Musk's bid to dismiss OpenAI's harassment claims denied in court

A federal judge on Tuesday denied Elon Musk's bid to dismiss OpenAI's claims of a 'years-long harassment campaign' by the Tesla CEO against the company he co-founded in 2015 and later abandoned before ChatGPT became a global phenomenon.
In the latest turn in a court battle that kicked off last year, U.S. District Judge Yvonne Gonzalez Rogers ruled that Musk must face OpenAI's claims that the billionaire, through press statements, social media posts, legal claims and 'a sham bid for OpenAI's assets' had attempted to harm the AI startup.
Musk sued OpenAI and its CEO Sam Altman last year over the company's transition to a for-profit model, accusing the company of straying from its founding mission of developing AI for the good of humanity, not profit.
OpenAI countersued Musk in April, accusing the billionaire of engaging in fraudulent business practices under California law. Musk then asked for OpenAI's counterclaims to be dismissed or delayed until a later stage in the case.
OpenAI argued in May its countersuit should not be put on hold, and the judge on Tuesday concluded that the company's allegations were legally sufficient to proceed.
A jury trial has been scheduled for spring 2026.

X users responded by pointing out that China's DeepSeek AI hit the top spot in the App Store early this year, and Perplexity AI recently ranked number one in the App Store in India. DeepSeek and Perplexity compete with OpenAI and Musk's startup xAI. Altman called Musk's accusation 'remarkable' in a response on X, charging that Musk himself is said to 'manipulate X to benefit himself and his own companies and harm his competitors and people he doesn't like.' App Store rankings listed ChatGPT as the top free app for iPhones on Thursday, with Grok in seventh place. Factors going into App Store rankings include user engagement, reviews and the number of downloads. Grok was temporarily suspended on Monday in the latest controversy surrounding the chatbot. No official explanation was provided for the suspension, which followed multiple accusations of misinformation including the bot's misidentification of war-related images — such as a false claim that an AFP photo of a starving child in Gaza was taken in Yemen years earlier. Last month, Grok triggered an online storm after inserting antisemitic comments into answers without prompting. In a statement on Grok's X account later that month, the company apologized 'for the horrific behavior that many experienced.' A US judge has cleared the way for a trial to consider OpenAI legal claims accusing Musk — a co-founder of the company — of waging a 'relentless campaign' to damage the organization after it achieved success following his departure. The bill, which requires Meta and Google to compensate news publishers for the use of their content, is cited in a section of the report on freedom of the press. Prime Minister Mark Carney indicated last week he is open to repealing the legislation. While Meta pulled news from its platforms in response to the 2023 law, news outlets are now receiving payments from a $100 million Google fund. Carney killed a digital services tax that would have applied to many large U.S. tech companies after U.S. President Donald Trump halted trade negotiations with Canada over the tax. (TSX.V: GRZ) (BSX: (OTCQX: GDRZF) ('Gold Reserve' or the 'Company') announces that the U.S. District Court for the District of Delaware (the 'Court') issued an order today in which it adjourned the start of the Sale Hearing from the currently scheduled August 18, 2025, to an as-yet unspecified future date. The Court also requested further briefing from the parties, and scheduled an in-person hearing on August 18, 2025, on this and related issues. Article content The Court stated its rationale for the adjournment as follows: Article content The Court reaches this conclusion reluctantly, but in the face of the following realities: a Sale Hearing held on August 18 would be directed to evaluating whether to accept the Special Master's recommendation to approve the Dalinar Energy bid, but the Special Master has recently received an unsolicited bid he is currently evaluating and which he may determine is a 'Superior Proposal' to Dalinar's (as defined in the Dalinar SPA); if the Special Master determines he has received a Superior Proposal, Dalinar is entitled to time to match it; although all discovery undertaken and briefing received to date is directed to the Dalinar bid, there is some possibility the Special Master may no longer be recommending approval of that bid, which could render a Sale Hearing focused on the Dalinar bid unnecessary. While Gold Reserve may be correct that the unsolicited bid presently being evaluated is 'a non-actionable underbid' (O.I. 2050 at 2) (emphasis omitted), the Court is not able to make a determination on this point in time to go forward with a Sale Hearing four days from now, especially since the Special Master has not yet completed his evaluation of the unsolicited bid. Article content The Court stated its 'inclinations as to appropriate next steps' as follows: Article content At this time, the Court's inclinations as to the appropriate next steps are to: (i) order the Special Master to determine, no later than August 25, whether he is adhering to his recommendation of the Dalinar bid or, instead, has received a Superior Proposal; (ii) order the Special Master to submit, no later than August 29, a proposed schedule for additional limited discovery, if any, necessitated by whatever decision he has made by August 25 and any additional, streamlined briefing; (iii) reschedule the Sale Hearing for some or all of the following dates: September 15-18, October 20-23; (iv) require any entity intending to participate in the Sale Hearing to request a specific, total number of hours it will use at the hearing for its examination of witnesses and argument (to include opening statements and closing arguments); and (v) provide a schedule and page limits for expedited post-hearing briefing and submission of proposed findings of fact.
