Metro wins in Labour Court over wage increase dispute

The metro has secured a legal victory in the Labour Court, effectively nullifying the enforcement of a 5.4% salary increase for municipal workers as stipulated in a collective agreement.
Judge AJ Snyman delivered the judgment on May 10, siding with the municipality's assertion of financial incapacity to fulfil the wage hike obligations.
The legal battle goes back to a 2021 dispute when the South African Local Government Bargaining Council (SALGBC) mandated a salary increment for that year.
The metro, citing budgetary constraints, failed to implement the increase, leading to a compliance order and subsequent protests in 2023.
These demonstrations, marked by disruptions in waste collection and municipal bus services, spanned three months and resulted in damage and vandalism to city infrastructure.
In his ruling, the judge acknowledged the city's financial hardships, emphasising that the municipality's request for exemption from the collective agreement was justified, given its economic challenges.
The court's decision effectively rejects the unions' demands for the wage increase, highlighting the importance of fiscal responsibility in municipal governance.
DA Tshwane caucus leader, Cilliers Brink, welcomed the court's decision, saying that it allows the city to use funds towards stabilising finances and enhancing service delivery.
'The council's decision to apply for exemption was very difficult and was not made to spite or punish employees. The exemption application was essential to the financial rescue mission in Tshwane,' Brink remarked.
He further noted that the R600-million saved has facilitated a debt settlement agreement with Eskom and will enable future investments in essential services.
Grandi Theunissen, leader of the Freedom Front Plus in Tshwane, also expressed approval of the Labour Court's ruling.
He criticised the SALGBC for unfairly dismissing the city's exemption applications and highlighted the VF Plus' commitment to responsible financial management during its tenure in the previous coalition government.
'The Labour Court also found that the SALGBC did not give the metro a fair opportunity to present its case and that the financial information was misinterpreted,' Theunissen said.
However, the South African Municipal Workers' Union (SAMWU) has expressed strong opposition to the Labour Court judgment.
The union contends that the decision undermines collective bargaining, a fundamental right of workers.
They argue that the court overstepped its authority by substituting the SALGBC6s decision with its own, thereby setting a dangerous precedent.
The union also asserts that this move threatens the autonomy of bargaining councils and could embolden other municipalities to avoid honouring wage agreements by citing unverified financial distress.
Nkhetheni Muthavhi, deputy general secretary of SAMWU, criticised the court for disregarding critical evidence presented during arbitration, including an independent financial expert's report confirming the metro's ability to afford the agreed-upon wage increases.
'The union would like to emphasise that the adverse impact of this judgment will have on workers, especially amid rising living costs,' said Muthavhi.
He argued that the court decision prioritises the metro's fiscal arguments over the constitutional rights and well-being of the workers.
In response, the union is at present exploring legal avenues, including appeals to the Labour Appeal Court or the Constitutional Court, to challenge what they perceive as judicial overreach and misapplication of affordability criteria.
The union also condemned the metro management of the time for creating the financial crisis through mismanagement and pursuing a political agenda that attacks workers' rights.
He also commented on the present coalition government.
'It is important to emphasise that the new administration inherited and regrettably, continued the DA's witch hunt against workers, prioritising the DA's inherent animosity towards workers and neglecting the needs and livelihoods of those who serve this city,' said Muthavhi.
'We will not allow workers to bear the brunt of mismanagement and judicial bias. This judgment represents a setback, but we remain resolute in our commitment to defending workers' rights.'
The union said that it plans to brief shop stewards and convene mass meetings with members to provide updates and determine the way forward.
'The union urges all members to remain united and vigilant as they continue to fight for their rights through all available legal and collective channels,' said Muthavhi.
The metro was approached for comment, but none had been received at the time of publication.

