Life imprisonment with no chance of parole until September 2034 is the sentence for a Honduran man who stabbed his migrant worker girlfriend 48 times.
David Enrique Espinoza Montes, 41, showed no emotion as he received his sentence in a courtroom at the Superior Court of Justice in Windsor on Wednesday.
Justice Joseph Perfetto described Espinoza Montes' crime as "particularly callous and senseless," and said the attack itself was "gratuitous and vicious."
"There is no question (the victim) was terrified," Perfetto told the court. "There was no mercy shown to her."
But the judge said he believes that Espinoza Montes' expressions of regret are sincere.
"In my view, Mr. Espinoza Montes has insight into his offending, and the deep impacts associated with it," Perfetto told the court.
"I am satisfied that Mr. Espinoza Montes is remorseful for his conduct."
The killing of 33-year-old Shermaine Carling occurred on Sept. 29, 2022, in a rooming house in Leamington.
According to the agreed upon statement of facts, Espinoza Montes attacked Carling in a jealous rage after learning she had been seeing another man.
Espinoza Montes inflicted 48 stab wounds on Carling's neck, torso, and back using a kitchen knife and a pair of scissors.
Immediately after the attack, Espinoza Montes remained at the scene and surrendered himself to police.
Earlier this year, Espinoza Montes pleaded guilty to a charge of second-degree murder. The charge carries an automatic life sentence in Canada.
Perfetto agreed with a joint sentencing recommendation from the Crown and the defence that Espinoza Montes should not have eligibility for parole until 12 years of incarceration.
Espinoza Montes has been in custody since his arrest almost three years ago.
Perfetto said the offender entering a guilty plea was the most significant mitigating factor in the sentencing, as it spared Carling's family — which includes two children — from the hardship of a trial.
Perfetto noted that Espinoza Montes had no prior criminal record, and has been participating in counselling and anger management programs at the South West Detention Centre.
"Other than this offence, there is no evidence that he is a violent person," the judge said.
The judge acknowledged that this case can be categorized as intimate partner violence.
Assistant Crown attorney Nicole Stortini agreed. "It is a very sad case of intimate partner violence," she said outside the courthouse. "The family is going through palpable grief, and they were very clear in expressing their grief."
Fellow assistant Crown attorney Jayme Lesperance pointed to the victim impact statements provided by Carling's family members. "(This murder) had a profound impact on children, cousins, siblings, and parents. We could never help with this wake of grief. We just hope this gives them some finality."
Espinoza Montes' status in Canada remains uncertain. He came to Essex County from the Honduras under a temporary foreign worker visa. But at the time of the murder, that visa had expired, and he was in the process of a refugee application.
The judge said he agrees with the Crown and the defence that immigration consequences should have no bearing on this sentencing.
Outside the courthouse, Lesperance said the Crown doesn't know if Esperanza Montes will be deported, and that will be matter for an immigration courts.
Justice Perfetto reserved his final comments for the victim's family in the Phillippines, who attended the courtroom virtually.
"It is difficult if not impossible for this court to console you," Perfetto told them. "There is nothing this court can do to undo the past... I wish that were different."
"However, I hope that as time passes, you will find healing and peace."

Cameras on a Tesla captured the moments that two suspects allegedly took off with a safe they stole from a home in Woodland Hills on Sunday. After they load the safe into the back of their vehicle they began to flee, but the Tesla driver followed them for a short distance, according to the driver. They said that once the suspects appeared to notice they were being followed, they performed a quick u-turn, which caused them to clip another vehicle. A neighbor who witnessed the crash said that the suspects sped from the area despite the tire being damaged in the collision. "He literally took off full speed, skidding with the tire track," said the neighbor. No injuries were reported in the incident and no arrested have been announced by police.

A man was shot to death inside of a 7-Eleven store in Lawndale on Sunday night. The shooting happened a little after 8 p.m. at the convenience store located in the 15800 block of Prairie Drive, according to the Los Angeles County Sheriff's Department. Deputies arrived and found one man suffering from a fatal gunshot wound. He was declared dead at the scene by paramedics. The victim has not yet been identified. There was no information immediately available on the motive or suspects involved in the shooting. SkyCal flew over the 7-Eleven shortly after the incident was reported, where deputies could be seen surveying the area. The entrance to the store was blocked off by yellow tape. Just two weeks after "American Idol" producer Robin Kaye and her husband were shot and killed in their Encino home, another possible shooting next door has outraged neighbors who are struggling to feel safe in the midst of a concerning wave of crime affecting their neighborhood. Hundreds of people flooded the White Oak Avenue home for a party that had to be broken up by police late Saturday night, shown in cell phone video captured by neighbors. They say that the house has been a constant issue, and despite complaints, nothing has yet been done. "This party house would've been shut down in Beverly Hills, would've been shut down in Burbank, but in LA you can break the law and there's no consequences," said Rob Glushon, the president of the Encino Property Owners Association. "We're very supportive of LAPD, but honestly they need to be tougher. This is an example of when something gets out of control because the law doesn't get enforced when the problem starts." It's just the latest issue in a growing trend that has seen the neighborhood plagued by break-ins, burglaries, robberies and murder. A community meeting days after the deadly double-shooting brought hundreds of concerned neighbors in front of law enforcement and city leaders who said changes were being made. Hours later, two homes were targeted in attempted burglaries, including one at a home belonging to former "Real Housewives of Beverly Hills" star Teddi Mellencamp. Neighbors say that that the party house is emblematic of Encino's problems in dealing with lawlessness. "That just kind of talks to the issue that we have in this whole community, where there's so many awful things going on, the burglaries and party houses and even murders," said Roy Nwaisser, president of the Encino Neighborhood Council. "It really does break my heart." In coming days, residents will join a zoom meeting with Mayor Karen Bass, their Los Angeles City Council representative and more LAPD officers to give a list of demands.
