The father-of-one, who is originally from America, wanted to "bring a slice of California" to his West Yorkshire home that is fit with a home office, games room,
It is cleverly hidden from view by a railway embankment below, and therefore only visible to trains passing by.
However, council officials have rules the structure was built without permission, and declared the entire £50,000 project illegal.
Following years of investment by Mr Khan into the ambitious build, the council have ordered for it to be demolished.
Mr Khan, thinking his property would not be intrusive or overbearing for neighbours, said: ""Because it's in a valley that nobody can see, I thought it was perfect.
"I won't build it up, I'll build it down, so you can't see anything."
He added: "The building inspector came out in 2008 and gave me the go-ahead, and I never heard anything from the council for years.
"There was no suggestion at all that I had done anything wrong."

But because Mr Khan did it all himself, from removing the vegetation, laying concrete foundations, and building up from the foot of the embankment to garden level, he thought the project fell within permitted development rights.

Bradford Council, however, took enforcement action last August by demanding he demolish the structure within three months.
They described the building as "incongruous" and "prominent" with its modern design, white render finishing and 'scale, massing and position upon an otherwise undeveloped embankment."
During a planning committee meeting, planners also claimed the rooftop terrace provided 'unrestricted views into the most private areas' of a neighbour's home.
Mr Khan argues the council's enforcement action comes too late, as the project was started more than decade ago.
He also insists the annex was built to a very high standard, with structural engineer backing: "I've gone at least five times over what is stipulated by building regulations.
"When I build something, I build something where it's going to last."
"I've done everything by the book, gone above and beyond," Mr Khan continued.
"I've worked on it after work, digging and building myself."
"You just want to create something beautiful that'll be there after you're gone - and still, you're treated like you've done something wrong.'
The 55-year-old still has greater plans for the property, including installing a kitchenette, toilet, Jacuzzi and full-size pool table.
But he may have to demolish the building entirely, if his current appeal to the Planning Inspectorate is unsuccessful.
Mr Khan is determined to fight if it comes to it: "I've got lawyers. I'll go all the way. Anyone with sense can see the value in what I've built.
"It's not intrusive at all. You have to think of people other than yourself.
"I could have built a granny annex at ground level which would have been imposing - instead they're looking at something much nicer."
He expects the home could be finished within five months, but it's been two years since he has done anything to its interior due to fears its demolition could come at any moment.
"I've felt like jumping off the rooftop because of all this constant harassment from the council."
Bradford Council, however, have defended their decisions and stated: "The difficulty with this proposal is that the size of the outbuilding with the amount of floor space over multiple levels is substantial in the context of a private dwelling.
"The building is large and the floorspace is utilised over multiple floors, and the local planning authority has not been provided with any details or any explanations as to why such an amount of space for an outbuilding use would be required for that amount of ancillary space."