Shamila Batohi and the NPA's week from hell — Failed extradition and calls for her resignation

There have been calls for NPA boss Shamila Batohi to resign following the entity's ongoing failure to prosecute State Capture cases. Batohi claims there are no fundamental problems in the NPA. On Friday, 6 June 2025, ActionSA called for advocate Shamila Batohi to be removed as the head of the National Prosecuting Authority (NPA) following the latest defeat in a State Capture prosecution. Meanwhile, the DA has revealed a set of reforms it believes can improve the justice system. These announcements follow this week's ruling by the Free State Division of the High Court in Bloemfontein, where Judge Philip Loubser found the extradition of Moroadi Cholota, the former personal assistant of corruption-accused former Free State premier Ace Magashule, was unlawful and unconstitutional on the basis that the extradition was requested by the NPA rather than the justice minister. This is related to the ongoing trial of 17 accused, including Magashule, over the tainted R225-million asbestos audit project in the Free State. The 17 accused, which include companies, are faced with 70 counts of corruption. On Friday morning, ActionSA parliamentary leader Athol Trollip said the party called not only for Batohi's removal as the National Director of Public Prosecutions, but a 'full parliamentary inquiry' into what they claim is the NPA's 'ongoing prosecutorial failures and the extent to which political interference has infected its operations'. Trollip said the NPA had 'once again exposed its deep dysfunction, either through incompetence or wilful neglect' in the ongoing asbestos trial and the handling of Cholota's extradition from the US. 'This is not an isolated blunder, but part of a disturbing and entrenched pattern. The NPA has become a refuge for the politically connected, a place where accountability is avoided, justice is delayed, and prosecutions collapse with shocking regularity. 'Under Shamila Batohi's leadership, the NPA reels from one scandal to the next. South Africans are left wondering if these failures are merely a result of incompetence, or is there a deliberate agenda to protect the corrupt?' said Trollip. The NPA has come under fire on multiple fronts. Accountability Now director Paul Hoffman told Daily Maverick: 'The bottom line of the judgment is that they used the wrong procedure in the extradition — they got the wrong person to ask for the extradition.' This, he said, 'upsets the entire apple cart and makes the extradition invalid, and once the extradition is invalid, then the court has got no business sitting in judgment over the person who has been extradited'. Hoffman explained: 'At the time that they did the extradition, the Supreme Court of Appeal had not made the ruling which says that it's not for the prosecutors to ask for the extradition… It's for the ministry of justice to ask for the extradition.' He continued: 'It's really not a typical bungle, but it's just another bungle.' Batohi and the NPA respond On Thursday night and Friday morning, Batohi has been on a media blitz responding to questions around the NPA. During an interview with Newzroom Afrika, Batohi confirmed her team had met with Justice and Constitutional Development Minister Mmamoloko Kubayi to reflect on this week's ruling. She revealed this centred around how pending and future extraditions would work. 'There's no fundamental problems in the NPA,' she told the broadcaster in an interview that spanned more than 2o minutes. She said that in the case of the acquittal of Nigerian televangelist Timothy Omotoso on charges of rape and human trafficking, among others, 'that broke my heart' because of her fight for justice for victims of gender-based violence. Batohi said: 'It's easy to put Shamila Batohi as the face of failure, but we really need to look at the challenges we're facing (systemically).' In addition, she said that while she was 'disappointed by the setbacks' within prosecutions, she was 'proud of the progress so far' by NPA staff, the majority of whom she said were 'dedicated and committed' to the rule of law. DA calls for reforms Following the Cholota ruling, the DA said it would write to Parliament's justice committee so the NPA could 'account for yet another unacceptable failure in prosecuting State Capture cases'. On Friday, the party's spokesperson on justice, Glynnis Breytenbach, said the DA would bring the issue to next Tuesday's justice committee meeting. During a media briefing on Friday morning, Breytenbach, a former state prosecutor, said: 'In the high-profile State Capture matter involving Ace Magashule's former PA, Moroadi Cholota, the NPA bungled the extradition request by using the wrong authority — a mistake