Former All-Star hurler found 'not guilty' of assaulting 12-year-old with stick

A jury has found former All-Star and Clare All-Ireland winning hurler, Niall Gilligan not guilty of assaulting a then 12-year-old boy with a stick almost two years ago.
At Ennis Circuit Court today, the jury of seven men and five women delivered a majority 'not guilty' verdict against the charge that Mr Gilligan (48) of Rossroe, Kilmurry, Sixmilebridge had assaulted causing harm of the boy with a stick at the Jamaica Inn Hostel, Sixmilebridge on October 5, 2023.
Mr Gilligan sat impassively in the court as the court registrar read out the 'not guilty' majority verdicts in the case concerning the assault causing harm charge and producing a stick under Section 11 of the Firearms and Offensive Weapons Act at the same location on the same date.
Two women in the Gilligan family group seated at the back of the court to support Mr Gilligan wept as the 'not guilty' verdicts were called out while the parents of the then 12-year-old sitting on the opposite side of the court left the courtroom shortly after the verdicts were announced.
The jury delivered their majority 'not guilty' verdict after five hours and three minutes of deliberations and returned to the court 48 minutes after Judge Francis Comerford directed shortly after mid-day on Wednesday that they could deliver a majority 11-1 or 10-2 verdict.
Shortly before 1pm, the foreman replied "yes" when asked by the court registrar had at least 10 of the jury reached a verdict in the case.
The jury reached their verdicts after five days of evidence, closing speech by lawyers from both sides and the judge's charge in the case.
Judge Comerford thanked the jury "for the careful deliberations you have taken".
Mr Gilligan spoke briefly with his legal team of solicitor, Daragh Hassett and Patrick Whyms BL in the body of the court before leaving the courtroom.

In his closing speech to the jury, counsel for Mr Gilligan, Mr Whyms said on the evening at the Jamaica Inn hostel, Mr Gilligan "didn't know that he was dealing with a child and did not create this situation".
Mr Whyms said that Mr Gilligan "was at the end of his tether" by the vandalism being done to a vacant property he was trying to sell.
Putting forward the defence of reasonable force against the charge of assault causing harm, Mr Whyms said that Mr Gilligan was at the Jamaica Inn hostel on the night of October 5 "in the dark and believed that he was under siege".
He said: "Believing himself under threat and needing to protect himself and his property, Niall Gilligan needs to make an instant decision and so we are here."

Mr Whyms said: "And Mr Gilligan, a family man who has young children and no previous convictions gives a clear story which has't changed and an entirely credible, fulsome account of what happened."
Mr Whyms said to the jury: "Did Niall Gilligan use such force as was reasonable in the circumstances as he believed them to be and if he did then no offence was committed."
In his prepared statement at Shannon Garda Station in February 2024 on the alleged assault, Mr Whyms said that Mr Gilligan "has given a perfectly plausible account in an otherwise impeccably accurate description of what occurred which placed the boys inside the building when he met them".
On the medical evidence, Mr Whyms said: "Nobody wants to see a child being injured and it would be much better if that didn't happen and the boy was injured in this case."
He said: "There doesn't seem to be much room for argument that he was injured from the actions of Niall Gilligan."
Mr Whyms said that a displaced fracture of a finger on the boy's left hand "is the only fracture in this case".
He said: "There is an un-displaced fracture of a finger - that is not a good thing to happen but that it is what happened."
He said: "There were injuries and there were sustained in the incident but by and large, most were cleared up in the week and the last one was pretty well cleared up in two weeks."
Mr Whyms said that the injuries "don't look nice on the photographs - there is no getting away from that and injuries that are photographed immediately after don't look nice".
Mr Whyms said that the injuries sustained by the boy "are clearly regrettable".

The GAA have paid tribute to the victims of a fatal shooting in Maguiresbridge with a minute's applause at Croke Park ahead of Sunday's All-Ireland SFC final. Vanessa Whyte, who was 45, and her children, Sara (13) and James (14) died after they were shot at their home in the Co Fermanagh village on Wednesday. A male who also suffered gunshot wounds remains in a serious condition in hospital. Vanessa Whyte and her children were active members of two local GAA teams. In separate statements on Wednesday night, both St Mary's Maguiresbridge Gaelic Football Club and Lisbellaw St Patrick's Hurling Club offered "heartfelt condolences to the families and friends of those impacted by the tragic incident. Vanessa Whyte and her children, Sarah and James "We are working with the GAA at county, provincial and national level, to implement the Association's critical incident protocols. We will work closely with all appropriate services to ensure that those who require support at this difficult time can access it. "The deceased were all active and beloved members of our club. We will not be making any further comment at this difficult time." A murder investigation has been launched, and police are probing a triple murder and attempted suicide line of inquiry. Ahead of today's All-Ireland SFC final at Croke Park between Donegal and Kerry, a minute's applause was warmly received with a picture of the mother and children displayed on the big screen at Croke Park. ‘We are coming here with hearts broken': Prayer service to be held for Fermanagh shooting victims

A prayer service will be held in Co Clare for a mother and two children killed in a shooting incident in Co Fermanagh . Vanessa Whyte (45), a vet from Co Clare, her son James (14) and daughter Sara (13), were killed in a suspected triple murder and attempted suicide at a house in Maguiresbridge on Wednesday morning. Ms Whyte was originally from Barefield, a village near Ennis in Co Clare. A murder investigation has been launched, while an adult male remains in a serious condition in hospital. READ MORE A prayer service will take place at the Church of Immaculate Conception in Barefield on Sunday evening. A notice on the parish website describes it as a service to remember Vanessa, Sara and James. Barefield parish priest, Fr Tom Fitzpatrick, said the community wanted to gather together to remember the family. The prayer service has been organised to take place on Sunday evening to allow for Ms Whyte's brother, Ivor, to travel home from Australia . 'The prayer service was organised by the community, myself and the pastoral council. We planned it days ago,' Fr Fitzpatrick said. 'The purpose of the service is to gather as a community and be with the family and let them know we are thinking of them and we are here in shock and in pain. 'When something happens in a rural community, even to one person, it affects everybody. We are coming here with hearts broken. A lot of the community knew Vanessa and she was so well loved.' It is understood that the funeral of the mother and her two children will take place in Barefield later this week. On Saturday, detectives from the major investigation team, who are carrying out the murder investigation, said they are continuing with their inquiries and appealed for information involving the movements of a vehicle. Detective Chief Inspector Neil McGuinness said: 'Our investigation is ongoing and we are working tirelessly to determine the exact circumstances of this tragedy. 'I would continue to appeal generally for anyone with information to come forward, and more specifically, I would ask anyone who saw a silver Mercedes saloon car being driven in the Clones Road area of Newtownbutler, or between Maguiresbridge and Newtownbutler, on the evening of Tuesday July 22nd, to call detectives on 101, quoting reference 276 23/07/25. 'Anyone who was travelling in the area and who may have captured dashcam footage which could assist, please get in touch.' The man who remains in a serious condition in hospital was a member of the same household, the PSNI said. On Friday, hundreds of people attended a community vigil for the family in Maguiresbridge. – PA