At 3,713square feet, Montebello is well over three times the size of an average family home and includes six bedrooms and three bathrooms. The €1.295million sale is one of nine €1million-plus residential property sales to take place in the in-demand seaside town to date this year. The move to put the property on the market came five months after An Coimisiun Pleanala (ACP) refused planning permission to then owner Rachel Carthy to convert the property into five apartments. A number of local residents opposed the planned apartment scheme and ACP refused planning permission after finding that the proposal would result in an incongruous structure in terms of design. ACP, dismissing its own inspector's recommendation to grant planning permission, found that the scheme would adversely affect the architectural character of the seafront area. The property holds major significance for the late star, who lived in the property for 15 years. Sinead, 56, died on July 26, 2023, of natural causes at her London home. In August 2023, mourners left flowers outside the home as thousands of people gathered on the seafront outside Montebello to see her funeral cortege make its way to a private burial. Fans returned to the seafront home last year from as far away as New Zealand to pay homage to the Nothing Compares 2 U singer. TEAM AT WORK However museum owner Paddy Dunning has revealed that rather than one sculptor being tasked with the new piece, a team of sculptors are working together to create the new Sinead waxwork. Paddy Dunning told The Irish Sun: 'I wasn't involved in the process of quality control at The National Wax Museum when we unveiled the last wax figure of Sinead but I am involved this time. 'I'm qualified to get it right because I knew Sinead since she was 18 and began her music career. THE MILLIONAIRE MILLENNIAL Gareth Sheridan chose the Constitution Room, the birthplace of the Irish Constitution in 1922, in the Shelbourne Hotel in Dublin as the location to launch his presidential campaign today. It's the second presidential launch we've had this summer, with the pharma tycoon worth €16 million, fielding robust questions from the Irish media as he enters the race. With his wife Heidi and his campaign team seated at the large Cabinet-style table next to the podium, the pharma tycoon (a terms he says he wouldn't use to describe himself) answered questions about the range of controversies that have emerged since his name first entered the race last weekend. The entrepreneur and former CEO of US-based company Nutriband, which describes itself as a 'values-based company' that manufactures abuse deterrent transdermal patches aimed specifically at opioid and fentanyl abuse, took questions on his finances, a united Ireland, the Triple Lock, migration, the Occupied Territories Bill, and housing. Sheridan's net worth right now is around €16 million and he has €500,000 cash in the bank to fund his presidential campaign. It was an honest mistake. You pay your dues and you move on,' he said. Did his mother object to social housing? After a story appeared in the Irish Examiner today, Sheridan confirmed that his mother did object to a housing project through her work. He said his mother 'broke down' when Sheridan asked her about it yesterday. 'It's something that is not in the personality of my mother by any means. My mother grew up in social housing. You know, she is one of my inspirations to tackle the housing crisis, and she's fully behind it. So I'm just really stressed about that. As a family, we find this as a core issue that needs to be tackled,' he said. What does he think about immigration and racist attacks? Asked about the recent attacks on the Indian community, Sheridan said 'it's certainly troubling but has become a 'little bit more prominent' now. 'I really stress that if that's something that you support or get behind, and I'm definitely not your candidate,' he said today. Describing immigration and migration in general as a 'tricky subject', Sheridan said these are 'not statistics at the end of the day. We're talking about people'. 'I think we have a migration problem both ways, right? We have an emigration problem because the youth are leaving in their droves, but we don't have an immigrant problem,' he said. 'It should be no surprise to us that Ireland has become a destination where people want to live and want to raise a family and want to grow their life, and we should have seen that coming,' he said. 'But we also have to understand that immigration is healthy for the economy, right? It's a matter of making sure that we all get along,' he added. Is he against removing the Triple Lock? Sheridan said today that he is against changes to the Triple Lock. This is one of the key pieces of legislation that the next president may have to sign off on if government is successful in pushing it through. The triple lock system dictates that Irish troops in groups of more than 12 cannot be deployed abroad without approval from Cabinet, the Dáil and a resolution from the United Nations Security Council. The changes proposed by government include removing the UN Security Council element. 'I think we're Irish first and European second and they need to listen to the people a little bit more,' said Sheridan. 'I think there's an overwhelming objection of the idea that we would move forward with that. And I want to stress that we're militarily neutral, but we've never been morally neutral, and that's important as well,' he said. Would Sheridan like to see a united Ireland? Sheridan said it is something he would love to see in his lifetime, but he said it is a complex issue that cannot be rushed. He told the media that the idea of a united Ireland needs to be 'very seriously thought out', stating that 'the narrative that we need to rush to bring that through is a little bit unprepared'. Is housing going to be one of his key talking points? Yes, Sheridan said he is not going to bring his toolbox and start building houses, but he will champion the issue. In January 2025, the terminal overhaul at King Khalid International Airport was completed - bringing the extension closer to completion. The revamped terminal features new facilities, including 38 check-in counters, 10 self-service kiosks, 26 passport control counters, and 10 automated gates.