that now risks derailing accountability in yet another major case.' The party is proposing a set of reforms, including passing the DA's 'Scorpions 2.0' Bill to create an independent Anti-Corruption Commission with the power to investigate and prosecute high-level corruption, free from political interference; amending the Constitution to ensure the NPA head is appointed by Parliament, and not by the president; the introduction of a dedicated parliamentary oversight subcommittee to keep the NPA accountable; and fighting for better funding, smarter recruitment, and stronger retention of experienced prosecutors. Breytenbach dismissed calls for Batohi's removal. She said the party would not table such a motion, and 'we would certainly not support it'. 'The national director is not the problem at the NPA. It's not a one-man job or a one-woman job. While I think that she could possibly have done things differently, she is not doing a bad job, and the failures of the NPA are not, you know, attributable to her and her alone.' Breytenbach said the process of appointing Batohi's replacement was 'something that concerns us deeply, and we've raised that more than a year ago already'. Batohi will turn 65 in January 2026 and retire at that point. Breytenbach said the process should include public participation, following the process President Cyril Ramaphosa used to appoint Batohi. This, she said, was laudable: 'So we're hoping that he will do that again.' She said the longer the process was postponed, the more dangerous it could become. 'It's a process that I would like to see start yesterday,' she said. DM

Image: Supplied Comrades Marathon runners and spectators could witness innovations along the route to make it a memorable, fun, and vibrant event, stated the KwaZulu-Natal Tourism and Film Authority on Friday. The economic spin-off from the Comrades Marathon Down Run, from Pietermaritzburg to Durban, on Sunday is expected to reach over R600 million for the host cities of Durban and Pietermaritzburg, said Sibusiso Gumbi, the acting Chief Executive of the KwaZulu-Natal Tourism and Film Authority, which has partnered with the Comrades Marathon Association (CMA). 'With all eyes on the race, we are hoping that it will inspire people, whether they watch it on the roadside or on their televisions, to choose KZN for their next holiday or attend one of our many sporting events that are hosted in our province,' he added. Gumbi said at least 1800 jobs were created because the CMA brings more visitors to the region than any other big international sporting event. 'We have everything a tourist could wish for: beautiful scenery, the beach, the bush, and the Berg, diverse attractions, including game reserves and safari experiences,' he said. Next Stay Close ✕ Meanwhile, CMA General Manager, Alain Dalais, said 22,677 runners have qualified for the 2025 ultra-marathon – 20% of the field are women, and organisers are expecting at least 24,000 to start the race. 'With the route going through some suburbs, there will be 47 refreshment stations and several 'fun, vibey' activation points and spectator zones to support the runners,' Dalais said. The previous record for the Down Run was 19,047 runners set in 2018. The ultra-marathon has attracted 3,063 international runners: 1,282 from the rest of Africa and 1,781 from countries outside Africa. 'We expect those international athletes to bring around another 3,000 family, loved ones, and travelling companions with them; hence, some 6,000 international visitors will be coming to the province,' Dalais said. 'The street finish in Durban is another innovation this year, with one of the biggest bonuses for the runners being that they won't need to climb stairs after finishing, as has been the case in previous years.' Hotelier Brett Tungay, board chairman of the regional branch of the Federated Hospitality Association of Southern Africa (Fedhasa) said: 'Bearing in mind the overall trajectory of the year for KZN, there is a real sense of optimism in tourism circles. The hospitality industry was expecting positive tourism figures driven by the participation of international runners and the influx of domestic visitors from various regions of the country.' The eThekwini Municipality stated that the Cleansing and Solid Waste Unit is working full force, conducting a pre-Comrade's Marathon route clean-up. Teams are picking up litter, sweeping the street, and clearing illegal dumps to ensure the route is spotless. The Msunduzi Municipality indicated that it has completed all route preparations and is ready to welcome thousands of athletes and spectators to Pietermaritzburg. The Comrades Marathon, taking place on Sunday, is expected to attract thousands of athletes and spectators to the Durban shores.
