
Mother who lost arm and leg in 'devastating' Tube accident takes TfL to court
A mother, who lost an arm and leg after falling on the train tracks and being hit by a tube, says she is "terrified" every time her daughters get the Underground, as she takes Transport for London to court.
In September 2022, Sarah de Lagarde, 47, slipped on a platform at High Barnet station, in north London, and fell down the gap between the train and the platform.
After being hit by two separate trains, she was taken to hospital and had to have an arm and a leg amputated, and now uses two prosthetic limbs.
She tells ITV News London it had a "devastating impact" on her life, with her husband and children becoming her carers.
While the payment claim is large, she says she would "trade anything to get her limbs back".
Mrs De Lagarde is bringing a legal claim against London Underground Ltd (LUL), which is part of Transport for London (TfL).
The first hearing in the case was held at the Royal Courts of Justice on Wednesday for breach of duty.
Speaking to ITV News London, she said she was bringing about the action as TfL is not doing enough to make the underground safe.
She said: "I really think that this is a bigger issue than just my case. This is affecting millions of commuters.
"I have two daughters who are of age to use public transport. I am absolutely terrified every time they go because I know the risks they're taking and I know that safety is a real issue. "
At the preliminary hearing, Judge Roger Eastman said an eight-week trial would likely take place at the beginning of 2027, with a further hearing due to take place in September this year.
He also said: 'I appreciate this is a very high value claim, potentially, and very serious claim.'James MacDonald, representing Mrs De Lagarde, told the court the case was 'not an ordinary personal injury case'.
In written submissions, he said the issues the trial judge will have to decide include whether LUL was in breach by not having a system in place to ensure that the Platform Train Interface (PTI) is monitored as passengers are getting off a train at a terminus station.
Another issue is whether LUL 'was in breach by virtue of its train operators not being trained to look for passengers on the tracks when entering a station'.
Prashant Popat KC, for LUL, said: 'We recognise that this is a tragic case, and the claimant sustained some horrific injuries.'
In written submissions, he added: 'The defendant denies these allegations.
'It also pleads contributory negligence.
'The parties are agreed that the case should proceed first towards a preliminary issue trial on liability. This would encompass breach of duty, causation and the issue of contributory negligence.'
A TfL spokesperson said: 'We are responding to a legal claim brought by Sarah de Lagarde. It is not appropriate to discuss details of our defence while this case is ongoing.
'Our thoughts continue to be with Sarah and her family following this terrible incident, and we will continue to make every possible effort to learn from any incident on the Tube network. Safety is our top priority and we will always place it at the forefront of our thinking.'

TfL chief accuses campaigners of spraying Tube graffiti just so they can clear it up
The Transport for London (TfL) chief has accused campaigners of spraying graffiti on the London Tube so that they can then clean it up. Andy Lord, the TfL commissioner, also told the vigilante cleaners to stop taking matters into their own hands. Videos of Londoners donning hi-vis vests and clearing up graffiti-covered Tube carriages have flooded social media in recent weeks. Speaking at a London Assembly meeting on Thursday morning, Mr Lord said: 'Firstly, I would ask anybody not to take this matter into their own hands. 'We also have evidence of people creating graffiti and then removing it, so that is being investigated by the relevant authorities.' The TfL commissioner conceded that there had been a 'spike' in graffiti particularly on the Bakerloo and Central lines, but insisted that 'significant action' had been taken to remove it in the past two to three months. A TfL spokesman said: 'We know that some people are keen to help in cleaning up graffiti when it appears on our network and we recognise their spirit of volunteerism. 'However, we are extremely experienced in dealing with it and understand which processes and equipment are needed to effectively remove it. 'We therefore ask that it is left to our professional cleaners to remove. All instances of graffiti are investigated by TfL to help prevent them in the future.' Mr Lord said his teams were removing about 3,000 tags a week from the Bakerloo and Central lines, neither of which have on-board CCTV cameras. He said cleaners were removing 'one act of graffiti every 11 minutes across our Tube fleet'. Since TfL launched its 'accelerated cleaning programme' in April, more than 70 per cent of Bakerloo trains have been cleaned, with about 17,00 tags removed. TfL has removed more than 19,000 tags from the Central line fleet since mid-April. A shortage of Bakerloo and Central line trains has exacerbated the problem, as it is harder to withdraw trains from service without impacting services. TfL previously admitted an increase in graffiti on the Bakerloo line was partly attributable to its automatic washer being out of action for weeks because of a track defect at the depot. The Mayor of London Sir Sadiq Khan has said he is wary of giving too much air time to the graffiti problem as he doesn't want to 'reward bad behaviour'. He told a discussion at the TfL board on Wednesday: 'Every graffiti is photographed before it is taken down. What we don't want to do is amplify the work of these people. We don't want to reward bad behaviour by publicising it.' Last year, a brand new Tube train was vandalised with graffiti before it had even made it into service. The Piccadilly line train was tagged while it was in transit from the manufacturer to the depot.

