Online Safety Act gazetted, enforcement pending completion of regulations

KUALA LUMPUR: The Online Safety Act 2024 will be enforced once the Malaysian Communications and Multimedia Commission (MCMC) finalises 10 regulations needed to implement the law.
Communications Minister Datuk Fahmi Fadzil said the MCMC has been tasked with drafting the regulations.
"Five have been completed and there are five more that we need to manage, some of which involve ongoing discussions with industry stakeholders," he told reporters after attending the Tun Abdul Razak Broadcasting and Information Institute (IPPTAR) Open Day today.
Fahmi said the act was gazetted on May 22.
"We need a bit more time to finalise these regulations," he added.
Fahmi said he had discussed with Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said on the formation of the Online Safety Committee, which will be established under her purview, as stipulated in the act.
"I see no issue with setting up the committee while the guidelines are still being developed and finalised," he added.
On June 16, Minister in the Prime Minister's Department (Law and Institutional Reform), Datuk Seri Azalina Othman Said said the Online Safety Act 2024 received royal assent from His Majesty Sultan Ibrahim, King of Malaysia.
She said the law had been gazetted and now awaits the signature of Fahmi to set the enforcement date.
Azalina said once signed and the law came into effect, the government would be able to immediately take down unlawful postings.
According to the law, there are also expectations on the platform providers to have a certain duty of care.
The Dewan Rakyat in December last year gave the nod to the Online Safety Bill which requires social media platform providers to comply with three main responsibilities, namely ensuring platform safety, protecting children under 13 and restricting access to harmful content.
These platforms would also need to submit an annual Digital Safety Plan detailing their safety strategies and accomplishments.
Meanwhile, in another development, Fahmi said the Malaysian Media Council will be involved in developing guidelines for the use of artificial intelligence (AI) in the media sector.
"Based on the journalism code of ethics we have developed previously, we can have a similar set of guidelines for AI use.
"With the establishment of the Malaysian Media Council, I believe it has an important role to play. By involving the council, industry stakeholders as well as the government and ministry, we can carefully assess the benefits and exercise necessary caution when using AI, particularly in the media sector.

Fahmi also announced a nationwide online briefing tonight to grassroots leaders to explain the government's initiatives under the 13MP. 'When we support grassroots efforts in spreading government aspirations, the people benefit in the long run,' he said. Earlier today, Anwar tabled the 13MP in the Dewan Rakyat, which included major reforms to the education and economic systems, and policies for an ageing population.

GENERAL KUALA LUMPUR, July 31 (Bernama) -- Less than 12 hours after the tabling of the 13th Malaysia Plan (13MP), the Communications Ministry will hold a briefing session tonight for the MADANI Community and National Information Dissemination Centre (NADI) managers to explain the plan's implementation to grassroots policy drivers. Communications Minister Datuk Fahmi Fadzil said the online session will involve 1,878 MADANI Communities and 1,099 NADI managers nationwide. He said the session is important to ensure that the efforts and initiatives of the MADANI Government are understood and widely disseminated to the public. 'We believe that by supporting the MADANI Community and NADI managers in spreading the government's efforts and intentions, the people will ultimately benefit. We expect more than 3,000 people to tune in to the briefing,' he said at a press conference after Prime Minister Datuk Seri Anwar Ibrahim presented the 13MP in the Dewan Rakyat today. Fahmi, who is also the MADANI Government spokesman, said the 13MP, themed "Melakar Semula Pembangunan" (Redesigning Development), reflects the ideals of the MADANI Government under the MADANI Economy framework for the 2026–2030 period. 'We take into account and understand the various opportunities presented by megatrends as well as existing domestic challenges. The 13MP aims to address all dimensions, including economic sustainability, people's well-being, environmental conservation and the strengthening of governance,' he said. He added that the 13MP also focuses on advanced technologies, including artificial intelligence (AI), with hopes of positioning Malaysia among the world's leading AI-driven nations within the next five years. Fahmi said the Communications Ministry will focus on developing the creative economy ecosystem and strengthening digital infrastructure through MyCreative Ventures and the National Film Development Corporation Malaysia (FINAS), particularly in the animation industry. 'I'm glad to highlight efforts to strengthen the creative or 'orange' economy ecosystem, where we hope several initiatives will enhance competitiveness through the production of high commercial-value works for both domestic and international audiences,' he said.

"The aim is to ensure the government's efforts under the Madani administration, through 13MP, are clearly understood by grassroots movers on the ground. "We believe that when we empower the Madani community and NADI managers to disseminate the government's goals and initiatives, the people will ultimately benefit," he told a press conference today. Fahmi said the briefing would use simple language to ensure clarity and inclusiveness among participants. He added that the ministry would continue its outreach efforts in the lead-up to the tabling of the 13MP next year to foster greater understanding and support for national development plans. Meanwhile, Fahmi said one of the targets under the 13MP was to expand Internet access nationwide and make it more affordable for the people. He said the government was committed to ensuring that the Internet is safer, especially for children and families. Fahmi said the government aimed to roll out a national digital ID system for individuals and businesses to enable secure access to global payments and improve digital marketability. "This follows feedback from various stakeholders, including civil society and non-governmental organisations, which have raised concerns about the misuse of the Internet, especially in social media, to exploit children," he said. Fahmi added that the 13MP would also support Malaysia's ambition to become a global leader in artificial intelligence while boosting the country's creative economy.
