Malaysian Bar supports federal child maintenance enforcement framework

KUALA LUMPUR: The Malaysian Bar stands ready to assist in the establishment of a federal framework to strengthen the enforcement of court-ordered child maintenance through legal analysis and consultations aspects, said its president Mohamad Ezri Abdul Wahab.
He said the Malaysian Bar also welcomes the call made in Parliament during the debate on the 13th Malaysia Plan on the establishment the framework, noted that the proposal represents an important opportunity to address one of the most persistent challenges in the family justice system, the non-compliance with maintenance orders.
For far too long, Mohamad Ezri said custodial parents have borne the burden of pursuing errant payors through lengthy and emotionally draining enforcement procedures.
'This has left many parents, and the children in their care, facing financial insecurity following separation or divorce. The Malaysian Bar stands ready to assist in developing this proposal through legal analysis, consultation, and engagement with the relevant ministries, state authorities, and stakeholders.
'We believe that strengthening the enforcement of maintenance orders is a shared responsibility that will benefit the well-being of children and the long-term stability of families,' he said in a statement today.
Mohamad Ezri said the Malaysian Bar advocates for systemic reforms that make family law processes more accessible, effective, and fair.
He noted that a dedicated enforcement framework or agency, developed in line with Malaysia's constitutional structure and jurisdictional boundaries, could help ensure that children's rights to financial support are protected and realised.
It would also reduce the strain on the courts, lower legal costs for vulnerable parties, and strengthen the family institution, he added.
He noted that in some jurisdictions, as seen with the United Kingdom's Child Maintenance Service and Canada's provincial and territorial Maintenance Enforcement Programs, enforcement mechanisms include direct wage deductions and other measures aimed at ensuring compliance.
'While Malaysia must design a system suited to its own laws and social context, the underlying principle that maintenance for children is not a voluntary act but a legal obligation should be firmly upheld.
'Any initiative must be inclusive and non-discriminatory, serving all eligible children and parents regardless of race, religion, or socio-economic background, and operating within the respective jurisdictions of the civil and Syariah courts,' he said. - Bernama

Meanwhile, Anwar said Malaysia continued to face wastage issues, particularly involving Non-Revenue Water (NRW) due to usage practices and weaknesses in the old piping system. He said Deputy Prime Minister Datuk Seri Fadillah Yusof, who is also the minister responsible, had raised the matter numerous times during Cabinet meetings. Following discussions, it would be made one of the priorities under the 13th Malaysia Plan (13MP). The Prime Minister said in terms of water management, ensuring comfort and meeting the people's needs remained the government's main priority. 'How can a country with an abundance of water, with floods two or three times a year, still face water shortages? That means something is wrong, not because of Allah's will, but due to a lack of human ingenuity. 'Take Jordan, for example. They may only have heavy rain two or three times a year, but they are able to store water for times of need. That is why our technology must not only focus on advancement but also ensure water-saving measures are in place,' said Anwar, who is also the Finance Minister. - Bernama

Govt to draft new act for early childhood education in 13MP

KUALA LUMPUR: The Education Ministry will draft a new Act on early childhood education to ensure comprehensive and effective regulatory oversight, said Education Minister Fadhlina Sidek. Speaking in the Dewan Rakyat, she said that as part of efforts to enhance educational outcomes, the government, under the 13th Malaysia Plan, will introduce a comprehensive transformation that addresses every level of learning. "In the context of early childhood education, a new Act will be drafted to ensure comprehensive and effective regulatory oversight," he said in her winding-up speech on the 13th Malaysia Plan. When tabling the 13th Malaysia Plan, Prime Minister Datuk Seri Anwar Ibrahim said the government will make preschool education compulsory from the age of five to enhance educational outcomes. Fadhlina added that she echoed Datuk Seri Saifuddin Abdullah (PN-Indera Mahkota)'s suggestion for preschool curriculum to be developed based on the developmental needs of children. She said the ministry would introduce the Preschool Curriculum 2026, which will be anchored in the School Curriculum Framework 2027. "This curriculum emphasises character building, self-confidence, values of compassion, and resilience through experiential approaches that are age-appropriate. "Accordingly, the national preschool curriculum will be made mandatory for all early childhood education institutions, with emphasis on human dignity (karamah insaniah), character development, critical thinking, and life skills. "To ensure its successful implementation, mastery of this curriculum will be prioritised," she added. She added that the ministry has also expanded access to preschool and leveraged on all available spaces, including in secondary schools, Teachers' Education Institute (IPG), vocational colleges, among others. "The priority is to ensure that parents and the community are encouraged and made aware of the importance of preschool education. "We also see that the new 2026 preschool curriculum is very important," she said. She added that under the 13th Malaysia Plan, the government will establish a National Education Council (NEC) tasked with coordinating, monitoring, and recommending strategic interventions. She said the ministry, along with the Higher Education Ministry, is working closely to prepare a Joint Cabinet Memorandum, which is expected to be tabled in mid-September 2025. In terms of membership, she said, the NEC will comprise representatives from various ministries, government agencies, academia, industry, NGOs, and GLCs to ensure that decisions made are inclusive. "The establishment of the NEC will serve to coordinate and monitor the implementation of policies, as well as to identify appropriate intervention measures to ensure that the education system remains relevant and effective," she said.