A corporate affairs executive who lost an arm and a leg after being hit by two Tube trains caused her own injuries through 'negligence', Transport for London (TfL) has claimed. Sarah de Lagarde, 46, had two limbs amputated after falling into the gap between the train and platform at High Barnet station in north London in 2022. The mother of two, who was returning home from work at the City investment firm Janus Henderson, brought a High Court case against TfL and is seeking damages of more than £25 million. He did not investigate further and TfL's submission stated that he 'did not see or hear the claimant at that point and did not look into the gap, having no reason to do so'. De Lagarde again called out for help but no one came and the train departed from the station, taking her right arm with it. She managed to reach her phone but her face was so badly injured she was unable to unlock it using Face ID. Rain meant it was too wet for the touchscreen to function. She again cried out for help and again no one came. Then a second train arrived at the station, running over her right leg. De Lagarde was not found until the driver of a train on a different platform heard her shouts and called the emergency services. Air Ambulance paramedics crawled under the train to reach her and later received a national bravery award. De Lagarde had surgery at the Royal London Hospital and was later transferred to the amputee rehabilitation unit in Lambeth, south London, until being discharged on December 1, 2022. She posted on Instagram today: 'I'm not a freak incident, I'm one of 162 people a month who get injured or killed on the TfL network. It's a systemic failure while senior leaders are enjoying their six-figure salaries and performance bonuses. The London Underground was once iconic. Now it's described as dirty and dangerous. 'While ticket prices keep increasing, service keeps declining. TfL tells us to 'See it. Say it. Sorted'. Well, if you see something that needs fixing, say it — log it with TfL and write to your MP. It's time for TfL to put passengers before profit and sort it.' De Lagarde's claim states: 'The breaches of duty caused the claimant to suffer life-changing injuries.' Thomas Jervis, the Leigh Day partner representing De Lagarde, said: 'Like millions of other Londoners, Sarah de Lagarde was just trying to get home from work when she was hit by two Tube trains at High Barnet station. Transport for London is refusing to accept liability and positively blames Sarah for what happened.' A spokesman for TfL said: 'We are responding to a legal claim brought by Sarah de Lagarde. It is not appropriate to discuss details of our defence while this case is ongoing. Our thoughts continue to be with Sarah and her family following this terrible incident and we will continue to make every possible effort to learn from any incident on the Tube network. Eight arrested over conspiracy to destroy Ulez cameras
Eight people have been arrested over an alleged conspiracy to destroy Ulez cameras, the Metropolitan Police said. A co-ordinated operation conducted by the force has seen six men and two women arrested on suspicion of conspiracy to commit criminal damage. One of the men is also alleged to have been involved in threatening and harassing the team sent to repair a damaged camera. The Met made the arrests at addresses in London, Windsor and on the Isle of Sheppey in the early hours of Wednesday. The London arrests took place in Uxbridge, Ickenham, Northwood, Sutton and Eltham. Those arrested remain in custody. Searches are ongoing at the addresses but officers say they have already recovered items related to the alleged offending. Superintendent Paul Thomas, of the Met's Roads and Transport Policing Command, said: 'There is a big difference between lawful protest and plotting to destroy or seriously damage property. 'Some may think of this sort of behaviour as a victimless crime, but when cameras are damaged or destroyed it creates dangerous hazards, risking collisions on the road in addition to disruption for motorists and residents. 'We take these offences very seriously and officers will continue working closely with Transport for London and other partners to identify and build a case against those responsible. 'Today's arrests are a significant development in what has been a long and complex investigation that is not yet over. 'I would appeal to anyone who has information about plans to target Ulez cameras to come forward.'
