
Cash recovery case: SC to hear Justice Varma's plea against in-house committee report on July 28
According to the causelist uploaded on the apex court's website, a two-judge Bench comprising Justice Dipankar Datta and Justice Augustine George Masih will hear Justice Varma's appeal.
The hearing assumes great significance, considering the fact that the impeachment process have already been initiated in Parliament for his alleged misconduct in connection with the recovery of cash.
On July 17, Justice Varma filed an appeal before the top court challenging the in-house committee report that found him guilty of misconduct. He contended that the mere recovery of cash from the outhouse of his official residence did not establish his culpability.
Subsequently, on July 23, he mentioned the matter before a Bench led by Chief Justice of India (CJI) B.R. Gavai, seeking an early hearing. The Supreme Court agreed to list the matter.
Senior advocate Kapil Sibal, appearing for Justice Varma, submitted before the CJI-led three-judge Bench that the matter involved important constitutional questions. The CJI assured him that an appropriate Bench would be constituted to hear the matter but recused himself, citing his prior involvement in internal discussions related to the case. 'I think it will not be proper for me to take up that matter because I was a part of that conversation,' the CJI said.

JAIPUR: In a chilling case of post-tragedy exploitation, fraudsters posing as government and legal representatives allegedly attempted to deceive and intimidate the family of a deceased victim of the recent Ahmedabad plane crash. The family, residing in Rundeda village of Vallabhnagar tehsil, was approached with a false promise of ₹8 to ₹10 crore in compensation in exchange for confidential documents and signatures. According to the police complaint filed by Deepak Menaria, son of the deceased Vardichand Menaria, the fraudsters first made contact via a mobile call on the night of 17 July. The caller, identifying himself as Bhupendra, claimed to be part of a central government verification team and requested personal documents including a copy of the deceased's passport and flight ticket. He assured Deepak that filing a legal case against Boeing could result in a massive compensation payout. The very next evening, on 18 July, a man and a woman arrived at the complainant's house in a white Ertiga car (registration number GJ 06 DX 8772). Without prior notice or formal introduction, they entered the house and began speaking directly to the victim's mother in a confusing and persuasive tone. Alarmed, she called Deepak, who rushed home to find the duo claiming to be from the Supreme Court in Delhi. They allegedly insisted that the family sign and provide thumb impressions on some documents, which they claimed were needed to initiate a lawsuit against Boeing in the United States. However, when Deepak stated that he intended to file the case independently — including Boeing, Air India, the Government of India, and the Airport Authority — the duo allegedly became aggressive, trying to coerce him into signing.

Maharashtra deputy Chief Minister Eknath Shinde visited Delhi on Thursday to hold meetings with Shiv Sena MPs and senior Union Ministers, triggering renewed speculation about a possible cabinet reshuffle. However, BJP as well as Shinde led Sena functionaries have downplayed any immediate changes in the MahaYuti government. The visit comes just days after Chief Minister Devendra Fadnavis met senior BJP leaders and Union Ministers in the capital to discuss key infrastructure and funding proposals. The back-to-back visits by the two leaders have set off political chatter, especially amid growing strains within the alliance. Shinde, who arrived in Delhi late Wednesday night, had a packed schedule on Thursday before returning to Mumbai. During his visit, he chaired a review meeting with MPs from his faction of the Shiv Sena, focusing on their parliamentary performance, constituency-level concerns, and coordination with the Centre. He is also learnt to have followed up on pending development issues with Union Ministers. 'Since the monsoon session of Parliament is underway, I came to Delhi to hold discussions with our MPs and meet Union Ministers. I always come to Delhi during the parliamentary session to hold a meeting with the party MPs. As an NDA ally, we support the Centre on key issues and are pushing for Maharashtra's development. Ours is a double-engine government and our efforts are aligned with that goal,' Shinde told reporters further dismissing the possibility of any reshuffle. Highlighting the party's growing support in Mumbai, Shinde said 123 former BMC corporators have recently joined his faction. 'This is a good sign ahead of the civic polls. Those who ruled the BMC for 20 years and treated it like a hen that lays golden eggs have been taught a lesson. Mumbaikars will teach them another one in the coming elections,' he said, in a swipe at the Shiv Sena (UBT). According to party sources, Shinde also interacted with office-bearers and representatives from other states, as part of the Sena's broader organisational outreach. 