were following up on new leads in the informal settlement of Middelpos. In May, the Saldanha Bay woman and two others, Jacquin 'Boeta' Appollis and Steveno van Rhyn, were convicted and sentenced by Western Cape High Court judge Nathan Erasmus for kidnapping and child trafficking. Last February, the blonde-haired, green-eyed girl disappeared from her home. According to witnesses, she was allegedly sold to a sangoma for the purposes of 'muti'. On social media, South Africans have been speculating after police confirmed that they were following up on new information about the disappearance of Joslin Smith. Many referred to a rumour that the little girl's mother – Kelly Smith – had 'dreamt' that Joslin was dead. She claimed her remains were located in Middelpos, where the Smith family resided. One Facebook user posted, 'Kelly apparently had a dream that she is buried in a drain in the cemetery behind Middelpos. Kelly is playing games.' Another added: 'Kelly Smith is probably the one who helped dig the hole then. Her hands and arms were full of sand'. A third added: 'I think that Kelly has possibly given the investigating officers information regarding who exactly it was that she sold Joslin to'. Is Joslin Smith still alive? During an eight-week trial, witnesses relayed how Kelly Smith bragged about selling her daughter to a sangoma for R20 000. She also allegedly claimed her child had been trafficked by a Nigerian man. Kelly reportedly told her sister that Joslin could also be 'hiding' in the Middelpos informal settlement. Kelly and her co-accused refused to testify in court. In a statement, police confirmed that they were following up on new leads in the active investigation into Joslin Smith's disappearance. It read: 'SAPS teams led by detectives with K-9 members, search and rescue teams, and local police have been scouring an identified area in Saldanha Bay. Whether the ongoing search will yield any success remains to be seen. 'It is worth reiterating that police have an obligation to follow up and test all information that is brought to their attention'. Police appealed to the public to give them space and time to perform their duties as the investigation continues.' Meanwhile, Kelly Smith, Jacquin Appollis, and Steven van Rhyn will appeal their life sentences for kidnapping and child trafficking relating to Joslin Smith. National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila confirmed that the trio will appear in the Western Cape High Court on 12 and 13 August. He said: 'All three have filed papers challenging both conviction and sentence. The NPA will oppose the applications, and we are confident that there are no prospects of success.
