The Social Welfare Department has strengthened its efforts to ensure that all government and private companies set up an Internal Complaints Committee (ICC) under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
Following the 2024 Supreme Court ruling mandating strict implementation of the POSH Act guidelines, the department has so far briefed the School Education Department, Higher Education Department, Labour Department, and the Revenue Department to set up the committee in their institutions.
'It is necessary that awareness regarding sexual harassment at workplaces is improved. There are still many who are not aware of these norms, and hence, the safety of women at workplaces is compromised,' a senior Social Welfare official said.
Stating that the department has seen an increase in reports on ICCs since 2022, the official said, 'We have received over 48,000 annual reports of ICCs present in Chennai last year compared to the 3,000 reports we received in the 2022-2023 financial year.'
The department is now focusing on ensuring the establishment of ICCs in the government sector before moving to private institutions. Further, institutions that have not set up an ICC will be levied a fine of ₹50,000. on institutions that haven't set up an ICC. 'Any organisation or society with more than 10 employees should have an ICC set up, the official added.

Chennai: A Tamil Nadu law regulating online real-money games like rummy and poker by introducing age, money, time and ad restrictions, besides two-stage Aadhaar-based verification, has been upheld by Madras high court . "In true essence, the online real money games is a trade activity, which, if left unregulated, has immediate implications on health of the public," a division bench of Justice S M Subramaniam and Justice K Rajasekar said on Tuesday. Bench made the observation while dismissing a batch of petitions moved by online gaming platforms challenging validity of restrictions. Refusing to concur with the platforms which contended that a state govt lacks power to bring in such restrictions, the court said, "Both the Union and state govts have power to enact laws in their own respective subject matter apart from the common pool as enabled in List III (concurrent list). This court cannot hold that state is barred from enacting laws regulating online real money games. It is covered under the subject matter of public health and sanitation which comes under List II (state list)," judges said. The argument that Information Technology Rules, 2021 already prescribe a regulatory framework for intermediaries, including online gaming platforms, and hence the state cannot frame a subordinate legislation is unacceptable, the court said. "This court views that the state is fully within its competence to enact laws pertaining to online real money games. This court on perusal of the provisions of the Act (state legislation) finds no contradictions or provisions that run contrary to the central rules in force," the bench said. Moreover, the provisions related to online gaming under IT Rules, 2021 is yet to take effect and remains unenforceable as of today. So there exists a vacuum in regulating online games, the court pointed out. The judges added that they are of the view that the state govt has rightfully taken adequate steps to fill in the vacuum by framing the legislation. Rejecting argument that mandatory Aadhaar verification violates privacy of a player, bench said, "Right to privacy carries with it its own limitations and cannot be claimed in absolute. When put on a scale, a compelling public interest outweighs right to privacy."

Delhi HC quashes POCSO case at victim's request, directs accused to perform community service

The Delhi High Court has quashed a Protection of Children from Sexual Offences (POCSO) Act case following the victim's request. The court asked the accused to perform community service at a government hospital for a month and deposit ₹50,000 towards the Army Battle Casualties Welfare Fund. 2019 case The accused had been booked in an FIR registered in 2019 on IPC sections pertaining to voyeurism, assault on a woman with intent to outrage her modesty, criminal intimidation, and sexual harassment, among others, apart from the relevant sections of the POCSO Act. In her complaint, the minor girl said the accused had pressured her into sharing intimate photographs. After communication between the two ceased, the accused allegedly threatened to share her photos online and demanded ₹6,000 from her in February 2018. The victim said she 'made several payments under duress', and later, a friend of the accused also blackmailed her for money. In his May 27 order, Justice Sanjeev Narula stated that the allegations were 'undoubtedly serious', involving charges of harassment and exploitation of a minor girl, which disclosed 'a pattern emblematic of the darker undercurrents of the social media age, where technology is misused to exert control, induce fear, and compromise dignity'. Ordinarily, such allegations, he added, would not merit quashing of the FIR, but it considered the victim's 'desire to move on from this chapter'. The court then ordered the quashing of the FIR, based on the accused's undertaking that he had not retained the photographs. It directed the accused to perform a month of community service at Lok Nayak Hospital.