'These engagements are crucial as the party looks to expand beyond Maharashtra,' a senior party leader said. In line with this strategy, the Shinde-led Shiv Sena is expected to hold a national executive meeting in Delhi in the coming weeks. State presidents and senior leaders from across India are expected to participate, with discussions likely to focus on party expansion and programme planning. The visit comes at a politically sensitive time. The government is under fire from the Opposition over corruption allegations against some ministers, and there are growing demands for their resignation. Simultaneously, talks of a possible alliance between Uddhav Thackeray's Shiv Sena (UBT) and Raj Thackeray's MNS ahead of the BMC elections have added to the political uncertainty. Earlier this week, Deputy CM Fadnavis met Finance Minister Nirmala Sitharaman and other senior Union Ministers to push for major funding proposals. Fadnavis also met Maharashtra Governor Ramesh Bais on Thursday, fuelling speculation about a cabinet reshuffle or portfolio changes. Are Rohingya people in India refugees or illegal migrants? Supreme Court to decide
NEW DELHI: The Supreme Court on Thursday said it will examine whether Rohingyas staying in the country were refugees or illegal migrants before going ahead with hearing a batch of petitions filed on their behalf challenging their deportation and seeking basic amenities during their stay in refugee camps. Rest is consequential,' a bench of justices Surya Kant, Dipankar Datta and N Kotiswar Singh said. 'If they are refugees, they are entitled to certain protections under law. If not, they are illegal migrants and should be deported back to their country.' The four questions framed by the court in the Rohingya batch of cases included, 'whether Rohingya entrants are entitled to be declared as refugees and if so, what protection emanates from the rights they are entitled to; whether Rohingyas are illegal entrants and if government of India and states are obligated to deport them in accordance with law.' There were two consequential issues also that were framed by the court. These were: 'Even if Rohingya entrants are held to be illegal entrants, can they be detained indefinitely or they are entitled to be released on bail subject to conditions.' Lastly, it said, 'Whether Rohingya entrants who are not detained but living in refugee camps have been provided with basic amenities like drinking water, sanitation, education, etc.' The court had taken up 22 cases involving the deportation of Rohingya who were either in detention camps or claimed refugee status. Among these, the bench sought to segregate cases related to Rohingya migrants as a single batch. The other cases involving other foreigners were directed to be grouped into a separate batch to be handled separately. As the batch of cases got listed together, the bench expressed a practical difficulty in proceeding with the hearing, as some petitions spoke about the deportation of foreigners in general, while others specifically related to the condition of foreigners in detention camps. Advocate Kanu Agarwal, appearing for the central government, submitted a list of cases pertaining to Rohingya people and urged the court to decide this batch of cases first. The non-Rohingya matters, he added, seek interpretation of the Foreigners Act. The bench agreed, saying, 'The issues that arise in the other batch of cases will be determined separately on another date.' Advocate Prashant Bhushan, who was appearing in multiple petitions, said that the genesis of these cases began with cases filed by Rohingya people in 2013. He said 15 out of the batch of 22 cases pertained to Rohingya refugees and the need to provide them facilities in their camps on par with refugees recognised under the UN Convention on Refugees. India is not a signatory to this convention and has not considered granting refugee status to them. Senior advocates Ashwani Kumar and Colin Gonsalves, appearing in other matters, pointed out that the Rohingya people who hail from Myanmar have fled to India seeking asylum as they were being persecuted in their country. Gonsalves further referred to a case filed by the wife of a foreigner facing detention in Assam which concern Rohingya and non-Rohingya foreigners. In that case, Gonsalves showed orders passed by the court to expedite the deportation process despite the fact that Myanmar was unwilling to take these persons back. In May this year, while hearing an application filed by Rohingya people in Delhi, the top court refused to adopt a piecemeal approach in deciding individual cases and called for all cases pending on the issue to be listed together. The Centre has been opposing the maintainability of these petitions, citing the Supreme Court's order passed in April 2021. This order permits the Centre to take deportation measures as required under law and held that while the right to life and liberty is available to even non-citizens, the right not to be deported is ancillary but concomitant to the right to reside or settle in any part of India, which is guaranteed under Article 19(1)(e) only to citizens.
